NOTICE OF MOTION PLEASE TAKE NOTICE that Defendants Dires, LLC, Stenzel, and Miller (the “Dires Defendants”) and Defendants John Baxter will and hereby do move the Court for an award of their attorneys’ fees and costs pursuant to Fed. R. Civ. P. 54(d)(2)(A), Local Rule 54.3, and the Lanham Act. Defendants will fully brief and argue this motion according to the Court’s forthcoming briefing schedule to be set pursuant to Local Rule 54.3(b).

MOTION Defendants hereby move the Court for an award of their attorneys’ fees and costs incurred in connection with this action, pursuant to the Fed. R. Civ. P. 54(d)(2)(A), LR 54.3, and the Lanham Act in the following estimated amounts: 1. $4,583,800 in attorneys’ fees for Defendants Dires, LLC, Scott Stenzel, and Craig Miller; 2. $4,410,814.97 in attorneys’ fees for Defendant John Baxter; and 3.
