NARRATIVE:

On 30NOV15 at approximately 10:45 hours I checked my work WWU email and found a response from Yik Yak Inc., regarding the search warrant I served on them on 11/24/15. The warrant return included information on a comment that was made on 11/23/15, which stated, “Let’s lynch her.” Included in the return was the location in global positioning, the associated cell phone number and type of cell phone that was used. A check of resources showed the cell phone number was associated to A1/CAMPBELL, Tysen D., who was found to be a student at Western Washington University. A records check of CAMPBELL showed no contacts or previous criminal history. I also obtained CAMPBELL’s Washington State Driver’s License photo along with his current class schedule at WWU. I contacted the professor who was associated with CAMPBELL’s 14:00 hour class, and asked if he would be willing to show CAMPBELL out of the class, so we could speak to him. The Professor agreed and we made arrangements to meet just after the class started at 14:00 hours. I arrived at Fraser Hall at approximately 13:50 hours. At approximately 14:03 hours I met with CAMPBELL as he exited the classroom. I asked CAMPBELL to come with me to the Campus Services building to discuss a case and he voluntarily agreed. CAMPBELL was then escorted to CS, to be interviewed. No questions or comments regarding the case were discussed. At approximately 14:10 hours CAMPBELL was taken to the conference room and asked to wait with Ofc. Derek Jones while I collected my paperwork and waited for Assistant Chief Tanksley. At approximately 14:20 hours I entered the conference room with AC Donnell Tanksley and read CAMPBELL his constitutional rights from my state issued Miranda card. CAMPBELL said he understood his rights and would speak with me. I asked CAMPBELL if he was familiar with the application Yik Yak and he said he was. I asked CAMPBELL if he used or had Yik Yak. CAMPBELL stated that he recently deleted the application from his phone. I asked what prompted him to delete the application and he said that he was banned after making a comment last week. I asked CAMPBELL what had happen and he explained that he was reading the posts and found one about the WWU Associated Student Body President. CAMPBELL said that the post alleged the ASB President said that “white people are like the baby KKK”. CAMPBELL said he found it “distasteful”, for somebody in that position to make comments of that nature. CAMPBELL said he responded with, “Let’s lynch her.” CAMPBELL said that after posting the comment he thought about it and decided to delete it. CAMPBELL stated he deleted the comment and then observed a response to his comment that said, “Not cool.” I asked CAMPBELL if he knew the ASB President and he stated, “No.” CAMPBELL said he made the comment to turn the premise of her alleged comment back on her, so he used the language he believed the KKK would use. CAMPBELL also said he assumed that the ASB President was “African”, “Middle Eastern” or dark skinned, based on the “white” comment. I discussed with CAMPBELL his Yik Yak usage. of 2014, when he started at WWU. CAMPBELL said he reads Yik Yak but rarely posts to it. CAMPBELL said he has posted approximately 15 to 20 times total. CAMPBELL said that after he posted his comment on Monday, he checked it possibly one more time that day. CAMPBELL said that when he went to check it the next day, he got a message saying he was banned for 16,000 days. CAMBELL said he then deleted the application. CAMPBELL stated the only other social media he uses is Facebook, but doesn’t really post to it. CAMPBELL denied having any association with white supremacy groups. I again asked CAMPBELL about his feelings regarding the post and his comment on Yik Yak. CAMPBELL said he was not offended or angry about the alleged comment by the ASB President, he believed it was distasteful and wrong for someone in her position to make that statement when she should be about equality. I asked CAMPBELL why he removed his comment and he said he didn’t like the way it sounded. I asked CAMPBELL how he thought the ASB President felt about his comment and he said she would feel “Oppressed by white people.” I again asked CAMPBELL how the ASB President would feel about his specific comment and he said, “She would feel threatened.” I asked if that was the reaction he was looking for and he said it was not. I asked what reaction he was looking for on the social media. CAMPBELL said his comment was only for him. I discussed the premise of social media being an outlet and not normally a place people are not looking for a response. CAMPBELL then said he, “Wanted to show her how ridiculous her comment was.” I asked CAMPBELL if he had seen the comment about hanging nooses from the trees in protest and he stated, “I don’t think so AC Tanksley wanted to ask CAMPBELL a few questions. CAMPBELL was asked if he knew what lynching was, and CAMPEBLL said it was hanging. AC Tanksley asked hanging in what manner and CAMPBELL said hanging a person. CAMPBELL said it was a reference to KKK. CAMPBELL said he used his Samsung phone to make the comment to Yik Yak while at his dorm room. CAMPBELL said he absolutely did not intent to lynch anybody like the KKK. CAMPBELL said he does not share the phone and has owned it for over two years. CAMPBELL said the phone is kept in his possession and nobody has borrowed it or used it other than him. CAMPBELL said he was not aware of the email WWU President Shepard sent out. CAMPBELL said he doesn’t use the email to send messages, but mainly to get information from his track coach. CAMPBELL said he has not checked his email since leaving the comment on Yik Yak and was gone hunting with his dad most of the Thanksgiving break. CAMPBELL then said he opened and closed his email earlier today. CAMPBELL said he saw the message from President Shepard, but assumed it was because the school was closed on last Tuesday. I asked if he called the Equal Opportunity Office and he said, “No.” I asked CAMPBELL if he emailed anything to the Faculty or Staff, and he said, “No.” I then exited the interview and consulted with Chief Rasmussen and AC Tanksley. Sledge spoke with CAMPBELL briefly to advise him that he was academically suspended and trespassed from the university. CAMPBELL was then taken into custody, handcuffed and searched. I impounded CAMPBELL’s backpack and cell phone. The backpack was impounded for safekeeping under PIR 3588. The backpack was inventoried and found to have spiral note books, running pants, calculator and other small personal items. I impounded the cell phone for evidence under PIR 3589. CAMPBELL was then taken to Whatcom County Jail and booked.
