Constitution Pipeline Company, LLC’s Request for Partial Notice to Proceed and Cut Down Trees, Docket No. CP13-499-000

Dear Secretary Bose: On the afternoon of Friday January 8, 2016, Constitution Pipeline Company, LLC (“Constitution”) filed with FERC a “Request for Partial Notice to Proceed.” The request seeks authorization from FERC’s Director of the Office of Energy Projects to cut down trees and conduct related activity within the workspace required for construction of Constitution’s proposed natural gas pipeline. Constitution asks FERC to provide this authorization by Friday January 15, 2016. The Office of the New York State Attorney General plans to electronically file an answer in opposition to Constitution’s request by 5:00 p.m. on Thursday January 14, 2016. Accordingly, the Attorney General’s Office respectfully requests that a decision on Constitution’s Request for Partial Notice to Proceed be deferred until this Office has submitted its answer in opposition.
