Salinas Union High School District ANNUAL NOTIFICATION OF THE UNIFORM COMPLAINT PROCEDURES (UCP) For students, employees, parents or guardians of its students, school and district advisory committees, appropriate private school officials or representatives, and other interested parties. The SUHSD has the primary responsibility to insure compliance with applicable state and federal laws and regulations and has established procedures to address allegations of unlawful discrimination, harassment, intimidation, and bullying, the charging of unlawful pupil fees and the non-compliance of our Local Control Funding Formula and Accountability Plans. The SUHSD shall investigate and seek to resolve complaints using policies and procedures known as the Uniform Complaint Procedures (UCP) adopted by our local board. Unlawful discrimination, harassment, intimidation, and bullying complaints may be based on actual or perceived sex, sexual orientation, gender, ethnic group identification, race, ancestry, national origin, religion, color, or mental or physical disability, or age, or on a person’s association with a person or group with one or more of these actual or perceived characteristics, in any program or activity that receives or benefits from state financial assistance. The UCP shall also be used when addressing complaints alleging failure to comply with state and/or federal laws in Adult Education, After School Education and Safety, Migrant Education, Consolidated Categorical Aid Programs, Career/Technical Education, Child Developmental, Special Education, Federal Safety Planning Requirements, Compensatory Education, English Learner Programs, HIV/AIDS Prevention, Foster and Homeless Youth, Nutrition Services – USDA Civil Rights, Physical Education, Tobacco-Use Prevention Education Program, and the Before and After School Programs. Complaints must be filed in writing with the following compliance officer: Associate Superintendent of Human Resources 431 West Alisal Street, Salinas, CA 93901 (831)796-7000 Ext. 1017 Complaints alleging discrimination must be filed within six (6) months from the date the alleged discrimination occurred or the date the complainant first obtained knowledge of the facts of the alleged discrimination, harassment, intimidation, bullying, and unauthorized pupil fees unless the time for filing is extended by the superintendent or his or her designee. Complaints will be investigated and a written decision or report will be sent to the complainant within sixty (60) days from the receipt of the complaint. This sixty (60) day time period may be extended by written agreement of the complainant. The Associate Superintendent of Human Resources shall conduct and complete the investigation in accordance with sections 4680-4687 and in accordance with local procedures adopted under section 4621. The complainant has a right to appeal the LEA’s Decision to the California Department of Education (CDE) by filing a written appeal within 15 days of receiving the LEA’s Decision. The appeal must include a copy of the complaint filed with the SUHSD and a copy of the LEA’s Decision. Civil law remedies may be available under state or federal discrimination, harassment, intimidation, and bullying laws, if applicable. In appropriate cases, an appeal may be filed pursuant to Education Code Section 262.3. A complainant may pursue available civil law remedies outside of the LEA’s complaint procedures. Complainants may seek assistance from mediation centers or public/private interest attorneys. Civil law remedies that may be imposed by a court include, but are not limited to, injunctions and restraining orders. El Distrito investigará y buscará resolver quejas usando los reglamentos y los procedimientos conocidos como los procedimientos uniformes de quejas (UCP) adoptados por nuestra mesa directiva escolar local. Las quejas que alegan discriminación ilegal pueden ser basadas en el sexo percibido o verdadero, orientación sexual, género, incapacidad, identificación de grupo étnico, raza, ascendencia, origen nacional, religión, color, o discapacidad física o mental, o edad, o sobre la asociación de una persona con una persona o grupo con uno o más de estas características percibidas o verdaderas, en cualquier programa o actividad que recibe o se beneficia de ayuda financiera estatal. El UCP también se usará en responder a las quejas alegando falta de cumplimiento con la ley estatal y/o federal en la Educación Adulta, Educación y Seguridad Después de Clases, Educación Migrante, Programas Consolidados de Ayuda Categórica, Educación profesional/técnica, Desarrollo Infantil, Educación Especial, Requisitos Federales de Planificación de la Seguridad Escolar, Educación Compensatoria, Programas de Aprendices de Inglés, Prevención de VIH/SIDA, Educación para Niños Sin Hogar y Niños con Padres Temporales, Servicios de Nutrición – Derechos Civiles USDA, Educación Física, Programa de Educación en la Prevención del Consumo de Tabaco, y los Programas Antes y Después de Clases Regulares. Las quejas se deben presentar por escrito con el funcionario de cumplimiento siguiente: Superintendente Asociado de Recursos Humanos 431 West Alisal Street, Salinas, CA 93901 (831) 796-7000 Ext. 1017 Las quejas que alegan discriminación deben presentarse dentro de seis (6) meses a partir de la fecha en que presuntamente ocurrió el hecho o cuando el demandante que interpone la queja conoce el hecho de la presunta discriminación, a menos que el tiempo para presentar la queja es extendido por el superintendente o su designado. Las quejas serán investigadas y una decisión por escrito o reporte se mandará al demandante dentro de un período de sesenta (60) días posteriores al recibo de la queja. Este período de sesenta (60) días puede ser extendido por un acuerdo por escrito del demandante. El Superintendente Asociado de Recursos Humanos conducirá y completará la investigación de acuerdo con las secciones 4680-4687 y de acuerdo con los procedimientos locales adoptados bajo la sección 4621. El demandante tiene el derecho de apelar a la decisión de la Agencia Educativa Local (LEA) ante el Departamento de Educación de California (CDE) por medio de presentar una apelación por escrito dentro de quince (15) días en que recibió la Decisión de la LEA. La apelación debe incluir una copia de la queja presentada ante del SUHSD y una copia de la Decisión de la LEA. Los recursos de la ley civil pueden ser disponibles bajo las leyes estatales y federales de discriminación, si aplicable. En casos apropiados, una apelación puede ser presentada conforme al Código de Educación 262.3. El demandante puede procurar recursos disponibles de la ley civil fuera del procedimiento de quejas de la LEA.
