not new. There is already a precedent on the Internet. In 2012, similar claims had already been made to Google. The images of the Tarot de Marseille rebuilt by Philippe Camoin and Alejandro Jodorowsky had been used without authorisation by Carlo Bozzelli on the website tarocchi.me. The violations were not accidental, because the author of the incriminated website, Carlo Bozzelli, has created the website of a Tarot school plagiarising the Camoin Tarot school, using copyrighted materials, and creating a trickery for the visitors and the students, leading them to believe they had arrived on a Tarot school selling courses authorised by Philippe Camoin, compounded by the fact that the images of Philippe Camoin Tarot were displayed everywhere on the website tarocchi.me. Claims had been made to Google and the pages of tarocchi.me had been sanctioned. This time, Carlo Bozzelli plagiarised slavishly the images of Philippe Camoin Tarot, pretending to have created them after a long work of restoration and research. The plagiarising cards are present on all the pages of the website tarocchi.net. It should be noted that the three-judge panel of the Court of Milan specialised in intellectual property has sanctioned Carlo Bozzelli in October 2013, holding him responsible of plagiarism and unfair competition, prohibiting him to reproduce the images of the Tarot Bozzelli, confirming it is a slavish imitation of the CamoinJodorowsky Tarot. However, the images of Bozzelli Tarot prohibited by the Court of Milan are still present everywhere on the website tarocchi.net. The comparison between the images of each of the major arcana respectively contained in these versions of Tarot reveals actually the re-use in the one of the defendant, as well as specific and marginal details that yet result as being specific to Camoin cards, precisely these symbolic elements that would result as having been inserted by the plaintiff in comparison to the common reference, formed by Conver Tarot. drawings depicted in the corresponding Camoin Tarot cards, thereby resulting confirmed that the defendant has used and re-used slavishly the specific form of representation (s. as confirmation of such evaluation the doc. 28 fasc plaintiff as well as the brief filed by the claimant party in the first stage of the procedure, regarding the documents 6, 14,15, 16 from Bozzelli). Given that the use of such decks of cards appears included within the scope of an activity by the parties of preparation of study and completion of courses - with this integrating the specific relationship of competitiveness between the parties involved, characterised by the community of the public interested in such specific area of knowledge - the three-judges panel considers that the conduct of the defendant had integrated the conditions of unlawful competitiveness including the ones at N.3 of the article 2598 c.c., having unlawfully gained the advantage of the work completed by the complainant (together with his associate in the Conver Tarot restoration, Jodorowsky) in order to recover and define the physiognomy of the major arcana such as represented in in Camoin Tarot in order to reproduce it almost exactly without mentioning in any way the subjects who had actually carried out such reconstruction but in fact attributing the paternity to himself. To this follows therefore the acceptance of the complaint related to such specific profile, with consequent prohibitory injunction to the sale and marketing of Bozzelli Tarot and with imposition of a penalty ex art. 614 bis c.p.c. and order of withdrawal from the market, measure to be understood for both Bozzelli and Dal Negro s.p.a. Order (extract page 14) a) prohibits to Carlo BOZZELLI and ANIMA s.r.l. the future edition also as a digital version of the volume called Il Codice dei Tarocchi in a version where results present the portions of text identified in detail in the document 43b of the requesting party, arranging that it is withdrawn from the market. b) prohibits to Carlo BOZZELLI and DAL NEGRO s.p.a. the future diffusion and marketing of the Bozzelli/Dal Negro Tarot cards, - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - ORIGINAL IN ITALIAN Motivazione (estratto pagina 9) 3 . Tuttavia ritiene il Collegio che parte reclamante abbia dato prova sufficiente del fatto che le carte dei Tarocchi Bozzelli siano derivazione diretta dei Tarocchi Camoin. Il raffronto tra le immagini di ciascuno degli arcani maggiori rispettivamente contenuti in tali versioni dei Tarocchi rivela in effetti la ripresa in quelle di parte resistente, oltre a specifici e marginali particolari del disegno che però risultano propri delle carte Camoin, proprio di quegli elementi simbolici che risulterebbero essere stati inseriti dal reclamante rispetto alla versione di comune riferimento, costituita dai Tarocchi Conver.
