The Complainant submits this complaint to the Court and states that there is probable cause to believe Defendant committed the following offense(s): COUNT I Charge: Solicit Child to Engage in Sexual Conduct-Prohibited Act Minnesota Statute: 609.352.2, with reference to:  609.352.4 Maximum Sentence: 3 years and $5,000 Offense Level: Felony Offense Date (on or about): 09/23/2016 to 09/30/2016 Control #(ICR#): 16036360 Charge Description: and with intent to engage in sexual conduct, solicit a child 15 years of age or younger, or someone the defendant reasonably believed was a child, namely Child 1, DOB 14 year old child to engage in sexual conduct, and the defendant was 18 years of age or older COUNT II Charge: Distribute via Electronic Communication Material that Relates/Describes Sexual Conduct to a Child Minnesota Statute: 609.352.2a(3), with reference to:  609.352.4 Maximum Sentence: 3 years and $5,000 Offense Level: Felony Offense Date (on or about): 09/23/2016 to 09/30/2016 Control #(ICR#): 16036360 Charge Description: and with the intent to arouse the sexual desire of any person, use the Internet or a computer, computer program, computer network, or computer system to distribute any material, language, or communication, including a photographic or video image, that relates to or describes sexual conduct to a child15 years of age or younger, or someone the defendant reasonably believed was a child15 years of age or younger, namely Child 1, DOB 14 year old child, and the defendant was 18 years of age or older 1

STATEMENT OF PROBABLE CAUSE   The Complainant states that the following facts establish probable cause:  

Your complainant is a licensed peace officer with the Washington County Sheriff's Office. Based on the reports regarding an incident involving solicitation of a minor for sex that occurred between 9/23/2016 and 9/30/2016, complainant offers the following statement to establish probable cause:  On 9/23/2016, Detective Folendorf of the Washington County Sheriff's Office participated in a detail posing as a 14 year old female posting an electronic message through the Whisper application: "Skipping school. Let's play." An individual with the screen name "ultrablue" responded back, sent a photograph of his motorcycle, and then inquired if the female was sexually active. Detective Folendorf, posing as the young female, stated "I'm 14, so I've done a little."  Thereafter, the two switched the mode of electronic communication to text message, which continued from 9/23/2016 to 9/30/2016. Based on the photograph of the motorcycle and cell phone number from which Detective Folendorf was receiving text messages, it appeared the person with whom she was communicating was 57 year old Charles Manley Anderson, DOB: 10/16/1958 ("DEFENDANT ANDERSON"). During the course of the electronic communication, DEFENDANT ANDERSON inquired if the Detective, posing as a 14 year old girl, was a "virgin" and stated that he "luv to make young girls cumming" and "I could teach you how to orgasm." DEFENDANT ANDERSON also sent photographs of a penis, sex toy, and testicle. DEFENDANT ANDERSON and the Detective, posing as a 14 year old girl, discussed whether they would have oral sex and intercourse when they meet. DEFENDANT ANDERSON agreed to bring Mike's hard lemonade and give the Detective, posing as a 14 year old girl, $50. On 9/30/2016, DEFENDANT ANDERSON and the Detective, posing as a 14 year old girl, agreed to meet at Sunfish Lake Park. On 9/30/2016, at approximately 1420 hours, DEFENDANT ANDERSON was observed driving a white pickup truck entering Sunfish Lake Park in the City of Lake Elmo, County of Washington, State of Minnesota. At approximately 1424 hours, DEFENDANT ANDERSON texted the Detective, posing as a 14 year old girl, stating "I'm here." Law enforcement took DEFENDANT ANDERSON into custody.  Under Miranda, DEFENDANT ANDERSON acknowledged texting the girl and letting her know he was at the park. DEFENDANT ANDERSON also acknowledged buying Mike's hard lemonade that day at a liquor store in Minneapolis, and that this was not "innocent" and was "wrong."  DEFENDANT ANDERSON has multiple convictions for Criminal Sexual Conduct, including: (i) Criminal Sexual Conduct in the Second Degree (26-K9-94-000054); and (ii) Criminal Sexual Conduct in the Second Degree (48-K3-97-000731).
