The subject matter was discussedby the General Secretary,NFIR with EDEOD, Railway Board on 2810612016_ (C) dated04fr March 2016 During discussions,the EDE(N) gavea copy of O.M. No. 490141212016-Estt. sent by the Director (Establishment/DoP&T)to the Railway Board. Under the said O.M. a copy of earlier O.M. issued by the Director DoP&T No. 49014/212014-Estt.(C) dated 26ft February 2016 has been forwarded. On going through the contents of Para 1 of O.M. dated 26^ February 2016 issued to all Secretariesof MinistrieslDepartments,Federationnotices that the instructions are not applicableto the Departmentof Telecom & Postsand the Ministry of Railways In this connection, Federation desires to reiterate that since the issue has already been adjudicated at the level of the Apex Court in a number of casesand the SLPs filed by the Railways have been dismissed,the continuanceof the rule for counting 50olotemporary statuscasuallabour servicefor pensionarybenefitsis totally unjustified. The policy guidelinesof DoP&T are not in accordancewith thejudgement of the Hon'ble SupremeCourt and as such, a detailed reference mentioning the facts contained in the PNM item, should be again sent to the DoP&T for seekingclearancefor counting full service. NFIR, therefore, requests the Railway Board to approach DoP&T again on the points mentioned above and also the facts brought out in the PNM agenda item for issuing necessaryinstructions on the subject. Federationwould like to have a copy of the referencemade to the DoP&T to enableus to also pursue.
