IMPORTANT PROVISIONS Development Projects / Activities classified as Cat. A & Cat. B Cat. A Projects – Clearance by MoEF Cat. B Projects – clearance by State Env. Impact Assessment Authority. Central Govt. to constitute a State level Impact Assessment Authority / State Level Expert Appraisal Committee in consultation with State Govt (Clause 3/4 (iii)) Environmental clearance shall be taken prior to all other clearances (Clause 4 (ii) / 4 (iii)) State level authority to divide projects into Category B1 or Category B2. Category B1 projects will require EIA to be conducted (Clause 7(i)) Clearances from other regulatory bodies not required unless clearance is sequentially dependant on it (Clause 8(v)) Structure / content of EIA Report given in Appendix III & structure of Ex. Summary for EIA in Appendix III-A Validity of clearance specified (Clause 9) - 10 years River Valley projects - 30 years Mining - 5 years other projects - Building construction projects upto occupation of property Submission of half yearly Report compulsory on 1st June & 1st December to concerned Regulatory Authority & to be public documents (Clause 10) EC to be Transferable during its validity to any other legal entity with written NOC of the Transferor (Clause 11) Amended EIA Notification of 2006 to supersede the 1994 Notification but MoEF may continue operation of some of the provisions of the Notification upto One year from Notification date.
