What IS a Patent and Trademark Resource Center?

Patent and Trademark Resource Centers (PTRCs) are a nationwide network of public, state and academic libraries that are designated by the USPTO to disseminate patent and trademark information and to support the diverse intellectual property needs of the public. Accessing the patent and trademark information at a PTRC with the help of a trained specialist, you may be able to determine if someone else has already patented your invention or obtained a federal registration for a trademark on goods or services. PTRCs also have access to PubWEST and PubEAST, examiner-based search systems. These trained specialists may also help you with specific questions regarding the patent and trademark processes, but they will not provide legal advice.

Ten Things an Inventor Can Do to Help Their Patent Attorney Richard Miller, OIC Member and IP Attorney, as presented to OIC OKC Chapter April 2009

Disclaimer: This list is a representative example of ways to help your patent attorney. • Do NOT disclose your invention to anyone until you decide on a filing strategy and are aware of the associated deadlines. But if you did it, know the date of disclosure. • Do NOT attempt to sell your invention to anyone until you decide on a filing strategy and are aware of the associated deadlines. But if you did it, know the date of the offer. • Define what makes your invention new, unique, different from others. • Ensure your patent attorney has a complete, full disclosure - how to build it, how to use it, when to use it, etc.

• Do have a good set of drawings and/or flow charts. • Do NOT attempt to draft your own patent claims – that is the legal part for your attorney. • Fully inform your attorney of any prior art you are aware, even if you think it may not be relevant. • Be responsive to questions from your attorney. Even with a full disclosure from you, the patent application is a joint effort. • Minimize changes to the invention once the patent drafting process starts. Minor or corrective changes are expected during the review process. Radical changes or new embodiments will increase the time to draft a patent application which = $. • If you do your own patentability search, do not assume you are reading the prior art patents and their claims correctly.
