DEPARTMENT ORDER NO. 12-05 June 10, 2005 WHEREAS, Book IV, Title II, Chapter 6, Section 42, of the Administrative Code mandates that the Insurance Commission be attached to this Department; WHEREAS, Book IV, Chapter 8, Section 39 of the said Code gives the Secretary supervision and control over bureaus, office and agencies under him; WHEREAS, Book IV, Chapter 9, Section 43 of the Administrative Code grants the Department of Finance administrative supervision over attached regulatory agencies; WHEREAS, the Office of the Secretary has received serious allegations of abuse, malfeasance, misfeasance and non-feasance on the part of certain Presidential appointees at the Insurance Commission; WHEREAS, there is an urgent need to verify, investigate and address these allegations for the public good and give the officials concerned an opportunity to be heard; WHEREAS, there is an urgent need to give the officials accused of any wrongdoing a forum to present their explanations or refutations of the charges leveled against them; NOW, THEREFORE, in view of the foregoing, a fact-finding committee (the "Committee") is hereby created to investigate all complaints, in whatever form, involving Presidential appointees in the Insurance Commission: 1. The Committee is mandated to: a. Receive and consolidate all complaint letters, in whatever form, alleging any act of abuse, malfeasance, misfeasance and non-feasance on the part of officials of the Insurance Commission appointed by the President; b.
Hear, interview and investigate complaints and the accused official/s, require the submission of comments as necessary and take and receive evidence to address any issue in relation to allegations brought forth before the Committee; and
c.
Report to the Office of the Secretary and to the Office of the President its findings and recommendations within seventy-five (75) days from the signing of this Order.
U 2. The Committee shall be composed of: Undersecretary Emmanuel P. Bonoan - Chairman Undersecretary Gabriel R. Singson - Member Assistant Secretary Jude B. Ocampo - Member 3. The Committee may designate an ad hoc secretariat and hearing officers, as necessary to accomplish the purposes of this Order. The ad hoc secretariat and hearing officers shall have such powers, functions and responsibilities as prescribed by the Committee, provided that all determinations arrived at by the ad hoc secretariat and hearing officers shall be merely recommendatory and subject to the final review of the Committee. 4. This Order shall take effect immediately. All concerned officials and employees shall be guided accordingly.
