CONTRACT AND AGREEMENT
THIS AGREEMENT, made this 2]th day of December. 2017 between, CYNTHIA GRACE C. TIU, OIC - District Engineer, Department of Public Works and Highways, Davao Oriental 2nd District Engineering Office, Mati, Davao Oriental (hereinafter called the "Entity") and ALEX H. ABELlDO, Proprietor, Legacy Construction Corporation, with business address at No. 604 Mancup Road Calasiao, Pangasinan ,(hereinafter called the "CONTRACTOR"). WHEREAS, the ENTITY is desirous that the CONTRACTOR execute the works under the onstruction of 2 Storey Workshop Building, Libudon National High School Idg. 1) City of Mati, Davao Oriental and the Entity has accepted the Bid for the execution and completion of such works calculated in the unit prices shown in the attached Nine Million Five Hundred Seventy Seven Bill of Quantities, a total Bid price of Thousand Four Hundred Twenty Five Pesos (P 9,577,425.00) to be completed within One Hundred Twenty(120) calendar days.
• NOW THIS CONTRACT AGREEMENT WITNESSETH AS FOLLOWS: 1. In this CONTRACT AGREEMENT, words and expressions shall have the same meanings as are respectively assigned to them in the Conditions of Contract hereinafter referred to. 2. The following documents shall be attached, deemed to form, and be read and construed as part of this CONTRACT AGREEMENT: a. In consideration of the payments to be made by the ENTITY to the CONTRACTOR as hereinafter mentioned, the CONTRACTOR hereby covenants with the ENTITY to execute and complete the Works and remedy any defects therein in conformity with the provisions of the CONTRACT AGREEMENT in all respects.

4. The ENTITY hereby covenants to pay the CONTRACTOR in consideration of the execution and completion of the Works, the unit prices in the CONTRACTOR'S calculated bid as applied to the actual quantities accomplished as certified by the PROCURING ENTITY under the provisions of the CONTRACT AGREEMENT at the times and in the manner prescribed by this CONTRACT AGREEMENT.
5 . The Contractor warrants that he has not given nor promised to give any money or
