PROPOSAL INSTRUCTIONS AND CONDITIONS The El Monte Union High School District (“District”) is calling for proposals from Electric Service Providers (“ESP”) to furnish the District with Electricity Districtwide from the Direct Access Market. The District’s participation in the Direct Access Market allows for the purchase of electricity from ESP’s as an alternative to the purchase of electricity through Southern California Edison’s bundled service. Through this RFP, the District intends to purchase electricity directly from ESP’s and at a lower rate. ESP firms that intend to submit proposals must be registered with the California Public Utilities Commission (“CPUC”) prior to submitting a proposal. CONTRACT TYPE / TERM: The contract type will be a fixed-rate per kilowatt hour. The period of performance will be based on the submitted proposal of the selected Contractor. However, if deemed necessary, the District may opt to increase the Contractor’s involvement in the awarded contract via an Amendment. Such Amendment, if any, to increase or decrease the dollar value and extend the period of performance shall be at the sole discretion of the District. CLOSING DATE is July 18, 2017, between the hours of 10:00a.m. to 12:00p.m. (PST). All RFP’s and contracts entered into hereunder shall be subject to the General and/or Special Conditions attached to this form. Envelopes containing proposals shall bear the superscription, “Proposal for Electric Service Provider to Provide Electricity on the Direct Access Market” and “July 18, 2017, between the hours of 10:00a.m. to 12:00p.m. (PST), RFP #2017-2018(P4)” Any proposals received before or after the scheduled window of time for receipt of proposals shall not be accepted. ”.

This RFP shall not be construed to create an obligation on the part of the District to enter into a contract with any firm or individual. This request is an information solicitation of proposals only. The District reserves the right to reject any or all proposals or to waive any irregularities or informalities in any proposal during the evaluation process without obligation to any firm responding to this announcement. Statements and other materials submitted will not be returned. No Respondent may withdraw his or her proposal for a period of one hundred twenty (120) days after the date and time set for the proposal opening. All proposals must be made upon this proposal form to be considered to be held valid. All blanks must be filled in, the proposal must be properly signed, and there must be no alterations or erasures, and no alternatives unless called for. Each proposal must be submitted with a fully executed NonCollusion Affidavit signed before a notary public.

5. Pricing must be provided for a twelve (12) month period and bills must have a starting date in September, 2017. 6. CONTRACT EXTENSION (if applicable): The District anticipates awarding an initial contract term of twelve (12) months with the option to extend the agreement on a monthto-month basis should it be deemed necessary and not to exceed six (6) months. The contract will begin with the SCE bills that begin in September of 2017. Extensions are contingent upon written mutual consent of the District and the Contractor. Any request for extension must be requested by the Contractor in writing no later than ninety (90) days prior to the expiration date of the existing agreement.
