2018 Nominating Convention Message From Chairman Rob Anderson, Dear State Delegate, Before attending the 2018 UTGOP Nominating Convention, please take a few minutes to review the attached convention packet so that you’re prepared for a full-day of events! Registration begins at 7AM. Multi-county races will begin at 8AM. (See page 4 for specific details.) The general convention will convene promptly at 11AM. Once the final credentials report is adopted by the convention body, registration will be closed. Please arrive early. We will be using your driver’s license for electronic registration. If you do not have a driver’s license, a government-issued photo ID will still be required and you will need to proceed directly to the Help Desk. Parking at The Maverik Center is NOT free. West Valley City will collect $10 per vehicle in the main parking lot AND in the overflow facility parking lot. We apologize for this inconvenience. We encourage you to carpool if possible. Also, if you require handicapped parking, there are 32 parking stalls located in the main parking lot the $10/car fee still applies. Wheelchair access to the building is located by the “Will Call” office. There are signs in the parking lot to direct you to the west-side of the main entrance, ground level. Arrive Early! There will be candidate booths, as well as vendor booths in the convention hall. This is a great time to have a final opportunity to meet with candidates prior to balloting, as well as mingle with other delegates, elected officials and Republicans from throughout the state! While we are doing everything possible to make Convention run smoothly and efficiently, please plan to stay for its entirety. Our goal is to have 100% of the delegates voting in all races, and on the submitted Constitution and Bylaw changes. Try not to leave until the convention has officially adjourned. Please remember to dress comfortably, and to wear sensible shoes as all of the seating will be stadium seating. Food will be available for purchase from the concession stands. A guest information booth will be located on the main corridor, which is up the stairs from the main entrance. (There will be signage to guide you along your way.) I look forward to seeing you at the Maverik Center, in West Valley City, on Saturday April 21st for what promises to be a very exciting Utah Republican Party Nominating Convention. Sincerely,

2018 Nominating Convention Proposed Convention Rules A. PURPOSE 1. This 2018 Nominating Convention shall nominate Republican Party candidates for United States Senate, First Congressional District, Second Congressional District, Third Congressional District, Fourth Congressional District, and multi-county districts of the State Senate and State House of Representatives. 2. The 2018 Nominating Convention shall conduct party business including amendments to the State Party Constitution, and State Party Bylaws. The Nominating Convention shall consider amendments to the standing State Party Platform.
B. CALL 1. The Utah Republican Party State Nominating Convention shall convene at 11:00 a.m. on Saturday, April 21, 2018, at the Maverik Center, 3200 Decker Lake Dr, West Valley City, UT 84119. 2. Multi-County State Senate District Elections shall be held beginning at 8:00 a.m. according to the schedule shown in an Appendix to these Rules. 3. Multi-County State House District Elections begin at 8:00 a.m. according to the schedule shown in an Appendix to these Rules.
C. RULES OF ORDER 1. The State Party Constitution and Bylaws, these Rules and the current edition of Robert’s Rules of Order shall govern this Convention. 2. These Rules shall govern any conflict with Robert’s Rules. 3. The Convention Chair is responsible to: a. Expedite business in every way compatible with the rights of the delegates; b. Decide all questions of order, subject to appeal; c. Enforce rules relating to debate, order and decorum; d. Maintain the course and objectives of the Convention.
D. ORDER OF BUSINESS 1. The order of business of this Convention shall follow the agenda adopted by the delegates.
2. Only delegates may participate in the business of the Convention; however, the Convention Chair may invite any individual to address the Convention. 3. In the hall, seating shall be organized by county, within each congressional district, with a separate area for non-voting visitors and media. Only credentialed media members may sit in the media section. A media credential card is nontransferable and must be obtained from the Convention Chair’s appointed Media Coordinator. 4. Each delegate to this Convention will be issued a credential card that is non-transferable and must be displayed at the time of balloting and any voting. In the event of electronic voting, each delegate will be issued a voting keypad or a scantron ballot that is non-transferable. Each delegate who does not return their voting keypad will have to pay the Utah Republican Party for the costs and penalties associated with replacing the voting keypad.
F. RECOGNITION TO SPEAK 1. A delegate must state his or her name and county and be recognized by the Convention Chair before speaking on Convention business. 2. No delegate may speak more than once or longer than two (2) minutes upon the same question, unless allowed by a majority of the Convention.
G. PLATFORM AMENDMENTS AND RESOLUTIONS 1. Only amendments to the Platform and resolutions which have been submitted in writing with seconding endorsements from at least five state delegates other than the sponsor and received at the Republican State Party Headquarters no later than 5:00 p.m. on the Thursday which occurs 28 days prior to the State Convention shall be presented to the Platform/ Resolutions Committee for review. There shall be a limit to no more than two amendments or resolutions sponsored by any one delegate. 2. The Platform/Resolutions Committee will meet with amendment and resolution proponents to discuss the amendments and resolutions preceding the Convention at Republican Party Headquarters.
1. Members of the public and media will be admitted to the convention hall to view the proceedings, as long as they follow proper conduct and the directions of the Convention Chair and Sergeant at Arms.
4. Amendments and resolutions may only be made during the time specified in the agenda approved by the Convention. The Convention may determine, by a majority vote, the order in which resolutions shall be considered. The debate

3. The Platform/Resolutions Committee shall forward nonredundant, significant amendments and resolutions to the Convention for consideration.

For each main motion on the Platform and resolutions, the chair shall allow proponents and opponents one (1) minute to gather and organize their comments before debate starts. 6. Unless determined otherwise, the time deemed by the agenda for each separate Platform amendment and resolution shall be no more than 6 minutes of total debate time, unless extended by a majority of the Convention, as follows: 2 minutes for the sponsor and other proponents, then 3 minutes for opponents, with the 6th minute reserved for sponsor summation. The debate time shall be exclusive of the time required to move and read the amendment or resolution.
H. CONSTITUTION, BYLAWS AND RULES AMENDMENTS 1. In order to be considered at the convention, amendments to the Party Constitution, and proposed changes to the Bylaws and Convention Rules must be received in writing no later than 5:00 p.m. on the Thursday which occurs 28 days prior to the State Convention, at Republican State Party Headquarters. 2. The Constitution/Bylaws Committee shall forward those duly submitted Constitution and Bylaw amendments either to the Convention or to the State Central Committee for consideration, and shall forward those duly submitted other Rules amendments to the Convention. 3. The debate and summation time for each amendment and bylaw change shall be determined by the convention agenda. Equal debate time shall be allowed for proponents and opponents of the motion. 4. For each main motion on the Constitution and Bylaws, the chair shall allow proponents and opponents one (1) minute to gather and organize their comments before debate starts. 5. Unless determined otherwise the time deemed by the agenda for each separate amendment shall be no more than than 6 minutes of total debate time, unless extended by a majority of the Convention, as follows: 2 minutes for the sponsor and other proponents, then 3 minutes for opponents, with the 6th minute reserved for sponsor summation. For an amendment to the Constitution or Bylaws, a motion to further amend, divide the motion, consider by paragraph, table, end debate (previous question), limit debate, postpone, commit, or request information shall not be considered.
I. CANDIDATE RULES AND REQUIREMENTS 1. Only Republican candidates who have properly filed for elected public office as required by law and meet the requirements of the Utah Republican Party Bylaws shall be considered by the Convention. In accordance with Party Bylaws, all candidates shall have filed a letter of intent and disclosure statement at State Party Headquarters no later than 5:00 p.m. on the Thursday which occurs 28 days prior to the State Convention. 2. Signage and distribution of literature rules shall be established by the rules committee, convention officers and the host facility. 3. The Candidate or his/her representative shall sign a document which states they have read and understand the CANDIDATE RULES AND REQUIREMENTS. Candidates will observe proper decorum, subject to the ruling of the Convention Chair. 4. All Candidates, special interest groups, and other organized groups shall pay a $500 refundable cleaning deposit before the convention. A group may consist of one or more individuals. 5. Anyone distributing materials at the Convention shall be responsible to remove their materials after the Convention, from the facility and the parking area. Clean up is required in order to get the $500 refundable cleaning fee returned. 6. Basic rules apply to all who have paid the $500 fee. (The intent is to have fairness, to treat all equally.) 7. All literature distributed must prominently display the name and contact information of the group or person responsible for it. Any literature being distributed without this disclosure may be removed from the premises.
J. NOMINATIONS 1. Opposed candidates shall be allowed five (5) minutes for presentation for U.S. House and U.S. Senate elections. a. Opposed candidates in multi-county legislative elections shall be allowed a total of twelve (12) minutes for presentation, divided equally among the candidates. b. Candidates are not required to have a nomination or second but may if they so desire. The total time limit remains the same regardless. Candidates and others in their presentations need not be delegates. c. The order of presentation shall be decided by random drawing. d. The intent is to have fairness, to treat all candidates equally. e. In Multiple Round Balloting, prior to a second or

and summation time for each amendment and resolution shall be determined by the convention agenda. Equal debate time shall be allowed for proponents and opponents of the motion.

2018 Nominating Convention K. PHYSICAL ARRANGEMENTS 1. Candidates and organizations are responsible for observance of these rules by their staff, campaigns, committees, supporters and delegates. Violations will result in forfeiture of deposits and removal of all signs of the violating group or individual. Each candidate or organization is responsible for the clean up of anything produced by, distributed by, or bearing the name of that candidate or organization. 2. Candidates and organizations will have access to the convention hall at a date and time announced to all candidates, to set up. No campaigning or electioneering will be allowed within 10 ft of the credentialing, registration or balloting areas. Signage and distribution of literature rules shall be established by the Rules Committee, Convention officers and the host facility. 3. Signage: a. Schedule for setup and take down of signs will be available from the State Republican Headquarters two weeks prior to the Convention. Sign placement must comply with the rules of the host facility. Sign placement will be limited to specific designated areas in the convention center and its grounds which have been approved by the Convention Coordinator, shown in an Appendix to these Rules. b. No helium balloons are allowed. c. Nothing may be affixed to any interior or exterior surface at the Convention Center. d. Projections (images projected electronically) are allowed only on surfaces directly above or within rented booth space by the candidate or organization that reserved that space, or as part of a media presentation if included in individual candidate’s speaking time by the candidate designated to speak. e. No signs may appear in or around the staging area of the arena. f.
Only professional installers may hang signs and rigging from the ceiling and must be coordinated in advance with the Utah Republican Party or its decorator.
g. No adhesive decals or signs of any kind are permitted for distribution on the premises. Any organization or individual distributing decals of any kind will surrender their $500 deposit and pay any additional direct costs incurred during cleanup. h. Decorations are not permitted on ceilings, painted surfaces, columns, fabric, decorative walls or fire
sprinklers. All decorative materials must be flame proof in accordance with fire regulations. 4. Booth space may be rented from the party, and likewise room or other display space, at rates determined by the party. a. All booth space, including the setting up of any tables inside or outside the Convention Center, must be obtained from or approved by the Utah Republican Party. Booths shall not be taken down until the Convention is officially adjourned on Saturday. b. Booth space will be chosen by lottery. c. Multi-county district elections will be held in separate rooms. Candidates who wish to have a table outside of the room prior to district meetings must contact party headquarters . 5. Distribution of food must be approved in advance by the State Republican Headquarters in coordination with the convention center management. No outside food or beverages are allowed. All food, beverages and concessions must be purchased through the convention vendor(s), including bottled water and other drinks. Candidates and organizations must contract with the convention vendor(s). 6. No confetti is allowed in the convention facilities. No glitter or balloons are allowed in the convention facilities. No hay or animals are allowed in the convention facilities, with the exception of service animals for disabled individuals. 7. The Rules Committee may make alterations or amendments to this section of the rules as needed to meet demands of the host facility and Party. 8. There shall be no restrictions on the distribution of printed material, except that materials may not be predistributed on the chairs in the convention hall. All printed material shall have a disclaimer identifying the responsible person or organization and phone number and be clearly printed on the material. 9. Candidates, organizations and individuals using the Convention for distribution, campaigning or any other promotional or reporting use shall be responsible to research and comply with the hosting facility’s policies and procedures and the Arrangements Committee’s requirements. 10. Any video or other recording and its purpose at the Convention shall be disclosed in advance to the Arrangements Committee or Convention Chair for approval. 11. There is no overnight parking at the host facility. No parking on sidewalks or blocking entrances. 12. Only the Utah Republican Party may distribute materials in the Convention’s main assembly halls or in any area where voting occurs.

subsequent round of balloting, remaining candidates shall be allowed one (1) minute each for additional presentation if they desire.

Any number of credentialed state delegates officially assembled shall constitute a quorum for the purpose of transacting business except that 60% of those credentialed shall be required for considering Resolutions and changes to the Party Constitution, Bylaws, and Platform.
M. GENERAL VOTING RULES 1. Other than the election of candidates or other balloting as noticed in the convention call, voting shall be by voice or by a show of delegate credentials, paper, electronic keypad, or scantron ballot. A call for division shall be accepted if 50 delegates stand in support. This division shall be an actual count of the delegates. A call for division is subject to a ruling by the chair that there has been a full vote and there is no reasonable doubt as to the voting result, but that ruling is subject to appeal. 2. The Credentials Committee directly after the opening ceremonies shall report the number of delegates registered as present with proper credentials and shall make a final report immediately preceding candidate speeches. 3. Suspension of Convention Rules shall be by a 2/3 of the delegate with a quorum present. 4. In contested statewide and federal races, candidate names shall appear on the ballot by random drawing at least seven (7) days before the Convention. In all races, candidate names shall appear on the ballot according to the following system: Each letter of the alphabet shall be randomly drawn. The order in which the letters are drawn shall be the order in which the candidate names appear on the ballot, proceeding from the first to the last letter of the last name and then the first name. The order of candidate presentations shall be the same as their order on the ballot. 5. There will be no absentee or proxy voting. 6. Unopposed candidates shall be declared the party’s Primary Nominee. 7. Voting will be conducted in the convention hall when the chair calls for the vote, after the candidate presentations. It is the prerogative of the chair to open and close balloting at appropriate times.
N. BALLOTS 1. Paper Ballots: (a) containing more than one (1) vote in a race; or (b) which are not clearly marked; or (c) with a vote for any person who was not properly nominated; or (d) for a candidate who has withdrawn or been eliminated from the race; will be considered spoiled and will not be counted for that race, either for a candidate or in the calculation of a majority threshold. Spoiled paper ballots may be exchanged
prior to deposit in the ballot box upon the showing of proper credentials and the surrendering of the spoiled ballot at the “Spoiled Ballot Desk(s)” where the spoiled ballot shall be exchanged and immediately destroyed in the presence of the requesting voter. Only State Delegates, upon presentation of proper credentials, will be allowed to deposit their own ballots in the designated ballot boxes when casting a paper ballot. 2. Electronic Keypads: State Delegates will be given the opportunity to verify their electronic keypad is working properly by conducting test votes. If an electronic keypad is deemed faulty, the delegate will exchange it for one that works properly. Upon verification, delegates shall cast their ballots electronically in the contested races that are balloted through electronic voting.
O. COUNTING ROOM & RESULTS 1. The Elections Committee Chair is responsible for the ballot counting room and poll watchers, the security of the ballots, ballot boxes, the accuracy of the count, and directing the access and conduct of all persons within the ballot counting room. 2. Poll watchers’ belongings such as purses, wallets, and all forms of electronics must be stored in a secure area outside of the ballot counting room. Poll watchers who bring electronics into the ballot counting room or break any other associated rule are immediately disqualified from the Convention and may be asked to leave. 3. The Elections Committee Chair is responsible to address any election related complaint and has the authority to take any election related complaint to the Convention Chair. 4. Each opposed candidate for statewide, multi-county state legislative and federal races shall be permitted to have one poll watcher. This poll watcher may not leave the ballot counting room before the vote tally for that office has been announced to the Convention. 5. Ballot counting shall not commence until after polls have been announced closed by the Convention Chair. Challenges to balloting must be made to the Convention Chair or Designee before that time expires. 6. Official tally sheets shall be used to record each counted vote, and shall be kept with the supporting ballots. These materials shall be preserved by the Party Officers in a secure location for at least five (5) business days following the Convention. 7. In the case of multiple ballots, the candidate with the fewest votes shall be eliminated in each round and more than one candidate may be eliminated when the sum of the votes received by the candidates to be eliminated does not exceed

2018 Nominating Convention the number of votes received by the next highest candidate, and that at least two candidates remain on the ballot. The two top candidates shall participate in the final ballot. 8. A candidate for an office that receives 60% or more of the votes cast at any point in the balloting process at the state nominating conventions shall proceed to the primary election. If a candidate has no primary opponent, the candidate shall proceed to the general election. 9. Any challenges to the counting process must be made to the Elections Committee Chair before the election result of that race are announced. Any candidate requesting a recount or challenging an election must file a request in writing to the Elections Committee Chair by 5:00 pm, two (2) business days following the Convention. Recounts or challenges may only be brought if they reasonably might affect the outcome of the election. 10. In the event of a tie, to determine which candidate advances to a succeeding round of balloting, the candidates shall be called before the delegates voting in that race for a coin toss. The candidate further down the ballot shall call heads or tails while the coin is in the air. The winner advances to the next round of balloting. If a coin toss was used to determine the winner, no challenge or recount request will be recognized.

As a Party, we are ruled by two governing documents: the Utah Republican Party Constitution and Bylaws. Both of these documents can be found on our website www.utah.gop under the Governance section. As you are already aware, 25 proposals, in accordance with our rules, were submitted by the March 22nd, 2018 5:00PM deadline. All said proposals that were duly submitted are included for your review. Pursuant to our governing documents, all submissions were forwarded to the Constitution and Bylaw (C&B) Committee for review. 2018 Nominating Convention Proposed Amendments (As submitted on March 22 at 5:00 pm) “Give Others a Chance to Serve” Constitution Amendment Purpose: Much of the UTGOP State Central Committee (SCC) membership has been in place a long time, with some members having served in these positions for over 20 years. No organization does well without a regular influx of new people and ideas. This amendment will produce an SCC comprised of fresh, vibrant leaders, instead of one creating rules for Caucuses and taking responsibilities away from state-delegate-elected UTGOP Officers. Effective Date: This amendment would take effect immediately if passed by a 2/3 vote of the attendees at the 2018 State Republican Nominating Convention, but have no impact on SCC membership until the County Party Organizing Conventions in 2019. Impact: This amendment: 1. Limits all At-Large County Representatives elected to the SCC at the County Organizing Conventions (or by filling vacancies in these positions) to a total of ten years of service in their capacity as County Representatives. 2. 2018 Nominating Convention UTGOP Constitution Amendment that enables State Delegates to: Vacate the At-Large Membership of the State Central Committee Purpose: Recent events have demonstrated several unexpected, unproductive, and unacceptable activities occurring during State Central Committee (SCC) meetings that may adversely impact state delegate rights and the UTGOP: 1. A significant group of SCC members has engaged in tactics to disrupt meetings and call emergency meetings that are difficult to attend on short notice, these meetings often serve personal interests. The SCC has become so dysfunctional that, of our body, we have about 50 disruptive members, and 20 non-disruptive members attending meetings, out of about 184 members (38%). 2. These disruptions have resulted in no significant business being conducted since the election of this committee a year ago (in this, an important election year) that promotes our Platform, helps elect our candidates, or supports our elected officials. 3. These at-large SCC members have been fixated on taking responsibilities away from the state-delegate-elected officers, effectively tipping the balance of power in the UTGOP away from the state delegates and towards the county delegates. 4. Since the SCC quorum requirement is just 40 members, this significant group has taken it upon themselves to pass Bylaw amendments that are illegal, and threaten to remove our Republican candidates from the ballot in November. Fortunately, UTGOP Chairman Anderson has been able to thwart these activities…for now. This amendment allows the Chair, during a Nominating Convention, to present state delegates with an opportunity to hit the “reset” button on a rogue SCC, and ask counties to provide new at-large SCC representatives so the UTGOP can continue conducting legitimate business for the party in an election year. Effective Date: This amendment would take effect immediately if passed by a 2/3 vote of the attendees at the 2018 State Republican Nominating Convention. At that time, the Chairman could exercise this option, allowing the State Delegates to have a say they would not otherwise have in the membership and direction of the UTGOP SCC. Impact: This amendment: 1. Allows the UTGOP Chair to place a motion before the state delegates, only at Nominating Conventions, to vacate the at-large membership of the SCC. 2. 2018 Nominating Convention “Return to Reason” Constitution and Bylaws Amendment Purpose: To fix an imbalance of power within the party, which has created a State Central Committee wherein there are about 50 members who are attempting to control the party organization.* Effective Date: Immediately, upon passage by a 2/3 majority vote at the 2018 State Republican Convention. Impact: This amendment: 1. Restructures the State Central Committee, with a smaller membership (134 vs. the current 180), due to fewer atlarge county representatives, 2. *Among other things they have: 1) called special meetings at times when they know many members can’t be in attendance, 2) openly treated the Chair and Vice Chair with contempt and attempted to bypass their authority, refusing to give up the microphone and stating “this body is now in control of this meeting,” 3) purposely dragged out meetings in order to wear out most members who finally leave, and then using the diminished attendance to their advantage to pass binding changes to the governing documents, policy and procedures, 4) attempted to vacate the chair from his position at meetings, 5) spoken openly about a desire to remove the Chair and Vice Chair from their positions permanently, 6) violated decorum, creating utter chaos in meetings, 7) invested the Secretary with powers far greater than those of the Chair and Vice Chair combined, 8) obstructed caucus and convention planning, 9) fired the party’s attorney, 10) replaced the party’s parliamentarian with their own parliamentarian at a special meeting, 11) sent out press releases and statements purporting to speak for the entire party, 12) attempted to serve as the liaison with the Lt. Governor’s office, and finally and most seriously, 13) passed a bylaw change which is in direct opposition to state election law and which could have devastating effects on the election of Republicans in Utah.

Summary This proposal would strike a clause from the URP Constitution Article IV such that no binding business may be considered by the party’s central committee unless noticed in the agenda. Proposal E. Notice of Meetings. A regular, quarterly State Central Committee meeting shall be noticed by postmarking an agenda at least two weeks before the intended meeting. A special State Central Committee meeting shall be noticed by postmarking an agenda at least one week before the intended meeting. No binding business may be considered at a State Central Committee meeting unless properly noticed by inclusion in the agenda except if a majority of the members in attendance vote to add an item to the agenda. Comments Currently, the State Central Committee may consider business without providing proper notice if a majority of its members want to do so. But doing so is not fair to those members who chose not to attend the meeting because the published agenda did not contain an item about which the member had a sufficient interest. Striking the exception would prohibit the committee from considering business that was not included in the proposed agenda for the meeting. The word, binding, is inserted to more specifically qualify the “business” of the committee. In other words, the committee could consider non-binding business without providing notice of it on the agenda (such as discussions about rules—but not decisions about rules, or discussions about caucus, or brainstorms to raise funds, etc.). Without inserting the word, binding, when striking the end of the sentence, the rule would become too restrictive.

In the event that three or more candidates are nominated for the same office, the convention may use multiple ballots or preference voting to choose Party nominees. The State Party Central Committee shall certify the method of election for the State Convention at least 6 months prior to the convention. In the case of multiple ballots, more than one candidate may be eliminated in each round, provided that the sum of the votes received by the candidates to be eliminated does not exceed the number of votes received by the next highest candidate, the first ballot shall be used to reduce the number of candidates to those receiving the highest percentage of votes that, when combined, represent a majority of votes. This process continues in each successive round until one (1) candidate receives a majority or in the case of public office, the balloting shall continue to a final round with the top two (2) candidates. If one (1) candidate for public office receives the 60% threshold, that candidate becomes the Party nominee but if neither candidate receives the 60% threshold, those two (2) candidates are to be referred to a primary election.

Pursuant to the requirements of Utah State Election Law, the following listings shall be made available to the public by the State Party and each County Party within the time frames specified: a. All officers of that party, within 7 days of their election or replacement; b. All persons holding membership on any governing bodies of that Party, within 14 days of their selection or replacement; c. Any other persons holding elected or appointed positions within that party, within 14 days of their election or appointment; d. Changes in delegate status shall be reflected in the listings within 14 days of their occurrence. 4. All delegate listings shall include, at a minimum, the name, precinct, Utah House district, Utah Senate district, Congressional district, address, phone number, and basis of eligibility of each delegate (e.g., election in the precinct caucus, election after the caucuses to fill an unfilled seat, or appointment to fill a vacancy occurring after the caucuses). 5. H. In the event that three or more candidates are nominated for the same office, the convention may use multiple ballots or preference voting to choose Party nominees. The State Party Central Committee shall certify the method of election for the State Convention at least 6 months prior to the convention. In the case of multiple ballots, the first ballot shall be used to reduce the number of candidates to those receiving the highest percentage of votes that, when combined, represent a majority of votes. This process continues in each successive round until one (1) candidate receives a majority vote. I. In the case of public office, A candidate for an office that receives 60% or more of the votes cast at any point in the balloting process at the state nominating conventions shall proceed to the general election. Should neither of the final two candidates receive greater than the 60% on the votes, those two (2) candidates shall be referred to a primary election. Summary This is a competing proposal to the one which the SCC passed at a recent regular meeting, and which is also before you as delegates today. Whereas the SCC’s proposal eliminates the phrase which allows “multiple ballots or preference voting” as options for balloting at a precinct caucus, this proposal keeps those methods as authorized options for precincts, while still allowing other balloting method(s) authorized by a county party’s rules. Proposal ARTICLE XII CAUCUS AND CONVENTION PROCEDURES Section 1. Precinct Caucuses B. The voting precinct caucus shall elect: 1) voting precinct officers; and 2) the number of delegates to the county convention and state convention that the voting precinct has qualified to elect, plus alternate delegates. Alternate delegates may also be elected if allowed by the respective county’s governing documents. In the event that three or more candidates are nominated for the same precinct office or the same delegate position, the caucus may use multiple ballots or preference voting or any balloting method allowed by the respective county’s governing documents to choose precinct officers or delegates.

Comment If this proposal is not passed by a 2/3 majority of delegates, but the competing SCC proposal is passed by only a majority of delegates, then “preference voting” (instant runoff voting, ranked choice voting, etc.) will not be allowed in counties where that voting option is not authorized in that county party’s governing documents. This is because Roberts’ Rules (p. 426) requires that “It [preferential voting] can be used with respect to the election of officers only if expressly authorized in the bylaws.” As a result, precincts in Salt Lake County and several other counties in which preferential voting is not specifically authorized, would no longer be allowed to use this efficient method for handling multiple candidate races for precinct officers or delegates. MODIFICATION
A. Ratification. The Constitution shall be binding when approved by a majority vote of the delegates present at a State Party Convention.
B. Amendments. The Constitution may be amended by a 2/3 vote of the members at a State Central Committee meeting if subsequently ratified by a majority vote of the Delegates present at the State Convention. This Constitution may also be amended by 2/3 vote of Delegates present at the State Convention. C. Submissions to the Convention. Proposed amendments to the Constitution or Bylaws which have been received in writing at state party headquarters by 5:00 pm on the Thursday which occurs 28 days prior to the State Convention, and which have been endorsed by at least six current state delegates, shall be included, in their entirety, in the call to the convention; shall be posted, in their entirety, in prominent position on the party website; and shall be placed in priority position on the proposed agenda to be sent to the delegates with the call to convention.
CD. Severability. If any portion of this Constitution is ever declared void, all other portions shall remain binding and effective.
Bylaw 7.5 STANDING CONVENTION RULES H. Constitution, Bylaws and Rules Amendments
1. In order to be considered at the convention, amendments to the Party Constitution, and proposed changes to the Bylaws and Convention Rules, with seconding endorsements from at least five state delegates other than the sponsor, must be received in writing no later than 5:00 p.m. on the Thursday which occurs 28 days prior to the State Convention, at Republican State Party Headquarters. 2. The Constitution/Bylaws Committee shall forward those duly submitted Constitution and Bylaw amendments either to the Convention or to the State Central Committee for consideration, and shall forward those duly submitted other Rules amendments to the Convention. The Party shall forward those duly submitted constitutional amendment proposals, bylaw change proposals and/or convention rules change proposals to the Convention. If requested by the submitter, the Constitution and Bylaws Committee shall also forward proposed constitutional amendments to the State Central Committee. 3. The debate and summation time for each amendment and bylaw change shall be determined by the convention agenda. Equal debate time shall be allowed for proponents and opponents of the motion.

2018 Nominating Convention Proposed URP Constitutional Amendment: Article III Section D March 2018 Background: Per the records of our Party Secretary, the average attendance at the last 13 SCC meetings is 111 persons, out of, for most of that time 182 SCC members, or less than 61% of the entire voting body. Since we had never had all members in attendance, the denominator of 182 seems unrealistic; it is never achieved in reality and therefore does not represent a reasonable standard. Reasoning: A US President is impeached upon a majority vote of those in attendance in the House of Representatives and ⅔ of the US Senate. These votes are based on those in attendance, and these are paid, professional politicians where their chief duty is to show up for votes. The SCC is mostly elected, volunteers who pay for their travel and are not reimbursed and have many other commitments. Therefore, with 111 of average attendance, and 103-110 required to remove an officer, it requires 95-99% of those in attendance to agree, which is never a standard in politics. The variance is from changes in the size of the SCC due to fluctuations of members of auxiliaries. A 2/3 vote impeaches a President and ¾ is the ratification standard of states approving a change to the US Constitution. We need this change to reflect the reality of attendance at SCC meetings and to remove any officer not willing or able to do their duties, committing ethical violations or for other egregious cause. The ¾ standard below is very high and only requires 1/4 to stand with an officer to keep them, that not in attendance should not be counted in any way, but they currently are. A majority of SCC members must be in attendance to consider removing any officer (over 50%). Example: If there are 172 SCC members, currently 104 would be needed to remove an officer. That is 94% of our normal attendance of 111. This proposed change would make it 75% or ¾ of 111 or 84 members. Seen another way, if 28 of the average of 111 wanted to retain any officer challenged, they could. This makes the standard for removal very high, but possible instead of setting a standard used nowhere else in politics of 94%, on average. 2018 Nominating Convention Proposed Resolutions Resolution To Direct Rob Anderson as Chair of the 2018 Utah Republican Party to work with the Governing Body of State Delegates and SCC members WHEREAS, Utah Republican Party Bylaws section 7.3 PARTY OFFICER NEUTRALITY requires Party Officers to remain neutral toward all candidates, and issues coming before the convention, and to not discriminate or restrict access to Party information and services. WHEREAS, in an interview with the Salt Lake Tribune, titled “Utah GOP chief slams Mitt Romney’s expected Senate run,” Rob Anderson is quoted as saying, “let’s face it, Mitt Romney doesn’t live here, his kids weren’t born here, he doesn’t shop here.” He also compared Governor Romney to Hillary Clinton, and said, “I have two questions for Mitt. First of all, why? And how do you expect to represent Utah when you don’t live here?” Rob Anderson later claimed that he was misquoted and that his statements were taken out of context. However, a tape of the interview verifies that the Salt Lake Tribune reported the interview accurately. WHEREAS, Party Chairman Rob Anderson has engaged in a pattern of behavior in which he ignores the Rules of the Party, including: • Unilaterally modifying approved bylaws and submitting them to the Lieutenant Governor • Failing to submit an operating budget to be approved by the State Central Committee, which has resulted in an additional $50,000 in legal obligations to the Party for legal counsel not approved by the SCC, as required by the Rules, and wrongfully using that legal counsel as personal counsel for the Chair • Interfering with the resignation of a State Central Committee Member to give that seat to his wife, Kathleen Anderson • Announcing that he had allowed the Party to take on approximately $75,000 of campaign debt from a defeated congressional candidate, in order to circumvent federal limits on individual donations to that candidate--a violation of FEC rules • Requesting that the SCC go into Executive Session (a confidential meeting), so his attorney could discuss sensitive lawsuit information, then having his staff video record the session and release it publically • Requesting that SCC members sign on to an electronic voting site using their cell phones, then monitoring private communications of SCC members, during the September 9, 2017 meeting WHEREAS, Rob Anderson has become hostile to the governing body of the Utah Republican Party by: • • • •
refusing to enact rules and decisions of the body publically, personally attacking members of the governing body aligning with others who have attacked members of the governing body failing to allow the State Central Committee to approve the 2018 Nominating Convention Committee
THEREFORE BE IT RESOLVED THAT: The 2018 Utah Republican Party Nominating Convention directs Chairman Rob Anderson to work with the governing body of the Utah Republican Party, the State Delegates, and the State Central Committee to promote Republican principles, follow party rules, and help elect Republicans in the November election.
