ABK merupakan orang Indonesia dalam batas usia antara 18 sampai dengan 40 tahun dengan keadaan sehat secara fisik dan mental. 船員是印尼人民且身體健康，身體上和精神上的年齡限制在18至40歲之間。 2 Crews must have a legal and valid document prepared before they depart to work in destination country. Article II DIAGNOSIS AND THREATMENT OF HEALTH / 診斷及治療健康 Crews have been declared fit to work on boat proofed by medical check-up result ABK telah dinyatakan fit untuk bekerja di atas kapal yang dibuktikan dengan hasil medikal. 已宣布船員適合在船上工作，如醫療成果可見一斑。 Medical examination must be performed by a health care provider which is legally recognized and meet the requirements of medical center Tes medikal harus dilaksanakan oleh lembaga kesehatan yang telah disahkan dan memenuhi persyaratan sebagai pusat medikal. 醫療測試都必須由衛生機構已批准及符合要求的醫療中心開展。 Party A will provides all necessary medicines needed by crew during contract period. Pihak-A akan menyediakan semua obat-obatan yang dibutuhkan oleh ABK selama masa kontrak kerja. A(甲方)將提供船員為期限的勞動合同所需的合法藥物。 In a certain condition Party A will performs medical examination if needed during contract period. Article III CONSULAR EXPENSES 1 Party A agree to bear the following expenses incured in connection with the crew's employment : Pihak-A setuju untuk menanggung biaya yang timbul dalam perekrutan ABK: 甲方同意承擔以下費用與船員的就業： - Round Flight Ticket / Ticket Pulang-Pergi / 圆形机票/门票去圆 2 Party A agree to bear the recruitment fee for the crew with condition shall be completing their contract. Pihak-A setuju untuk menanggung fee rekrutmen dengan kondisi ABK harus menyelesaikan kontraknya. A(甲方)同意承擔完成合約的船員招募費的條件。 3 If crew has problem and should be repatriated during first 4 month of working period, Party B would replace them with another eligible crew or the recruitment fee would be deducted to the next invoice. Jika ABK bermasalah dan terpaksa harus dipulangkan dalam 4 bulan pertama masa kerja, Pihak-B akan menggantinya dengan ABK lain yang memenuhi syarat tanpa mendapatkan fee rekrutmen dari Pihak A atau Fee Rekrutmen akan dikembalikan kepada Pihak A pada invois berikutnya. 如果船員有問題在前4個月，B(乙)方將無條件更換一位給甲方，或是在下一次帳單扣除買斷費。 4 Crew provided by Party B should be ready to depart based on the schedule provided by Party A. Otherwise, all of arrangement cost of crew departure would be beared by Party B (Ticket, Visa, Ticket Cancellation Cost etc) ABK harus siap diberangkatkan sesuai dengan jadwal yang disediakan oleh Pihak-A, Jika tidak, Biaya pengurusan pemberangkatan ABK ditanggung oleh Pihak B (Tiket, Visa, Biaya Pembatalan Tiket, dll) 乙方的船員會按照甲方提供的行程表出發，否則乙方會負擔費用(機票、簽證費、機票取消費等等。 5 Party-B will reimburse all costs incurred by Party-A if the crew had problems upon arrival at the destination airport, and had to be returned to the country of origin (Jakarta) because of false documents such as fake passports, fake seaman books, etc. Pihak-B akan mengganti semua biaya yang dikeluarkan oleh Pihak-A jika ABK bermasalah setibanya di bandara tujuan, sehingga harus dikembalikan ke negara asal (Jakarta) dikarenakan kesalahan dokumen seperti paspor palsu, buku pelaut palsu dll. B(乙方)將報銷所有費用，如果船員抵達目的地機場時有任何問題，導致它必須返回到該國的原產地（雅加達 ）的錯誤，由於假文件如護照，假等海員書。

Article IV CONTRACT PERIOD / 合同期 1 Contract period is for 24 months, effective from the date of departure from Indonesia and will be continued if agreed between the ship master and crew. Masa kontrak adalah selama 24 bulan dan berlaku mulai dari tanggal keberangkatan ABK dari Indonesia dan bisa diperpanjang masa kerjanya jika ada persetujuan antara shipmaster dan ABK. 船員合同期為24個月，並且是有效的起始之日起出發的印尼船員和他的任期可以延長，如果有船長和船員之 間的協議 2 Party-A shall inform Party-B if there is a crew that will extend his contract after the contract is completed. Pihak-A harus menginformasikan kepada Pihak-B jika ada ABK yang akan memperpanjang masa kontraknya. 甲方應通知乙方，如果有船員將延長合同。 3 Employment contract is declared expired and crew declared has completed the contract after 2 years of work or if crew are returned by Party A to the country of origin (Indonesia) before they reach 2 years of work due to the things that caused the vessel could not longer operate, like a fire, the ship is damaged etc. Masa kontrak kerja berakhir dan ABK dinyatakan selesai kontrak setelah 2 tahun kerja atau jika Pihak-A mengembalikan ABK ke negara asal (Indonesia) sebelum 2 tahun kerja karena terjadinya hal-hal yang menyebabkan kapal tidak bisa beroperasi lagi seperti terjadinya kebakaran, kapal rusak dll, 宣布完成2年後的就業合同,若船隻無法運行，或船舶意外損壞等.等同兩年滿期 4 The Crew is declared broken the contract if returned by Party A due to disobedience (not follow) to the shipowner. ABK dinyatakan putus kontrak apabila dikembalikan oleh pihak A karena selalu membangkang dengan Pemilik Kapal. 當船東需要船員配合轉船的時候，船員須無條件配合，否則視同違約 Article V AGENCY FEE 1 Party A should pay recruitment fee to Party B for each crew sent by Party B to Party A as follows: Pihak A harus membayar fee perekrutan kepada Pihak B untuk setiap ABK yang dikirimkan oleh Pihak B ke Pihak A sebagai berikut: 甲方將付買斷費給乙方；每個船員美金550元，若是需要簽證則為美金600元。 - US$ 600 per crew departed with visa. - US$ 550 per crew departed without visa. 3 Party A must make a payment of the fees and crew salary at least 3 days after receiving invoice sent by Party B Pihak-A harus melakukan pembayaran Fee dan gaji ABK paling lambat 3 hari setelah menerima invois dari Pihak-B. 甲方須支付費用和船員工資最遲不超過3天,在接收乙方的收據之後。 4 Crew’s Rank and wage are determined based on their working career and it will increase on the next year of contract. Penentuan Peringkat ABK dan besarnya gaji ABK adalah berdasarkan tingkat pendidikan dan pengalaman kerjanya dan akan meningkat di tahun berikutnya. 測定評級船員船員和薪水是基於教育水平和工作經驗，並在明年將增加。 5 Party A shall pay all of amount from the invoice sent by Party B to the determined bank account after Party A check the amount is correct Pihak-A harus membayarkan semua jumlah yang tercantum pada invois yang dikirim oleh Pihak B setelah Pihak A mengecek jumlahnya benar adanya. 在A(甲方)核對B(乙)方所給的帳單，確認金額無誤之後，需匯款至(乙)方所指定之帳戶 Article VI INSURANCE / 保險 1 During Crew's work contract period, Party A obliged to insure crew from all kinds of possible injuries and even death and valid from the date of departure. Selama masa kontrak, Pihak A wajib mengasuransikan ABK dari segala macam kemungkinan kecelakaan kerja dan bahkan kematian dan berlaku sejak tanggal keberangkatan ABK. 甲方應讓船員避免各種可能的傷害，甚至死亡，並出發船員之日起有效。

2 If Crew got injured or dead while working on board, the employer shall arrange for local medical treatment. In this case, the employer must pay the expenses of the local medical treatment. After being repatriated to Jakarta, the expenses of medical treatment or compensation for bereaved family shall be covered by compensation of insurance policy in Indonesia. Jika kru terluka atau mati saat bekerja di kapal, majikan harus mengatur perawatan medis lokal. Dalam kasus ini, majikan harus membayar biaya perawatan medis setempat. Setelah dipulangkan ke Jakarta, biaya perawatan medis dan kompensasi bagi keluarga yang ditinggalkan harus ditutup dengan kompensasi polis asuransi di Indonesia. 如果船員在船上工作時受傷或死亡，雇主必須安排當地的醫療。在這種情況下，雇主單位必須支付的當地醫 療成本。返回雅加達，包括醫療和賠償死者家屬的費用應該由工傷保險政策在印度尼西亞 3 In case of death or injury to crew, Party A must try do the best to provide all necessary documents to Party B. Dalam kasus kematian atau cedera pada kru, Pihak-A harus mencoba melakukan yang terbaik untuk menyediakan semua dokumen yang diperlukan untuk Pihak-B. 船員死亡或受傷的情況下，甲方必須設法提供B方必要的文件 4 Party A shall pay the repatriation costs of crew to Indonesian (for hard injuries), in case of death, party A will provide services to process it according to Muslim custom in nearby countries. Pihak-A harus membayar biaya pemulangan kru ke Indonesia (untuk cedera keras), dalam kasus kematian, Pihak-A akan menyediakan layanan untuk proses itu menurut adat Muslim di negara-negara terdekat. 一方必須支付遣返費用印尼船員（硬受傷），死亡的情況下，甲方將提供服務的過程中根據周邊國家穆斯林 的習俗。 Article VII DEPOSIT OR GUARANTEE MONEY / 存款或保证金 1 Party A will retain crews salary of U.S. $ 800 as collateral and it will be given back to the crew after Finish Contract. The definition of finish contract is crew return to country of origin (Indonesia) after worked for 24 month completely. And if crew has worked for more than 1 year and returned in accordance with Captain or Party A or Shipowner's instruction due to the vessel concerned has ended the session, docking, sold by the owner, or bankrupt company, then the guarantee money will be given back to the crew in accordance with ratio of employment (US$ 800/24 x ...... month of employment) Pihak A akan menahan gaji Pelaut sebesar US$ 800 sebagai jaminan dan uang tersebut akan diberikan kembali kepada ABK setelah Finish Contract. Pengertian Finish Contract adalah ABK pulang ke Indonesia setelah bekerja genap 2 tahun (24 bulan). Apabila ABK bekerja lebih dari 1 tahun dan dipulangkan atas dasar perintah Nakhoda/Kapten atau Pihak A dikarenakan kapal bersangkutan telah mengakhiri akses (finish session), naik dermaga (docking) atau kapalnya dijual oleh Pemiliknya dan/atau Perusahaan mengalami Pailit, maka jaminan akan dikembalikan ke ABK sesuai dengan perbandingan masa kerja (US$ 800 : 24 X ....bulan kerja) 船員的保留款為美金800元整，若是船員工作期滿2年視同滿期，則需無異議退回給船員。若是船員工作超過 一年，非因船員本身原因而被遣返，保留款則按比例退回(800除以24個月乘上工作月數) 2 Deposit will be retained by installments during the first 8 months of US $ 100 and the total is US $ 800 Deposit akan dipertahankan dengan diangsur selama 8 bulan pertama sebesar US $100 dan totalnya adalah US $ 800. 保留款分8期每期美金100元，總共為美金8百元。 3 If the crew does not complete the contract because of their own accord with any reason, then the crew must bear all of returning expense (ticket, mess etc) deducted from their salary and crew concerned declared has broken the contract with the result that the guarantee money will be forfeited. Jika sebelum finish kontrak ABK mengundurkan diri atas permintaan sendiri dengan alasan apapun, maka ABK harus menanggung segala biaya kepulangannya (tiket, mess, dll), dipotong dari gaji dan dianggap tidak finish kontrak, sehingga jaminan dianggap hangus. 如果船員因為自己的原因導致沒有完成合約，船員會從薪水扣除遣返的費用，且其保留款將被沒收。

ABK yang selalu melakukan kekerasan, pengrusakan peralatan dan atau selalu membangkang. 船員始终是暴力，破壞或設備，並始終叛逆。 2 Crew were negligent in work and or make a serious mistake. ABK telah lalai dalam bekerja dan atau telah membuat kesalahan fatal. 船員已在他們的工作疏忽或犯了一個致命的錯誤。 3 Crew intentionally uses ship equipment to interests outside the ship or send them out of the ship. ABK yang dengan sengaja membawa, mengeluarkan peralatan-peralatan keluar dari kapal untuk kepentingan pribadi. 船員人明知而带來的船供個人使用，發卡設。 4 The crew were convicted of violation of local laws when the ship leaned on the port. ABK yang telah melakukan pelanggaran hukum lokal ketika kapal sedang sandar di pelabuhan. 船員誰違反了當地的法律，當船舶停靠的港灣 5 Crew who refuses the reasonable working instruction of the senior and/ or disturb duties of other crew ABK yang menolak instruksi kerja yang wajar dari senior dan / atau mengganggu tugas ABK lainnya 船員誰拒絕合理的工作指示，從高級和/或乾擾與其他船員職務 6 The crew got off the ship without the permission of the captain and not return within the time specified by the captain. ABK yang turun dari kapal tanpa izin dari kapten dan tidak kembali dalam waktu yang telah ditentukan oleh kapten. 船員們下船未經許可的隊長和隊長所允許的時間內返回。 7 Crew who habitually over drinks and gambles. Article X DISPUTE / 争执 Disputes or complaints that arise concerning the provisions of this contract will be settled in accordance with the following procedures: Sengketa atau keluhan yang muncul tentang ketentuan kontrak ini akan diselesaikan sesuai dengan prosedur sebagai berikut: 將以糾紛或投訴方面出現本合同規定的，按照下列程序： 1 Complaints submitted directly to the officer on board. Keluhan disampaikan langsung kepada Petugas di atas kapal. 投訴直接提交給有關人員在船上 2 Report and submit a written report to the head of the section where the crew employed. Melaporkan dan menyerahkan laporan tertulis kepada kepala bagian di mana para ABK bekerja. 報告並提交一份書面報告，船員工作的部分，在那裡頭 3 Report and submit a written report to the ship captain. Article XII JOINT COMMITTEE 1 Questions arising out of the provisions of this agreement should be based on the Join Commitee formed jointly by Party A and Party B. The Committee shall obtain full authority to act and his decision will be final and binding. Article XIII CORRECTION AND AMENDMENT Both parties agree that this agreement applies as referred to in Article XI. both parties can at any time in writing and submit corrections changes to this agreement.
