A prominent San Mateo County child psychiatrist accused of molesting seven young patients faked dementia to avoid a trial, prosecutors said Friday. William Ayres, 80, had been under observation at Napa State Hospital for the nine months after reportedly showing signs of dementia.

But Ayres was making it up, using his medical knowledge to fool other doctors into believing that he was incompetent to aid in his own defense, a prosecutor said during a court hearing. "We have information that he is malingering," said Chief Deputy District Attorney Karen Guidotti, citing a report issued recently by doctors at Napa State Hospital. Judge John Grandsaert of San Mateo County Superior Court will decide if Ayres is capable of assisting defense lawyers fighting multiple molestation charges that resulted in a hung jury in 2009. www.sfgate.com/crime/article/DA-Child-psychiatrist-is-faking-dementia-3761191.php

The judge sealed the report from public view. Prosecutors confirmed that the report had concluded that Ayres "has regained his competency" and can assist in his own defense should the case be retried. Guidotti acknowledged that there had long been suspicions as to whether Ayres was pretending to have dementia and memory loss. Ayres is being held without bail at San Mateo County Jail in Redwood City pending a bail hearing Wednesday. A competency hearing has been set for Oct. 2. Ayres, the former head of the American Academy of Child and Adolescent Psychiatry, is charged with nine counts of performing lewd acts on seven boys, ages 8 to 13, during counseling sessions in the early 1990s.

After the 2009 trial resulted in a hung jury, prosecutors decided to retry the case. Defense attorneys challenged that move, saying Ayres wasn't fit to stand trial. A jury trial last year to determine his competency ended in another hung jury, prompting Ayres' placement at Napa State Hospital. At his 2009 criminal trial, Ayres testified that as a medical doctor he used physical exams to help determine what was ailing his psychiatric patients. Prosecutors contend that it was during those examinations that the boys were molested.
