I § 1 Scope of the Act
(1) This Act regulates electronic toll collection for the use of designated sections of motorways, express roads and parallel roads to which traffic may be diverted from the transEuropean road network1) or directly competitive with certain parts of that network (hereinafter referred to as "specified road sections" ), according to the distance traveled, the rights and obligations of users of such specified road sections, the competence of state administration, Toll Collection Administrator, power control and responsibility for the breach of duties imposed by this Act. (2) The electronic tolling system uses one or more of the following technologies: a) satellite positioning, b) mobile communications GSMGPRS, c) 5, 8 GHz The microwave technology. (3) This Act does not apply to toll the form of payment under a special regulation.2) § 2 Basic provisions
(1) Electronic toll payment is electronically calculated amounts by category of vehicle for the Road usage (hereinafter referred to as "toll") on the basis of the data collected electronically. If it is not possible to calculate tolls electronically or on the basis of the data collected electronically, it can calculate the toll alternative way. Tolls can be paid in cash, bank transfer, credit card or other means approved by the Administrator toll collection. This is without prejudice to the obligation to provide for reimbursement of tolls for the use of specified road section length less than the length of a specified road section. Tolls except tolls collected on the use of motorways acquired under a concession contract under a special regulation, 2) the income of the National Motorway Company toll is National Highway Company, as required to apply to the execution of the tasks under a special regulation 3) (2) The use of specified sections of road motor vehicles with a gross weight of 3, 5 t or combinations of vehicles with a gross weight of 3, 5 t for transport of goods and vehicles allowing the transport of more than nine persons including the driver pays the toll. For the purposes of this Act the use of specified road section also means a special use roads under a special regulation, 4) even if for such special use permit is not required. (3) the distance traveled means the distance between two points defined section of road designated to crossing under the implementing regulations 4) (4) onboard unit is a device with a minimum interoperability in the implementation of toll transactions using some of the technology of satellite positioning and mobile communications GSMGPRS, or 5, 8 GHz microwave technology. § 3 Duties toll payer
(1) The obligation toll operator has vozidla5) and on site at the time of the inspection toll payment and the driver of the vehicle. (2) The operator of the vehicle and the driver of the vehicle are required a) before driving the specified sections of place and activate the vehicle onboard unit b) correctly and completely enter into the OBU technical vehicle data necessary to calculate tolls and its reversal, c) correct use of onboard unit d) comply with the toll schedules. (3) The obligation under paragraph 2. a) to c) shall not apply to the operator of the vehicle and the driver of the vehicle when calculating the substitute toll. § 4 Exemption from tolls
(1) The exemption from toll applies to vehicles a) Ministry of Interior of the Slovak Republic designated pursuant to special regulation 6) b) Ministry of Defence of the Slovak Republic, c) the armed forces or civilian components of the sending State for the purpose of performing official duties, 7) d) the Armed Forces of the Slovak Republic and the North Atlantic Treaty Organisation, e) rescue units of the integrated rescue system under a special regulation 8) f) Toll Collection Administrator, g) used for the maintenance of specified road sections, h) Toll collection authorized person used for electronic toll collection and control of electronic toll collection, i) Slovak Information Service, j) Railway Police, 8a) k) Prison and Court Guard, 8b) l) customs správy.8c) (2) Operators and drivers of vehicles exempt from tolls referred to in paragraph 1 are required to adhere toll schedules. § 5 The toll rate
The toll rate for 1 km road section is defined determines the categories of vehicles from 3, 5 t to 12 t gross vehicle weight over 12 t gross vehicle weight and enabling vehicles carrying more than nine persons including the driver. The method of calculating toll rates must take into account at least the EURO emission class and number of axles of the vehicle. § 6 Toll collection
(1) Toll collection is the National Highway Company, AS9) Toll Collection Administrator is authorized to conduct activities under this Act, authorize another person. (2) Toll collection is to build interest payment to pay the toll in cash, bank transfer, credit card or other means approved by the Administrator toll collection. In connection with its activities under this Act, the administrator can set up toll collection and distribution points and contact points. (3) For the purposes of this Act, the administrator electronic toll collection device to collect, use and storage under a special regulation10) the following: a) the registration number of the vehicle and its photographic representation, b) the technical data of the vehicle, c) the identification code onboard equipment, d) the length of the distance traveled by road, e) the rate of tolls and toll amount calculated, f) details of the vehicle operator under a special regulation, 11) g) data on the geographic location of the vehicle. (4) Toll collection or a person authorized for the purposes of this Act authorized to collect, process, use and store under a special regulation10) personal data of the vehicle, if a natural person, the authorized representative of the operator of the vehicle and the driver of the vehicle in the title, name , surname, date of birth, permanent address, nationality, ID card or passport and driving license number; without prejudice to the provisions of a special regulation on the protection of classified skutočnosti.11a) Where the driver of the vehicle in the performance of official duties or in connection therewith proves its jurisdiction under a special regulation, 11b) the person in charge of the control of the driver is authorized to require only the registration number of service card. (5) Toll Collection Administrator or his designee shall not be entitled to collect, process, use and store data referred to in paragraphs 3 and 4 of vehicles exempt from tolls under § 4 point. a), b), d) and i) to k) and their conductors. (6) Toll collection will ensure that the vehicle operator or driver of the vehicle in front of the Road usage may be placed in their vehicles on board units under § 2 par. 4. The onboard unit can be connected to the tachograph vehicle. (7) The Toll Collection Railway Police is obliged to fulfill its duties under this Act and the Slovak Information Service to enable continuous and direct access to the information gathered by the electronic device under paragraph 3. (8) Toll collection six months before the introduction of the toll collection system submitted to the Ministry of Transport, Posts and Telecommunications of the Slovak Republic (hereinafter the "Ministry") message that contains the unit values and parameters of cost items to be used in calculating the rates of tolls for specified sections roads, together with an explanation of how the provisions of tariffs for different categories of vehicles. § 6a Ministry
(1) Department at least four months before the new toll collection system shall submit to the European Commission a report containing a) unit values and parameters used in the calculation of cost items b) categories of vehicles to the payment of toll, c) the extent specified road sections which are used to calculate the cost, the percentage of intended to cover the costs and the amount of toll rates along with an explanation of how the provisions of toll rates. (2) The Ministry shall notify the European Commission any discount and reduction in toll rates and all exemptions from the obligation to pay tolls. § 7 Check
(1) check compliance with the obligations under § 3 Persons authorized to perform controls in conjunction with the Service toll police forces.12) (2) A person charged with carrying out checks are a) staff administrator Tolling nominee b) employees Administrator toll collection. (3) The person in charge of the control is demonstrated license issued by the Ministry. The card contains information about the identity of the name, surname, date of birth, permanent address and identity card number. (4) Records of licenses of persons authorized to perform inspection leads the ministry.
(5) Persons authorized to perform controls are eligible: a) to obtain information pursuant to § 6. 3 stationary electronic device or a mobile electronic device b) demonstrate evidence of failure to comply with the provisions of this Act, c) at the time of the check sum calculated choose toll d) if it can not determine the actual distance of the vehicle prejazdenú the specified sections of roads, toll calculated from the length of 650 km and the appropriate rate e) require the driver of the vehicle explanation f) require the driver of the vehicle proof of payment of tolls, g) control the location, operation and use of the OBU h) check the data entered into the onboard unit for calculating tolls and toll settlement. (6) Members of the police service toll during the inspection are empowered: a) direct the vehicles to the point of control for administrators Tolling or designee, b) prohibit continue driving or instruct the direction of travel, unless the vehicle inspected toll paid or not paid in the calculated amount, c) prohibit the driver next ride if the finding of a breach of any of the obligations set out in § 3; disable the driver can drive until such time as the operator of the vehicle or the driver of the vehicle fails to meet the obligations under § 3rd (7) Persons authorized to perform controls are obliged to prepare a certificate of inspection. Member services toll Police shall ensure notification of the offense or administrative offense prescribed procedures at the appropriate District Office for Road Transport and Roads ("the District Transport Office"), if the offense was not covered in the block at the place. (8) If the member services toll Police in exercising control under this Act finds other infringement, upon special regulation.12) (9) The provisions of paragraph 6 shall not apply to a driver who performs tasks in the area of protection of the constitutional system, internal order, national defense and security, 13) where the execution of these tasks can not be postponed and can not provide otherwise. § 7a Specific provisions on the detention of the registration certificate and registration plate of the vehicle
(1) A member of the police service toll is entitled to retain the registration certificate and registration plate of the vehicle if the driver of the vehicle does not pay the toll. If the driver of the vehicle is not willing to registration plate issued, member services toll police is authorized to withdraw; damage caused in connection with its withdrawal shall be borne by the vehicle operator. Registration certificate and registration plate of the vehicle shall be retained until the payment of tolls. (2) A member of the police service toll issue of the detention of the registration certificate and the detention registration plate of the vehicle in accordance with paragraph 1 confirm. The proceedings and decisions of the detention of the registration certificate and the detention registration plate of the vehicle are not subject to general regulations on administrative konaní.13a) (3) If it has been proven tolls paid, withheld registration certificate and registration plate of the vehicle shall immediately return the vehicle driver or operator. If the toll was manifestly paid within 15 days after the detention of the registration certificate and registration plate of the vehicle, is competent for their return service department toll police that those detained. If the toll was manifestly paid within 15 days of the arrest of the registration certificate and registration plate of the vehicle and the vehicle is registered in the Slovak Republic is competent for reimbursement police station, which records vehicle. (4) If the reasons for detention of the registration certificate and registration plate of the vehicle has ceased or within 15 days of their arrest, the police department toll service shall forward these to the police station, which records vehicle. (5) In the case of a vehicle which is not registered in the Slovak Republic, detained registration certificate and registration plate of the vehicle remain concealed at the toll services of the police department. Service Department toll police detained return the registration certificate and registration plate of the vehicle the driver or operator of the vehicle until there is payment of tolls. § 8 Offences
(1) An offense in the area of toll collection is committed by a person who a) using the specified road sections without paying the toll, b) refuses to pay the toll when prompted scrutiny of authorized persons on site at the time of inspection, c) does not have a vehicle onboard unit pursuant to § 3 paragraph. 2, d) not enter data or enters incomplete or misleading information to the OBU or disclose these data administrator toll collection or his designee, e) tamper with onboard unit or tampered strikes. (2) For an offense under paragraph 1 shall be imposed a fine of 2,655 Euros and block proceedings in the amount of 1,655 euros. (3) The misdemeanor proceedings are subject to special predpis14) the fact that the offenses referred to in paragraph 1 block in the proceedings pending before the police service toll. (4) The offenses referred to in paragraph 1 discussed the relevant district offices traffic. (5) Income from fines imposed for offenses revenue of the state budget of the Slovak Republic.
§ 8a Administrative offenses
(1) An administrative offense in the area of toll collection is committed by a natural person authorized to conduct business or legal person who a) enjoin or permit to ride on the selected road sections used vehicle for which it was not paid tolls or which does not have onboard unit b) in connection with proceedings for an offense in the area of toll collection authority authorized to clarify or discuss the infringement notifies the particulars of the person to whom entrusted driving, the name, surname and address, c) fails to fulfill its obligation under § 3rd (2) Administrative offenses under paragraph 1 heard in district offices traffic. (3) The administrative offense under section 1 stores Subdistrict traffic fine of 16,595 euros. (4) The fine is payable within 30 days of the entry into force of the decision imposing the fine. (5) Income from fines imposed for administrative offenses revenue of the state budget. § 9 Enabling provisions
(1) The Government of the Slovak Republic shall establish regulations of the Slovak method of calculating the amount of tolls and toll rates defined for 1 km stretch of road for vehicle categories from 3, 5 t to 12 t gross vehicle weight and 12 more total weight of the vehicle and allowing the carriage of motor vehicles more than nine persons including the driver. (2) The Ministry shall issue to the implementation of this Act generally binding legal regulation laying down a) the definition of road sections with electronic toll collection, b) details of the marking of vehicles Toll Collection Administrator or a person authorized vehicles, which are used to control toll collection, and documents to demonstrate the persons authorized to perform inspections. (3) The Ministry shall issue a generally binding legal regulation toll schedules that establish a) details of the rights and obligations 1. vehicle operators and drivers of vehicles subject to the myth according to § 2 para. 2, 2. vehicle operators and drivers of vehicles exempt from tolls pursuant to § 4 paragraph. 1, 3. Toll Collection Administrator and his representative 4. Persons authorized administrator Tolling pursuant to § 6. 1, b) details of the contract on the Road usage and providing OBU under this Act, c) details of the terms and conditions of payment of tolls and toll payment showing, d) details of the method and means of achieving the commitments vehicle operators, e) details of the manner of handling the onboard unit, its use, location, installation, connection, operation, operation, technical specifications and procedures to address the specific cases and disorders OBU f) particulars of the claims procedure, g) details of the rules for calculating and collecting tolls in some specific cases of use of specified road sections, h) details of the substitute toll calculation. § 10

In § 86, after paragraph 12 insert a new paragraph 13 is added: "(13) NDS as32aa) provides information on vehicle registration (except vehicles of category M1, L and T) only for the purpose of collecting tolls, without prior written request data on data carriers (in electronic form) at least once a month and even without the prior consent of the person to whom such information relates, in this range: a) the name or business name, permanent address or registered office, identification number or identification number of the holder of the vehicle, the vehicle owner and the person to whom the possession of the vehicle transferred, b) assigned registration number, type of vehicle, brand, trade name, type, variant and version of the vehicle, the date of first registration or year of manufacture, serial identification number (VIN), gross vehicle weight.
