An Act to constitute a Reserve Bank of India. Whereas it is expedient to constitute a Reserve Bank for India to regulate the issue of Bank notes and the keeping of reserves with a view to securing monetary stability in India and generally to operate the currency any credit system of the country to its advantage

06.03.1934:

That the respondent no.1 shall have the sole right to issue bank notes in India, and may, for a period which shall be fixed by the Central Government on the recommendation of the Central Board, issue currency notes of the Government of India supplied to it by the Central Government, and the provisions of this Act applicable to bank notes shall, unless a contrary intention appears, apply to all currency notes of the Government of India issued either by the Central Government or by the Bank in like manner as if such currency notes were bank notes, and references in this Act to bank notes shall be

That the respondent no.1 had the sole right over the design, form and material of bank notes shall be such as may be approved by the Central Government after consideration of the recommendations made by Central Board, under section 25 of The Reserve Bank of India

5. That the petitioner no.1 is the fledging advocate and practicing different jurisdictions Uttarakhand and Delhi since 2015 (REG.NO UK.356/2015) and permanent resident of Kotdwara district pauri Garhwal(Uttarakhand). That the petitioner no.2 is the fledging Company Secretary

working in Delhi since

2015(Membership Number A47647) and permanent resident of 2093A,163 Ganesh Pura-B, Tri Nagar, Delhi-110035.That the petitioner no.3 is the fledging advocate and practicing different jurisdictions Delhi since 2015 (REG.NO D/3974/2015) and permanent resident of House no-20-F, K- Block, Saket, New Delhi-110017. That the petitioner no.4 is the fledging advocate and practicing different jurisdictions Uttarakhand since 2015 (REG.NO UK.375/2015) and permanent resident of Kotdwara district pauri Garhwal(Uttarakhand). The petitioners have means to pay if any cost is imposed by the Hon’ble Court.

7. That as per knowledge of the petitioners present cause of action never came before the Hon’ble High Court prior the present PIL writ petition. This is first Public Interest Litigation before this Hon’ble Court.

THE CASE IN BRIEF 8. That the Reserve Bank of India act,1934 was passed in 1934 thereafter respondent no.1

came into force, An Act to

constitute a Reserve Bank of India. Whereas it is expedient to constitute a Reserve Bank for India to regulate the issue of Bank notes and the keeping of reserves with a view to securing monetary stability in India and generally to operate the currency any credit system of the country to its advantage. According to Section 26 of the Reserve bank of India Act, 1934. Banknote shall be legal tender at any place in India in payment, or on account for the amount expressed therein, and shall be guaranteed by the Central Government.

9. That the respondent no.1 shall have the sole right to issue banknotes in India, and may, for a period which shall be fixed

That the respondent no.1 have duty to design, form and material of bank notes shall be such as may be approved by the

Central

Government

after

consideration

of

the

recommendations made by Central Board, under section 25 of The Reserve Bank of India Act,1934.

According to the RBI, A special feature in intaglio has been introduced on the left of the watermark window on all notes except Rs. 10/- note. This feature is in different shapes for various denominational (Rs. 20- Vertical Rectangle, Rs 50-

WWW.LIVELAW.IN Square as used in earlier notes, Rs. 100 Triangle, Circle, Rs. 1000- Diamond(not in enforce)) and helps the visually impaired to identify the denomination and the copies of the same is annexed as ANNEXURE P-1

That the respondent no.1 Recently exercise his power to issue banknote on dated August/18/2017 by issuing press release “RBI Introduces rupee 50 banknote In Mahatma Gandhi(New) Series”, by this Respondent no.1 aware the country about the new banknote of rupee 50 and image of note and salient features of banknote, there are total 14 salient features i.e. 9 salient features

for obverse(front side) of bank note and 5

features for back side of note and the copies of the same is annexed as ANNEXURE P-2(colly).

That the respondent no.1 by press release for banknote rupee 50 don’t have visually impaired feature like other banknotes i.e 2,000,500,200 & 100. As per the respondent no.1 , old banknote of Rs 50 has bearing the identifcation mark in left side of the banknote i.e a square with intaglio print which can be felf by touch, helps the visually impaired to identify the denomination whereas in new note there is no identification marks for visually impaired persons and the copies of the same is annexed as ANNEXURE P-3. It is very difficult for visually impaired person to identify the New Note. This act of respondents violated the constitutional right of visually impaired persons, which is confirmed by article 14 of The Constitution India i.e. “The state shall not deny to any person

That the respondent no.1 issued notification 2008

dated June 4,

regarding Banking facilities to the visually challenged

persons for facing problen in availing banking facilites. RBI direct the other banks to provide the facilites for visually challenged person but this time respondent no.1 violated the fundamental rights of Visually impaired persons and the copies of the same is annexed as ANNEXURE P-4 15. That the respondent no.1 dated August/18/2017 by issuing press release is liable to be set aside, revised, reviewed and recalled on following amongst other GROUNDS: A. BECAUSE the Respondent no.1 while exercising their power under section 22 & 25 of The Reserve Bank Of India regarding rupee 50 note violated article 14 of The Constitution Of India which categorically

states that, “The state shall not deny to

any person equality before the law or the equal protection of the laws within the territory of India”

B. BECAUSE the Respondent no.2 while exercising their power under section 22 & 25 of The Reserve Bank Of India regarding rupee 50 note violated article 14 of The Constitution Of India which categorically

states that, “The state shall not deny to

any person equality before the law or the equal protection of the laws within the territory of India”.

C. BECAUSE

the press release dated August 18, 2017 by

Reserve Bank of India regarding rupee 50 banknote have violated article 14 of The Constitution Of India.

PRAYER: It is, therefore, most respectfully prayed that in the interest of justice this Hon’ble Court may graciously be pleased to: (a) Direct the respondent no. 1 for issue the new Rupee 50/- with identification mark for visually impaired persons. (b) Direct the respondent no.2 for approve the new Rupee 50/which bearing the identification mark for visually impaired persons. (c) Direct respondents to withdrawn 50/- rupree note currency without identification mark for visually impaired persons & also stop the printing of such currency banknote which is without identification mark for visually impaired persons. (d) Grant any other and/ or further relief(s) which this Hon’ble court may deem fit and proper in the facts and circumstances of the present case. Filed by
