Alternative Dispute Resolution Alternative Dispute Resolution (ADR) is a term that refers to problem-solving methods used to assist individuals in conflict reconcile their disagreements. ADR is an alternative to more traditional avenues of conflict resolution, such as court actions and hearings. ADR includes both mediation and conciliation. Through discussion and negotiation facilitated by a neutral third-party, such as a mediator, ADR participants are given the opportunity to take an active role in the outcome and settlement of their dispute. Parties often save valuable time, resources, and unwanted stress by participating in good faith to reach a mutually acceptable solution during the ADR process.
“From discord, find harmony. In the middle of every difficulty lies opportunity.” - Albert Einstein
The ADR program is a practical and useful service available to parties involved in charges filed with the Colorado Civil Rights Division (CCRD).
Mediation & Conciliation Mediation: After a charge is filed with CCRD, the charging party or respondent may request and engage in voluntary, confidential mediation prior to CCRD’s investigation. CCRD mediators hold a meeting or conference with the parties and facilitate settlement negotiations as the parties attempt to resolve the filed charge and dispute. Conciliation: If the CCRD Director makes a probable cause finding after investigation of the charging party’s allegations of discrimination against the respondent, the parties are required to participate in mediation. This mandatory mediation is called conciliation. CCRD conciliators assist the parties in attempting to reach a settlement and vindicate the public interest.
