POLICY It is the policy of the Department of Corrections (DOC) to govern the control and safeguarding of offender personal property. [4-4294] Offenders will be allowed to retain in their possession an authorized amount of personal, state, and religious property. The DOC will specify the limit of personal property and funds belonging to offenders; these procedures are made available to offenders upon admission and when updated. [4-4292] [4-4293] The DOC may limit, change, or disallow items which are currently authorized to prevent compromise of security, good order, and discipline of the facilities.

II. PURPOSE The purpose of this administrative regulation (AR) is to prescribe consistent limitations for the volume and type of property allowed to be maintained by an offender and to provide instructions for the acquisition, identification, transportation, storage, and disposal of offender property.

III. DEFINITIONS A. Americans with Disabilities Act Inmate Coordinator (AIC): DOC employee within the Office of Legal Services who is designated to coordinate efforts to comply with and carryout responsibilities under the Americans with Disability Act (ADA) and ADA Litigation Remedial Plan. B. Approved Source of Supply: Publisher, retail/wholesale dealer of mail order products for books (used books will not be accepted from any approved source of supply) magazines, hobby craft, faith items, and health care items, or other items as determined by the administrative head, with an address or post office box and phone number, verifiable with a commercial directory service. C. Computerized Property Inventory: A computerized inventory system administered by the Department to track and monitor state issued and acquired personal property in the possession of offenders during their period of incarceration. This electronic inventory is considered part of the offender’s file D. Contraband: Any item that a DOC employee, contract worker, volunteer, visitor, or offender is not specifically authorized to have in his/her possession; any item that has been altered and/or is being used for other than its intended purpose; any publication deemed as contraband pursuant to AR 300-26, Publications; any item(s) over the three cubic foot allowable personal property limit; any item listed in the Offender Visitor Consent to Search Authorization (AR Form 300-01B); any item listed in the Code of Penal Discipline; any item listed on the administrative head’s “Declaration of Contraband”; and any item that may threaten the safety and security of a DOC facility, DOC employees, contract workers, volunteers,

offenders, or visitors or any item listed as contraband in an administrative regulation. E. Faith Group Items: Items that are specifically for the purpose of faith group practices. Some items may be restricted based on facility security levels. F.

Grandfathered: The allowance for existing property items to remain in the offender’s possession despite a change in policy. The property item must have been originally obtained in accordance with policies that were in effect at the time.

G. Health Care Appliances: Medical equipment, or medical support equipment that have been prescribed for the offender and approved and/or issued by Clinical Services. H. Legal Papers: Pleadings and resource documents (e.g., case law, court rules, statutes, transcripts, legal forms, etc.). I.

Liability Limits: DOC limits its liability for offender property that may be lost, stolen, damaged, or destroyed to an aggregate maximum of $300.00.

J.

Medical Shoes: Shoes for an offender that have been prescribed by a licensed health care provider for a specific medical condition. These shoes may be boots or soft soled shoes.

K. Offender Property Inventory : Document for inventorying allowable property (except perishable items) that the offender possesses. This document also serves as the offender’s cell permit for his/her property. This form does not automatically authorize offenders to procure all items on the form. Offenders are not permitted to maintain more than three cubic feet of property (both state and personal) plus two cubic feet of legal material in his/her cell, excluding electrical items and health care appliances.

IV. PROCEDURES A. General: 1.

A computerized inventory will be maintained for each offender documenting state issued items as well as items purchased through canteen or other approved sources of supply. A copy of the inventory will be given to the offender. Any time a personal property item is received or discarded the offender’s computerized property inventory will be updated and a copy forwarded to the offender. [4-4294] a.

Offenders are responsible for ensuring this update.

b.

Offenders are required to keep all receipts on property items purchased for proof of ownership for as long as they maintain the property item.

c.

Any property not listed on the offender’s computerized property inventory will be deemed contraband and disposed of in accordance with AR 300-06, Searches and Contraband Control.

d.

DC Form 850-06A, Offender Property Inventory is used any time an offender’s property is inventoried for storage or transfer to another facility,. 1) A copy of the offender’s current computerized inventory is referenced to conduct the inventory and attached to the completed form. All property inventories as well as discrepancies between the computerized inventory and actual property accounted for will be noted on DC Form 850-06. Corrections will be made to the offender’s computerized inventory as necessary.

2) Completed inventory forms will be signed by one staff member and the offender at the completion of the inventory and when property is returned to the offender. If the offender refuses to sign or is unable to sign, two DOC employees will sign. 2.

The DOC reserves the right to change allowable offender personal property limits and items. Notification of changes will be made to the offender population.

3.

Once an item sent outside of DOC, re-entry is not permitted, unless the item was sent out of the facility for approved repair or with written approval by the administrative head or designee.

4.

Wedding bands will be available on canteen. Offenders that enter DRDC with their wedding band, are permitted to retain the band only (no stones are allowed).

5.

Duffle bags are part of the standard state issue and move with the offender on facility transfers. It is assigned to and labeled for each offender and remains in the offender’s possession, except when the offender is assigned to restrictive housing, during which time the bag is stored with the offender’s property. Excess duffle bags will be returned to the Denver Complex for reissue to intake offenders.

Offender Property Acquisition: At all correctional facilities, offenders will be allowed to purchase canteen items within the limits established in DC Form 850-06B, Allowable Property Matrix. All offender property must be marked with an offender name and number to validate ownership.

7.

No sexually explicit items or prohibited publications previously allowed under the provisions of this AR will be retained by offenders. There will be no “grandfathered” items.

8.

Offenders will not under any circumstance sell, buy, barter, loan, give, store, or otherwise exchange property. Any items exchanged will be deemed contraband and confiscated and disposed of in accordance with AR 300-06, Searches and Contraband Control.

9.

State Issued Offender Identification (ID) Cards: There will be a $2.00 charge to the offender for state-issued ID cards, lost or damaged through the offender’s own negligence. ID cards that are worn, or have become unreadable through normal use, will be replaced at no charge to the offender.

B. Property Limits: 1.

Property compliance will be completed in accordance with an offender’s custody level utilizing DC Form 850-6A, Offender Property Inventory and DC Form 850-6 B Allowable Property Matrix.

2.

Property limits, to include hobby items, will be in accordance with DC Form 850-6B, Allowable Property Matrix. Personal property may be limited, or removed altogether, during an offender’s period of assignment to restrictive housing. Unauthorized property items will be stored during an offender’s assignment to disciplinary restrictive housing.

3.

Property items not authorized as a result of a scored classification regressive move will be considered contraband and disposed of in accordance with AR 300-06, Searches and Contraband Control.

4.

Offenders are not allowed to own more than one pair of state issued and one pair of canteen purchased shoes/boots. Shower shoes do not count against the shoe limit.

5.

Shoes: Offenders will not be allowed to own more than one pair of state-issued shoes. Shower shoes will not count against the shoe limit. a.

All shoes, excluding shower shoes, will be marked and notched in accordance with this policy.

Prior to the footwear being issued to the offender, a photocopy of the sole of Clinical Services-issued medical footwear or footwear purchased in special sizes from alternate vendors will be taken by property DOC property employees. The photocopy is stored on file in the property area for as long as the offender is in possession of the footwear. The photocopy will identify which offender was issued the footwear by full name and DOC number.

Close custody offenders are not allowed to purchase or possess the following items: a.

Padlocks

b.

Mustache scissors

c.

Tweezers

d.

Fingernail and toenail clippers

Medium custody offenders will have padlocks tethered to their property box/bag.

C. Faith Property: The DOC will permit offenders to have faith property in accordance with AR 800-01, Religious Programs, Services, Clergy, Faith Group Representatives, and Practices. All faith property is added to the offender’s computerized personal property inventory. D. Legal Property: Offenders may maintain no more than two cubic feet of legal paperwork in their possession. All legal paperwork must be stored in an approved legal box. It is the offender’s responsibility to determine what legal papers he/she will retain to comply with this restriction. Excess legal material will not be stored by any facility. 1.

A two cubic foot box for legal papers is available for purchase through canteen.

2.

Only legal papers may be stored in an offender’s legal box to include during offender transport. Any non-legal property found stored within a legal box will be considered contraband.

E. Health Care Appliances and Americans with Disability Act (ADA) Assistive Devices:

F.

1.

Health care appliances and assistive devices will not be included in the volume limit for offender property.

2.

All allowable health care appliances and assistive devices will be added to the offender’s computerized property inventory. Facilities have the right to mark appliances as they see fit.

3.

Any health care appliance that is determined to be modified will be sent to Clinical Services for evaluation. Legal Services AIC will be consulted when it is determined that an assistive device has been modified.

4.

Display Materials: 1.

The following materials are approved for open display or posting in offender cells on approved bulletin boards, or painted posting areas: a.

Cell permits; diplomas; certificates; calendars; athletic awards; and photographs. Calendars may not be spiral or metal-bound and must fit within the posting area of the cell.

Any persons displayed in photographs will be dressed in accordance with the provisions of AR 300-01,

Bulletin boards or painted posting areas will be of consistent size and dimensions for offender cell size which will be determined by the facility, but in no case will the area be larger than 50” by 27”. When facilities replace bulletin boards, or repaint areas, the area will not exceed 24” by 24”, per offender.

Prohibited Display Materials and Publications: a.

No offender will possess, display, or have under their control any publication or material that is properly censored pursuant to the definition and procedures contained in AR 300-26, Publications.

b.

No offender will possess, display , or have under their control any other drawings, paintings, writing, pictures, items and/or devices that based upon the offender's history, is determined to be contrary to public safety and/or rehabilitation goals set for the offender by the DOC (i.e. collections of photos of children by a pedophile) may be confiscated for review. If such an item is found, the item will be forwarded to the administrative head or designee, for a decision on disposition. The administrative head or designee may confer with subject matter experts to determine the actual impact on the offender or offender population. In assessing reading material, the level of review will determine whether an objective person could reasonably believe that the material or publication is detrimental to security, good order, and public safety or rehabilitation goals.

c.

If the administrative head or designee decides that possession is not allowed, it will be deemed contraband and subject to disposition of contraband, as defined in AR 300-6, Searches and Contraband Control, or if the item is considered to be “criminal evidence” it will be handled pursuant to AR 1150-07, Crime Scene Management and Criminal Evidence Handling.

G. Temporary Absence: 1.

Space will be provided for storing the property of an offender safely and securely until his/her return to the facility. [4-4164] When an offender is temporarily off -grounds (e.g., out to court, infirmary, outside medical absences) his/her property with the exception of health care appliances, assistive devices, and self-medications required for use during the temporary absence, must be inventoried, secured, and stored utilizing DC Form 850-6 A, Offender Property Inventory. The form must be signed by one DOC employee and the offender upon completion of the inventory and again upon return of property to the offender. If the offender refuses to sign or is unable to sign, two staff members will sign. Health care appliances sent with the offender will be noted on the inventory and accounted for upon the offender’s return.

2.

Offenders who are scheduled for medical appointments, admitted to an infirmary and/or temporarily held at a DOC facility for court appearances or facility reassignment will be sent from the sending facility with appropriate prescribed medications, to include self-medications; and a clear plastic bag containing hygiene items, e.g., soap, toothbrush, toothpaste/powder, comb; any required health care appliance as determined by Clinical Services; two total sets of greens; a coat and hat during inclement weather season; and two changes of clean undergarments.

3.

If an offender is out to court and subsequently released from the DOC, he/she will have ten calendar days in which to advise the facility, in writing, as to the desired disposition of his/her property. Failure to notify the facility within this timeframe will result in the property being disposed of with a record maintained of the disposition.

4.

Offenders who escape from the jurisdiction of the DOC will be deemed to have abandoned their personal property. The property will be disposed of after release by the Office of the Inspector General. Disposition will be made part of the offender’s department and working files.

Offenders under the supervision of the Division of Adult Parole will refer to AR 250-57, Property and Evidence Control.

H. Facility Transfer

I.

1.

Upon the facility transfer of an offender, the sending facility must inventory the offender’s property, personal and state-issued, against the offender’s current computerized property inventory to ensure all items are accounted for and are in compliance with this AR. If the sending facility finds a discrepancy, an incident report must be completed noting the discrepancy(ies) and correct the computerized property inventory before sending the offender property. The property will then be secured, prior to the transfer.

2.

Upon arrival at the receiving facility, each offender will have all personal property, and state-issued clothing inventoried and verified. If the receiving facility finds a discrepancy, an incident report must be completed noting the discrepancy(ies) and the sending facility contacted for appropriate resolution.

Out of State Contract Placement 1.

J.

Out of state contract placement offenders received from states under the Interstate Corrections Compact Agreement will be subject to this administrative regulation and will be processed through the Denver Reception and Diagnostic Center as new arrivals. Prior to any Interstate transfer to Colorado, the sending state, or agency will receive a copy of 850-06K and it will be at their discretion to send allowable property to DRDC. The receiving administrative head will have final approval authority over any specified item.

Discharge 1.

State-issued outer clothing, duffle bag, special clothing issued, and footwear will be retained by the DOC upon the offender’s release from institutional custody. These articles will be forwarded to the facility laundry for de-tagging, storage, and re-issue. All gender-specific, state issued undergarments in the released offender’s possession (up to five maximum of each article) may be retained by the offender; whatever the offender does not want will be forwarded to the laundry.

2.

Personal property will be returned to the offender at the time of his/her release, if applicable. DOC employees will check to see that state property does not leave the facility. [4-4446] Upon the legal release/discharge of an offender from the DOC, the offender will be allowed to take all personal property listed on his/her computerized property inventory with the exception of health care appliance(s) or assistive devices that are owned by the DOC and temporarily assigned to the offender. Refusal by the offender to sign a copy of the inventory will result in forfeiture of property.

3.

DOC owned health care appliances will be returned to Clinical Services at the time of discharge from a facility. In some cases, in consultation with Clinical Services and Offender Services, offenders may be allowed to discharge with the appliance, especially if the appliance is related to mobility and a recovery plan has been developed. DOC owned assistive devices will be returned to the office of the AIC at the time of discharge from a facility. In some cases, in consultation with the office of the AIC, offenders may be allowed to discharge with the assistive device.

4.

When an offender is paroling, or discharging to a detainer, or pending charges, all personal property must be mailed to an address outside DOC facilities, in accordance with AR 300-38, Offender Mail. Law enforcement agencies, including Immigration and Customs Enforcement (ICE), will not accept personal property for offenders releasing to their custody. The only allowable property is legal papers. Property that is not mailed will be disposed of in accordance with AR 300-06, Searches and Contraband Control.

5.

Offenders under the supervision of the Division of Adult Parole will refer to AR 250-57, Property and Evidence Control.

1.

Upon the death of an offender, it will be the responsibility of the administrative head or designee to ensure all of the offender’s property is officially inventoried and secured. An inventory of the property will be completed and signed by the property officer conducting the inventory. A copy of the inventory will remain with the items.

2.

The deceased offender’s property will be released to the offender’s next of kin, as designated in AR 850-10, Emergency Notifications.

3.

If the next of kin requests the property be sent, and if sufficient funds are available in the offender’s account, property may be mailed to the next of kin by certified mail/return receipt requested. The DOC does not accept liability for property damaged through the mail. This practice does not apply to wheelchairs or other health care appliances. If health care appliance(s) or assistive device(s) was personally owned by the offender upon entering the DOC, the next of kin will coordinate recovery of the item with the DOC on a case by case basis. Property that is not mailed out or destroyed will be disposed of by the facility in accordance with AR 300-06, Searches and Contraband Control.

V. RESPONSIBILITY A. It will be the responsibility of the appropriate administrative head to ensure that staff are adequately trained to meet the intent and requirements of this policy. B. It is the responsibility of the director of Prisons to review this AR annually and update as necessary.
