POOL SOLICITATION SUMMARY

Introduction The Utah Department of Transportation (UDOT) utilizes a variety of avenues to select Right of Way (ROW) Consultants for acquisition and acquisition related service contracts. Once the decision is made to utilize a Consultant, the UDOT ROW, in coordination with the UDOT Project Manager and UDOT Consultant Services, determines the procurement method. This decision is based on the nature of the project and related factors such as anticipated costs, land values, and complexity. The most commonly used and simplest selection method is selecting a consultant from the Right of Way Services and Local Government Pool. Right of Way Acquisition Services and Local Government Pool The Right of Way Acquisition Services and Local Government Pool (Pool) is a pool of prequalified individuals and consultants in various work disciplines. This selection process may be used by UDOT to select consultants for small and non-complex right of way acquisition service contracts under $600,000 from start to completion. This Solicitation will establish the pool of qualified consultants in the various work disciplines. Solicitation This Solicitation follows the request for qualifications processes and procedures outlined herein. Consultant selection for this pool is a Qualification-Based Selection (QBS) process, where the primary factor in selection is the qualification-based criteria outlined by in the Work Discipline Evaluation/Scoring Criteria Section (beginning on page 20), rather than the cost of right of way acquisition related services. Cost is a secondary factor after a Consultant is selected and the contract negotiation process begins. Qualifications Based Selection The establishment of this Pool is a qualifications-based selection (QBS) process. Consultant fees are not a factor in the scoring/ranking of Consultants to provide the requested services. All price/cost related items which include, but are not limited to past, present or future fees associated with Consultant contracts, direct salaries / wage rates, indirect cost rates, and other direct costs are prohibited from being used in Proposal(s). Consultant fee discussions are not allowed. Do not include any reference to Consultant fees (past, present, or future) in the Proposal(s). Right of Way Acquisition Services and Local Government Pool – Development Process 1. Consultants are invited to submit a separate Proposal for any of the work disciplines for which a consultant has qualifications. 2. UDOT professionals will review and evaluate the Proposals based on the criteria within this Solicitation through the Selecting By Consent (SBC) Process. SBC is a scoring process that aids the Selection Team in developing a final score and ranking through a collaborative process. The Selection Team scores each weighted criterion by “consent”. Consent is defined as the willingness of all Selection Team members to accept a decision reached by a collaborative process. 3. Each Proposal will receive a final score by UDOT Selection Teams. 4. UDOT has established a minimum threshold score of 60% of the total points available. If a Proposal receives this threshold score or higher, the consultant will be considered qualified and will be listed as qualified for the work discipline. If the Proposal receives below the minimum threshold score, the consultant will not be listed as qualified for the work discipline. 5. Consultant Services will provide a consultant’s scores by email directly to the consultant individual identified as the primary contact. 6. By June 30th, Consultant Services will post the final pool of qualified consultants list on the web, www.udot.utah.gov/go/cspools. 7. After the effective date of July 1st, consultants may schedule a time to come in and review the successful Proposals.

8. After the effective date, UDOT and Local Government representatives may select from the qualified list of consultants for contracts. There are two levels of selection methods from the Pool; Direct-select and Request for Pool Letter of Qualifications (RPLOQ). 9. At the mid-point of the pool period (18 months), Consultants will be required to meet the Requalification Certification Requirements to maintain their qualification status. Pool – Direct-Select UDOT ROW and Local Government Project Managers may direct-select from the qualified list of consultants in the Pool for contracts up to the small purchase cap of $150,000. If UDOT ROW and/or Local Government Project Managers anticipate the contract amount (including any modifications) will exceed the contract cap of $150,000, a Request for Pool Letter of Qualifications (RPLOQ) selection method must be used. Pool – RPLOQ For contracts exceeding the Pool Direct-select limit of $150,000 but less than $600,000, UDOT ROW and the Local Government Project Managers will follow the RPLOQ process. For this selection method, cost will be included as one of the selection criteria. If UDOT ROW and/or Local Government Project Managers anticipate the contract amount (including any modifications) will exceed the $600,000 contract cap, a project-specific request for proposal selection method must be used. The Right of Way Acquisition Services RPLOQ Consultant Selection Process is in development. Please note, a price proposal will be required for this selection process. Pool Period The Pool period is July 1, 2018 through June 30, 2021. Consultant Cumulative Cap It is the responsibility of all parties (UDOT, Consultants, and Local Governments) to make sure each project seeking Consultant selection from the Pool meets the Contract Caps of $150,000 for Pool Direct-Select contracts or $600,000 for Pool RPLOQ contracts (including all modifications) and the Consultant Pool Period Cumulative Cap of $1,500,000 for Local Government Projects and $1,500,000 for State Projects. No exceptions. The Consultant Cumulative Caps will be evaluated periodically during the pool period and may be revised based on the needs of UDOT and Local Governments at UDOT’s sole discretion.

Consultant Cumulative Cap Contingency Formula A full twenty-five percent reserve of all open non-on-call contracts in the 2018-2021 Pool will be reserved for potential modifications to those contracts in order not to exceed the Consultant Cumulative Cap. Proposal Submission Consultants interested in being listed as qualified in the Pool may submit work discipline specific Proposals in response to this Solicitation. A Proposal may be submitted at any time from the initial posting of this Solicitation on February 20, 2018 through the first two years of the Pool period. New Consultant Proposals will then be evaluated annually by UDOT technical experts to determine whether the Consultant is qualified in specific work disciplines based on work discipline specific Proposals. Any Proposals received by 11:00 a.m. on April 3rd will be evaluated during the months of April, May and June. If considered qualified, the consultant will be eligible to be selected on July 1st, subject to the financial screening process. Schedule of Proposal Deadlines April 3, 2018 by 11:00 a.m. April 3, 2019 by 11:00 a.m. (Interim Pool Submission) April 3, 2020 by 11:00 a.m. (Interim Pool Submission) Any Proposals received late by UDOT for an April 3, 2018 11:00 a.m. deadline will not be evaluated by UDOT until after the following year’s interim submission deadline of April 3, 2019. Any Proposals received late by UDOT for an April 3, 2019 11:00 a.m. deadline will not be evaluated by UDOT until after the following year’s interim submission deadline of April 3, 2020. No Proposals will be accepted for the Pool after April 3, 2020, at 11:00 a.m. Any Proposals received after April 3, 2020 11:00 a.m. will be considered non-responsive and will be disqualified. The Solicitation for the new pool period of July 1, 2021 through June 30, 2024 will be advertised in approximately February 2021 with a new deadline in April 2021. Requalification Certification Requirement Firms and individuals will be required to self-certify they are still qualified in each work discipline at the mid-point of the Pool period based on the Utah Procurement Code (Utah Code 63G-6a-507), see page 23 for details. Protests All protests with respect to this Solicitation must be in writing, and will follow the requirements in Utah Code Sections §63G-6a-1602 et seq. Any protest not set forth in writing within the time limits specified in §63G-6a-1602 is null and void and will not be considered. Additional Qualifications The ROW Division, UDOT and/or Local Government Project Managers reserve the right to ask for additional qualification information before a contractual agreement is signed with a Consultant (firm or individual) from the Pool list. Consultants in the ROW Services Pool will be qualified based on having met minimum qualifications. The agency reserves the right to select consultants from the Pool on an as-needed basis to perform the specific tasks necessary to meet the needs of the agency and the project. If UDOT receives complaints about the performance of a consultant or at any time, the agency has the right to ask the consultant for additional qualification information including but not limited to a presentation of an acquisition and/or relocation before a contractual agreement is signed with the Consultant. Said presentation may result in the exclusion of individuals or additional consultants from performing work on behalf of UDOT and/or Local Government Projects. There is no guarantee that consultants approved for the Pool will be assigned work. Financial Screening UDOT requires Consultants be Financially Screened at the appropriate level prior to performing work for UDOT. The time it takes a Consultant to complete the Financial Screening process varies and therefore UDOT encourages Consultants to submit the Financial Screening – Short Form or Financial Screening Application and Questionnaire in a timely manner after notification of selection for the Pool. For questions, contact Consultant Services at 801-965-4138. A Consultant’s Financial Screening status is effective for the period of one year from the time the Consultant is approved. UDOT has a system in place that allows UDOT Right of Way Agents or Project Managers to electronically select prequalified consultants from the Pool, the Contract Management System (CMS). This system tracks all contract requests. If you have never been financially screened by UDOT your firm is not listed in CMS. Consultant admittance into the Pool for any of the work disciplines is contingent on providing a Financial Screening – Short Form. Consultants may also opt to submit a full Financial Screening Application and Questionnaire for contracts larger than $150,000. Do not attach these financial screening documents with your pool submission, please submit them separately. Consultant Services Electronic Notification Subscription Service Please join the Consultant Services Electronic Notification Subscription Service. Consultants will only be notified of any updates or changes to this Solicitation through this service.

POOL ACCEPTANCE AND COMPLETION CRITERIA

Work Disciplines A Pool of qualified Consultants (firms or individuals) has been and/or will be selected to cover each area of service (Work Disciplines) UDOT deems necessary for upcoming projects. UDOT ROW will select qualified Consultants from the appropriate Work Discipline. Qualified Consultant Selections UDOT Right of Way and Local Government Project Managers are encouraged to use a variety of Consultants for their Pool Projects. However, it is up to each Consultant to market their skills and services directly to the UDOT ROW and Local Government Project Managers. There is no guarantee of work. Required Percentage of Work for Prime Consultant Pool Contract Language states a Prime Consultant will self-perform 100% of the total contract value. For Pool contracts under the disciplines for Lead Agent Services, Complex and NonComplex Projects, the Prime Consultant will self-perform at least 30% of the total contract value. The UDOT ROW Lead Agent and Consultant will be required to notify the Right of Way Services Contract Administrator of ANY variation from this requirement so that the contract language may be altered. When a contract is modified or if UDOT receives a complaint about the performance of a consultant, the agency has the right to ask the consultant for additional qualification information including but not limited to a presentation of an acquisition and/or relocation before a contractual agreement is signed with the Consultant. Said presentation may result in the exclusion of individuals or additional consultants from performing work on behalf of UDOT and/or Local Government Projects. Prime Consultant Pool Dollar Availability All contract and modification costs (including subconsultant costs) will count towards the Prime Consultant’s Cumulative Pool Dollars. The selecting UDOT ROW Lead Agent and/or Local Government Project Manager will make sure that each Consultant selected for a Pool Contract has consultant cumulative dollar availability prior to contacting the Consultant. This is done through the Contract Management System (CMS). Contract and/or Modification Requirements UDOT requires standard contract and contract modification documentation. Any variation from this will require full justification in the Consultant’s Executive Summary. Contract modification requests are required to comply with the contract-cap and consultant cumulative-cap limits. Task Schedule/Deliverable Dates/Project Completion Date Certificate of Insurance (annually submitted and maintained on file with Consultant Services) Subconsultants shall be required to meet all contract document requirements, if the value of the subcontract is greater than or equal to $25,000.

The UDOT ROW Lead Agent is required to complete the following documents through a CMS Pool Contract and/or Modification request before the contract/mod can be generated: 1) Scope of Work – Executive Summary 2) ROW Independent Cost Estimate (ICE) 3) R-709 Form (Required for All State and Federal Projects) 4) CMS electronic Contract/Modification Approval 5) Executed Local Government Federal-Aid Agreement (if applicable) Insurance Requirements Consultants are required to provide UDOT with Certificates of Insurance meeting the current guidelines. Current insurance requirements can be found on the UDOT Consultant Services Forms website www.udot.utah.gov/go/csforms. Applicable Federal, State, and Local Regulations The Consultant will conform to all applicable state and federal regulations. Authorization to Begin Work Authorization to begin work or a Notice to Proceed (NTP) for all ROW services contracts may only be issued by Consultant Services staff via email. NOTE: Violation of authorization to begin work (Notice to Proceed) may result in non-payment of work performed, termination of an impending contract, or loss of federal funds, if applicable. Consultant billings shall not date prior to contract and/or modification execution date. Required Personnel Qualification The Consultant will be responsible to ensure all personnel proposed are qualified through training, experience, license, and appropriate certification for the tasks assigned and will have a working knowledge of UDOT standard practices. Conditions of Proposal All costs related to the preparation of a Proposal and any related activities are the sole responsibility of the Consultant. UDOT assumes no liability for any costs incurred by Consultants during the pool development, selection and contract negotiation processes. Review of the Solicitation Documents Consultants are responsible for reviewing and understanding the content and requirements of the Solicitation. Read and review each section carefully to ensure Proposals meet the outlined requirements. If the Consultant identifies any mistake, error, or ambiguity in the Solicitation during the procurement process, it is the duty of the Consultant to notify the Contract Administrator via email. Conflict of Interest UDOT expects Consultants to act with integrity and professional ethics. When there is a potential conflict of interest, Consultants are required to either not submit for the project or Right of Way Services and Local Government Pool Solicitation July 1, 2018 - June 30, 2021 Page 9 of 48

disclose the potential conflict to the Consultant Services Manager prior to submitting a Proposal. The Consultant Services Manager will coordinate with the UDOT Conflict of Interest Review Team for a determination by UDOT. For additional information, refer to the UDOT Consultant Services Manual of Instruction (MOI). Listing of Current or Former UDOT Employees UDOT's requirement for listing current or former UDOT employees as personnel in a Proposal is as follows: • If a Consultant lists a former UDOT employee on the Proposal who officially left UDOT employment prior to the submission date of the Proposal, the Consultant will not be disqualified. • If the Consultant lists someone who has not yet left UDOT employment, even if the employee plans to retire or quit soon, the Consultant will be disqualified. Non-affiliated Consultant Employees Consultants cannot list non-affiliated individuals in their Proposal employed by another Consultant. The Consultant’s Proposal will be disqualified and will not be evaluated by UDOT. If the use of non-affiliated consultant employees is noted after qualification, the Consultant’s Proposal will be disqualified once it is brought to Consultant Services attention. Individuals Concurrently Employed By Two Firms Two firms cannot utilize the qualifications of the same employee or individual as key personnel for the same work discipline or both firms’ Proposals will be considered nonresponsive and will be disqualified. Exception 1: If one firm voluntarily withdraws their firm’s Proposal, the other firm’s Proposal will be considered responsive and will not be disqualified for this reason. Exception 2: If an individual changes employment from one firm to a different firm mid-pool period, and their qualifications are submitted for the new firm for a subsequent interim Proposal submission deadline for the same work discipline, neither firm will be disqualified for this reason. No Sub-consultants Consultants may not use the qualifications of sub-consultants as part of their Proposal submittal to qualify in a work discipline. If a consultant submits with a sub-consultant, the Proposal will be considered non-responsive and will be disqualified. Training Requirements Consultants and Subconsultants will be required to provide UDOT any necessary training verification as deemed necessary. It is the responsibility of each Consultant to know what training will be required and when it is offered. Project Evaluation Requirements The ROW Division will monitor and evaluate consultants using the established ratings criteria for each service as presently found in the ROW ePM Module. Consultant cumulative ratings will be evaluated as part of the ROW close-out process once all ROW has been cleared for a project. As a result of such ratings, when UDOT receives complaints regarding the performance of a consultant, or at any time, the agency has the right to ask the consultant for additional qualification information including but not limited to a presentation of an acquisition and/or relocation before a contractual agreement is signed with the Consultant. result in the exclusion of individuals or additional consultants from performing work on behalf of UDOT and/or Local Government. Please contact the Director of Right of way for more information. Debarment Certification Federal Regulations require certification by prospective participants (including consultants, subconsultants, and principals) as to current history regarding debarment, eligibility, indictments, convictions, or civil judgments. The selected Consultant will be required to certify in accordance with contract Standard Terms and Conditions on every contract. Consultants are required to disclose any current (last 2 years) debarment, license issues, and/or investigations information in Proposal(s). Right to Cancel or Reject UDOT reserves the right to cancel the Solicitation at any time when it is in UDOT's best interest. UDOT also reserves the right to accept or reject any or all Proposals submitted in response to the Solicitation. Pool Debriefing Opportunities Consultant Services may offer Consultant Pool Debriefs by email within 30 days following July 1st. Debriefing information will include 1) Discipline Scores and 2) Not Qualified (“1”) and/or “Fail” Score Selection Team Reviewer Comments (see page 22 for details). Successful Proposals will be available for the 3 years of the pool period. This may be changed to meet the needs of UDOT. Disposition of Proposals Proposals and their content become the property of UDOT and are treated as non-public records until the Pool has been published. The Proposals of successful Consultants will be open to public inspection for a period of three years after the Pool qualification is published. Work Site Safety Utah Code 63G-6a-403 states UDOT may request the Consultant submitting a Proposal to provide information about the Consultant's work site safety program, including any requirement that the person imposes on sub consultants for a work site safety program and any other pertinent information. Audits Prior to a final contract award on a project, an audit may be conducted by UDOT of the selected Consultant. This audit will be for the purpose of ensuring the selected Consultant is financially capable of performing the contract, the cost information and prices quoted are reasonable, and the selected Consultant has adequate accounting practices to ensure accurate tracking of contract costs. UDOT reserves the right to inspect Consultant records associated with specific projects, including financial records, as deemed necessary during the term of any contract. Prior to final acceptance of contract work, UDOT may conduct a closing audit of the Consultant. This closeout audit will be performed upon completion of the contract to verify the accuracy of all billings and compliance with the contract provisions. If a proposing Consultant has failed to pay UDOT monies due to UDOT for over payment on past projects, UDOT has the right to reject and/or disqualify the Consultant’s Proposal. Disqualification will be based on audit findings, determinations, and recommendations made by the UDOT Fiscal Audit Division. Technology Requirements It is the responsibility of the Consultant or Subconsultant to know what technology requirements are required when doing business with the State. The Consultant will be responsible for the accuracy of the translated data and therefore, may be required to reimburse UDOT for any errors having a direct cost to UDOT. Please contact the Deputy Director of ROW for more information. Delivery Method / Deliverables All ROW contracts require specific deliverables for each discipline to be provided to UDOT which must follow the UDOT Right of Way ProjectWise Guide. Government Records Access and Management Act (GRAMA) UDOT will maintain a nonpublic process for the duration of this Solicitation. Pursuant to Subsection §63G-2-305(6) of the GRAMA, all records related to this Solicitation, including, but not limited to Proposals, evaluation, and selection procedures, and any records created during the evaluation and selection process will remain nonpublic records. The GRAMA, Utah Code Ann., §63G-2-101 et seq., provides in part that certain records are protected if properly classified.

Preparation of Proposals Prepare Proposals in accordance with the UDOT Proposal Requirements Summary. Proposal Organization For Work Disciplines 1 – 3 and 7 – 11, each Proposal should contain the following sections: 1) Pool Cover Page Form; 2) Firm Qualifications; 3) Key Personnel Qualifications; 4) Project Experience; and, 5) Form BC (Business Confidentiality), if applicable, see page 15. For Work Disciplines 4 – 6, each Proposal should contain the following sections: 1) Pool Cover Page Form; 2) Individual Qualifications; 3) Project Experience; 4) License(s) and Certification(s); and, 5) Form BC (Business Confidentiality), if applicable, see page 15. Sections are not required to start at the top of a page. (NOTE: The Cover Page should not be submitted as a separate electronic file from the rest of the Proposal, it should be the first page in the electronic file.) Pool Cover Page Form The Pool Cover Page Form – ROW Pool is required for each Proposal. It may be on the Consultant’s letterhead and must consist of the following with no additional information. The information is required to be in this exact format with no additional information other than the Consultant’s letterhead. Proposals will be considered non-responsive and will be disqualified if the Cover Page is not attached to the Proposal; if the Acknowledgement is not included on the Cover Page; and/or if there is additional information included on the Cover Page. No evaluation points are assigned to this section and the Cover Page will not count as one of the allowed pages.

Guidelines for Preparing Proposals These guidelines were developed to standardize the preparation of a Proposal for the ROW Pool. The purposes of the guidelines are to ensure consistency in format and content in the Proposals prepared by Consultants and submitted to UDOT. It is highly recommended that Proposals are written and presented to UDOT in a clear and concise format which will not distract from the content of the material presented. Separate Proposal Submittal Required for Each Work Discipline A separate Proposal submittal is required for each Work Discipline for which you are interested in submitting. Multiple Proposal electronic files may be attached to one email. Separate Proposal Submittal Required for Each Individual for Work Disciplines 4 – 6 A separate Proposal submittal is required for each individual proposed for Work Disciplines 4 – 6 for which you are interested in submitting. Multiple Proposal electronic files may be attached to one email. Electronic File Naming Convention Consultants are required to use the electronic file naming convention outlined as follows. The electronic file name of your Proposal file will be named first with the work discipline number then firm name. For example, if ABC Corporation is submitting a Proposal for the 1-Acquisition Services work discipline then the electronic file name of the PDF will be “1 ABC Corporation.pdf”. Claim of Business Confidentiality The GRAMA, Utah Code Ann., §63G-2-101 et seq., provides in part that certain records are protected if properly classified. Consultants are responsible for determining which information, if any, they wish to be protected under a Claim of Business Confidentiality, and are responsible for taking appropriate action to do so. An entire Proposal may not be protected under a Claim of Business Confidentiality. To protect information under a Claim of Business Confidentiality, the Consultant must, at the time the information is provided to UDOT, include a Form BC - Claim of Business Confidentiality. It is the responsibility of the Consultant to complete Form BC in accordance with Subsection §63G-2-309 and submit to UDOT as an attachment to the Proposal. If nothing in the Proposal is being protected under a Claim of Business Confidentiality, a Form BC is not required. REQUALIFICATION CERTIFICATION REQUIREMENT

The Utah Procurement Code (Utah Code 63G-6a-507). Effective May 1, 2013, the Legislature revised the Procurement Code to state prequalified lists of consultants may not be for a term longer than 18 months (Subsection (5)(b)(ii). To be compliant with Utah Code, ALL Consultants qualified in the Pool as of Thursday, November 1, 2019 will be required to self-certify their firm is still qualified to provide services. Consultants are required to submit a Requalification Certification Form (RCF) for each work discipline for which they are listed as qualified by UDOT to maintain their qualified status in the Pool. RCF Submission Deadline Between November 1, 2019 and Thursday, November 15, 2019 by 11:00 a.m. Consultants may submit RCFs any time starting on Thursday, November 1, 2019 until Thursday, November 15, 2019 by 11:00 a.m. Any individual or firm listed as qualified in the Pool who does not submit an RCF within the window provided and by the deadline for a specific work discipline will no longer be considered qualified in the Pool for that work discipline effective January 1, 2020 if or until they do submit an RCF and are approved. If a firm misses the RCF deadline in error, they may submit an RCF for consideration subject to Consultant Services and Right of Way Division approval.

Separate RCF Submittal Required for Each Work Discipline A separate RCF submittal is required for each Work Discipline for which your firm is listed as qualified by UDOT to maintain your firm’s qualified status in the Pool. For Work Disciplines 4-6, a separate RCF submittal is required for each individual listed as qualified. However, multiple RCF electronic files may be attached to one email. Requalification Certification Form (RCF) A RCF is required for each work discipline. It may be on the Consultant’s letterhead and must consist of the following with no additional information. There are two forms, one for Work Disciplines 1-3 and 7-11 and a different one for 4-6. Please use the appropriate form. The information is required to be in the exact format with no additional information other than the Consultant’s letterhead. If there is any other information provided in the RCF, the RCF will be considered non-responsive and will be disqualified. Requalification Certification Form (RCF) - Work Disciplines 1-3 and 7-11 Material Changes Section Consultants are required to identify changes that have occurred since they qualified for the 2016-2016 General Engineering Services and Local Government Pool. Since consultants in the pools may requalify at the 18-month interval without the need to go through a new competitive procurement process, it is essential that UDOT become aware of any changes that have occurred during that interim that may affect a consultant’s ability to perform as UDOT requires. Not every change will disqualify a firm from being included in a prequalified consultant pool. Consultant Services Division personnel will thoroughly evaluate the material changes identified on the RCF Form and disqualify a firm if such action is necessary to protect the interests of UDOT and the state. Following are definitions for each item in the Material Changes Section of the RCF Form. If an item is not applicable, insert “NA” / “None” / “No”. Do not leave a field blank. 1. 1 – Acquisition Services (Firm)

UDOT is seeking firms capable of assisting in UDOT’s overall ROW Acquisition process. Applicants in this category shall perform complex Acquisition Service assignments for UDOT or a Local Government Agency with UDOT Oversight in compliance with applicable State and Federal Laws and Regulations, including, but not limited to the Uniform Relocation Act and the Utah Relocation Act and their implementing regulations. Applicants must be able to submit work in a prescribed format using specific computer programs from remote personal computers. In order to qualify for this Work Discipline you must show qualifications in each area below. All qualified consultants must have knowledge, experience and an understanding of all applicable state, federal laws and implementing regulations when acquiring property. Prior knowledge of applicable laws, rules and regulations must be demonstrated. (See: Federal Uniform Relocation Act, Utah State Code Section 57-12, Code of Federal Regulations sections 49 CFR Part 24 and 23 CFR Part 10.) The Lead Agent in this service may be required to manage a staff or team of ROW professionals and will have documented experience with scheduling and budgeting in order to fully manage the ROW process from ROW design to ROW clearance. 10 – Project Coordination Services (Firm)

UDOT is seeking firms capable of assisting in UDOT’s overall ROW Acquisition process. Applicants in this category shall perform project coordination assignments for projects for UDOT and/or Local Government Projects. Examples of project coordination include acquisition file preparation, proficiency with UDOT’s Right of Way ePM Module and ProjectWise, scanning documents, and quality assurance principles and application. The Project Coordinator in this service may be required to provide coordination for multiple projects . The Project Coordinator must have experience and sufficient knowledge of the applicable State and Federal Acquisition and Relocation processes and procedures under the Utah Relocation Act and the Federal Uniform Relocation Act to ensure that all ROW documentation and ePM inputs are in compliance with the applicable laws and regulations and UDOT policies and procedures. Applicants must be able to submit work in a prescribed format using specific computer programs from remote personal computers. In order to qualify for this Work Discipline you must show qualifications in each area below. All qualified consultants must have a knowledge, experience and certifications in the following area: • An understanding of all applicable state, federal laws and implementing regulations when acquiring property. Prior knowledge of applicable laws, rules and regulations must be demonstrated. (See: Federal Uniform Relocation Act, Utah State Code Section 57-12, Code of Federal Regulations sections 49 CFR Part 24 and 23 CFR Part 10.) • Work experience as an acquisition agent or project coordinator for a State Department of Transportation, Local Public Agency, or Federal Agency – Highly Recommended o References (Contact information-address, office/cell, phone, email) Description of Work Performed, in table format, must be submitted. The description must include the following information: • Experience as an Acquisition Agent, Project Coordinator, ROW Manager, Lead Agent or firm for a State DOT Project, Local Government Project with Federal Participation • Describe in table form, the work performed by this firm. The description must include the following information: Name of the project, location of the project, size of the project, name of the agency responsible for the project, complexity of the project, (I.E. the number and type of properties acquired, number of displacees relocated; by household or business, number of properties managed, number of right of way agents supervised, type of work those you supervised performed for the project and the length of time it took to clear the right of way etc.) Your experience as a Project Coordinator may be rated based on past experience with UDOT as well as on the information you include with this submission. (Please note: your entire response including this section, is limited to the maximum number of pages as noted on page 15 of this Solicitation.) 11 – Cell Tower & Other Wireless Communication Leasing Consultants (Firm) This service is open to firms specializing in providing landlord services associated with the management of cell towers and other wireless communication leases. UDOT is seeking Qualified Consulting Firms that will provide the Department typical cell tower and other wireless communication landlord services including but not limited to: leasing, valuation, negotiation, relocation, auditing, mitigation, and planning. Applicants must be able to submit work in a prescribed format using specific computer programs from remote personal computers. To qualify for this work discipline the consultant must also show qualifications in each area below.
