Transfer for Students Attending a No Child Left Behind (NCLB) Title I Program Improvement School and/or a School Identified for Corrective Action or Restructuring Upon notification by the California Department of Education of the school(s) status as "NCLB Program Improvement," the parents/guardian of all students enrolled in the identified school must be notified in a timely manner of their option to transfer to another school within the District which has met Annual Yearly Progress (AYP) and/or has a higher Academic Performance Index (API) than the student's school of residence. Dates and time lines will be publicized in advance of the Program Improvement opt-out period. Applications will be accessible online at www.fsusd.org and computers with internet access will be available in the Education Services Department. The permit process is outlined in BP 0520.2 and AR 0520.2, Title I Program Improvement Schools. Transfers from a "Persistently Dangerous" School Upon receipt of notification from the California Department of Education (CDE) that a district school has been designated as "persistently dangerous," the Executive Director of Pupil Services or designee shall provide parents/guardians of students attending the school with the following notifications: 1.

Within 10 days of receipt of the notification from CDE, notice of the school's designation

Within 20 days of receipt of the notification from CDE, notice of the option to transfer their

(cf. 0450 - Comprehensive Safety Plan) Parents/guardians who desire to transfer their child out of a state designated "persistently dangerous" school shall provide a written request to the Executive Director of Pupil Services or designee and shall rank-order their preferences from among all schools identified by the Executive Director of Pupil Services or designee as eligible to receive transfer students. The Executive Director of Pupil Services or designee may establish a reasonable timeline, not to exceed seven school days, for the submission of parent/guardian requests.

The Executive Director of Pupil Services or designee shall consider the needs and preferences of students and parents/guardians before making an assignment, but is not obligated to accept the parent/guardian's preference if the assignment is not feasible due to space constraints or other considerations. For students whose parents/guardians accept the offer, the transfer shall generally be made within 30 school days of receiving the notice of the school's designation from the CDE. If parents/guardians decline the assigned school, the student may remain in his/her current school. The transfer shall remain in effect as long as the student's school of origin is identified as "persistently dangerous." The Executive Director of Pupil Services or designee may choose to make the transfer permanent based on the educational needs of the student, parent/guardian preferences, and other factors affecting the student's ability to succeed if returned to the school of origin. The Executive Director of Pupil Services or designee shall cooperate with neighboring districts to develop an interdistrict transfer program in the event that space is not available in a district school. (cf. 5117 - Interdistrict Attendance) Transfers for Victims of a Violent Criminal Offense Within a reasonable amount of time, not to exceed 14 days, after it has been determined that a student has been the victim of a violent criminal offense while on school grounds, the student's parents/guardians shall be offered an option to transfer their child to an eligible school identified by the Executive Director of Pupil Services or designee. In making the determination that a student has been a victim of a violent criminal offense, the Executive Director of Pupil Services or designee shall consider the specific circumstances of the incident and consult with local law enforcement as appropriate. Examples of violent criminal offenses include, but are not limited to, attempted murder, battery with serious bodily injury, assault with a deadly weapon, rape, sexual battery, robbery, extortion, or hate crimes. The Executive Director of Pupil Services or designee shall consider the needs and preferences of the affected student and his/her parent/guardian in making the offer. If the parent/guardian elects to transfer his/her child, the transfer shall be completed as soon as practicable. Other Intradistrict Open Enrollment Except for transfers under NCLB Program Improvement School, students attending a state designated "persistently dangerous" school, or victims of a violent criminal offense ", the following procedures shall apply to all other intradistrict open enrollment options: Intradistrict Open Enrollment transfers are required when a parent/guardian wishes his/her child to attend kindergarten through grade 12 in a school other than the neighborhood home school within the district. Each individual student must be registered at his/her designated neighborhood school prior to submitting an application for open enrollment. Failure to register at his/her designated neighborhood school will void the Intradistrict Open Enrollment Application. Students who move from one attendance area to another attendance area within the district must complete an

Intradistrict Open Enrollment application to apply to remain in their previous school. K - 12 Open Enrollment Transfer Application Period The open enrollment application period will occur annually for those students who will enter kindergarten through grade 12 for the beginning of the next school year. The district, in all instances and in accordance with law, shall determine which school sites will be considered for open enrollment purposes. Dates and windows will be publicized in advance of the open enrollment period. Applications will be accessible online at www.fsusd.org, and computers with internet access will be available in the Student Services department. Applications must be submitted online during the established advertised application window. A student who is enrolled in a K-8 elementary school, and whose parents would like their student to attend a middle school, are required to apply for open enrollment during the open enrollment period. Students who are interested in enrolling in special programs such as Gifted and Talented (GATE), Dual Immersion (DI), International Baccalaureate (IB), Matt Garcia Career and College Academy, Early College High School, and the Public Safety Academy (PSA) shall adhere to the respective application guidelines. Students who are accepted into special programs are not required to apply for an open enrollment transfer. Students who are accepted into special programs and who choose to leave the special program are required to enroll in their resident school. (cf. 6181 - Alternative Schools/Programs of Choice) Parents/guardians may submit one open enrollment transfer application per child. A separate application must be submitted for each child in a family. Information regarding the open enrollment period will be available at the Student Services department and school sites. Procedures 1. Students shall be enrolled or registered in a Fairfield-Suisun Unified School District school. 2.

Applications must be submitted online during the established advertised window.

3. A random unbiased lottery selection will be conducted by the Executive Director of Pupil Services or designee for applications submitted during the Open Enrollment window. Late applications will be considered after those applications submitted during the window and in the order in which they are received. Refer to Selection Priorities for Intradistrict Open Enrollment Transfers below. 4. Applicants will be contacted by the Executive Director of Pupil Services or designee when space is available. Applicants who receive approval must confirm their intent to accept the Intradistrict Open Enrollment placement with the Department of Student Services within two business days. Failure to respond will result in the withdrawal of the approval and removal from all

Intradistrict Open Enrollment lists. Selection Priorities for Intradistrict Open Enrollment Transfers Submitted within the Window As a requirement of Education Code 35160.5, a random unbiased lottery selection will be conducted by the Executive Director of Pupil Services or designee following the application period to determine student acceptance if requests exceed space availability. A waiting list shall be established from the order determined in the random unbiased lottery to indicate the order in which applicants will be accepted, should space become available. Space at each school may be reserved for 1) walk-in enrollment for neighborhood students; 2) NCLB Program Improvement transfers; and 3) Overflowed students On-time Intradistrict open enrollment transfer requests shall be granted according to the following priorities: 1.

Transfers of District Employees' Students Students of employees will receive priority

2.

Transfer of Siblings of Foster Youth Foster care students whose foster youth siblings currently attend the requested school will receive priority

3.

Transfers of Siblings Students whose siblings currently attend the requested school will receive priority.

Additional Information: 1. Once any student is enrolled through the Open Enrollment process that school shall become the school of residence through the highest grade level at that school. Students who discontinue enrollment from the district shall lose their transfer status. 2. The Executive Director of Pupil Services or designee shall inform applicants as to whether their application has been approved, denied or placed on a waiting list no later than four weeks prior to the start of the next school year. If the application is denied, the reason(s) for denial shall be stated. 3. A student may voluntarily change schools through the open enrollment process once each school year. Upon acceptance, the new school becomes his/her home school for enrollment purposes through the highest grade level at that school. All open enrollment placements will be finalized between the tenth and the fifteenth day of instruction. After the fifteenth day of instruction, no open enrollment transfers will be considered until the next school year unless administratively mandated by the Executive Director of Pupil Services or designee.

4. Disagreements with the open enrollment process shall be resolved by the Executive Director of Pupil Services 5. Any complaints regarding the Intradistrict Open Enrollment transfer process shall be submitted in accordance with the applicable complaint procedure. (BP 1312.3 - Uniform Complaint Procedures) 6. District students who have been placed in specific programs such as Gifted and Talented Education (GATE), Dual Immersion (DI), International Baccalaureate (IB), or Early College, and who opt out of the specific program will revert to their school of attendance in accordance with AR 5111.3. 7. Students enrolled in kindergarten through eighth grade schools will need to apply through the Open Enrollment process if they would like considered to attend a middle school. 8. Transportation: The District does not provide transportation to or from school for Intradistrict Open Enrollment transfers. Notifications Notifications shall be sent to parents/guardians at the beginning of each school year describing all current statutory attendance options and local attendance options available in the district. (Education Code 35160.5, 48980) Such notification shall include: a.

All options for meeting residency requirements for school attendance.

Program options offered within local attendance areas.

c. A description of any special program options available on both an interdistrict and Intradistrict basis. d. A description of the procedure for application for alternative attendance areas or programs and the appeals process available, if any, when a change of attendance is denied. e. The explanation of attendance options under California law as provided by the California Department of Education. (cf. 5145.6 - Parental Notifications)
