Policy Statements

Nondiscrimination Statement The Minot Public School District is committed to a policy of nondiscrimination in relation to race, color, creed, age, religion, national origin, sex, marital status, status with regard to public assistance, and/or disability. This policy will prevail in all matters concerning staff, students, educational programs and services, and persons with whom the district does business. Inquiries concerning Title VI of the Civil Rights Act of 1964 and Section 504/ADA of the Rehabilitation Act of 1973 may be referred to the school principal or the school districts assistant superintendent: 215 2nd St. SE, Minot, ND 58701; Phone 857-4456. Inquiries concerning Title IX of the Educational Amendments of 1972 should be referred to the school principal or the school districts Title IX coordinator. The procedure is printed in the back of this handbook.

Sexual Harassment Statement Sexual harassment is a form of sex discrimination prohibited by the Minot Public Schools. It is the policy of school district to maintain a learning and working environment that is free from sexual harassment. Any person who believes he or she has been the victim of sexual harassment by a student or an employee of the School District should report the alleged acts immediately either verbally or in written form to the school principal or Title IX Coordinator. The Minot Public School Sexual Harassment Procedure and reporting form can be found at http://www.minot.k12.nd.us in the Student or Parent sections.

Access to Student Records Under the Family Educational Rights and Privacy Act (20 USC 1232g), parents or 18year old students have the right to review and inspect all school records pertaining to the student. A summary is printed on page 14 of this handbook.

Abuse and Neglect Professionals having knowledge of or reasonable cause to suspect that a child is abused or neglected, or has died as a result of abuse or neglect, must make a report of the circumstances. Those professionals required to report are any: school teacher, administrator, or school counselor.

Technology, Computer and Network Facilities The Board of Education is committed to the goal of having technology, computers and network facilities used in a responsible, efficient, ethical, educational and legal manner in accordance with the mission of the Minot Public School District. Acceptable uses of the network are activities which support teaching and learning. Network users are encouraged to use technology, computers and the Internet for purposes which meet their individual educational needs and take advantage of the computer and network functions. Acceptable uses of technology, computers and the network include, but are not limited to: • Minot Public School and Minot Public Library online catalogs; • NWEA MAP testing; • Network file storage; • Word processing and other software; • Electronic mail; • Accessing databases such as Grolier’s Online and ODIN (Online Dakota Information Network); • Accessing Internet resources such as web sites and United Streaming. Unacceptable uses of computers and the network include, but are not limited to: • Accessing Internet resources or visiting web sites deemed inappropriate by the staff and administrators of this District; • Violating the privacy rights of students and employees of this District; • Gaining unauthorized access to computer systems or files; • Copying print, software, music or video for use in violation of copyright law; • Inappropriate content in e-mail, other documents or online postings; • Using profanity, obscenity, or other language which may be offensive to another user; • Using the network for financial gain or for intentionally spreading computer viruses; • Downloading, storing, or printing graphics, videos, files or messages that are profane, obscene, or that use language that offends or tends to degrade others; • Taking and/or publishing digital images that are inappropriate, embarrassing or harassing to other students or MPS employees; • Intentionally bypassing the state-wide and/or district-based Internet filters.

Accidents In the case of a serious injury on the school premises, first aid will be rendered and medical assistance will be secured. The school district provides no medical insurance benefits for school-related injuries. Damage to or loss of glasses or any other personal property is not covered under any school-provided insurance plan,

Activities Activity opportunities for students are provided by various organizations, such as Minot Recreation Commission, YMCA, and booster clubs. Adult volunteers are recruited to supervise and coach athletic activities.

Admission and Registration Registration begins in February for all children who will be entering kindergarten the following fall. State law requires that a child be five years of age before August 1 of the year entering kindergarten, or six before August 1 when enrolling in grade one. For students whose birthdays fall between September 1 and January 1, there is a process by which parents may request early entrance into kindergarten •(age 5) or first grade (age 6). To qualify, a student must exhibit special talents and be ready mentally, socially, academically, and physically. The process includes a parent interview and one or two phases of standardized testing. Approval criteria are high. Requirements for registration are: • official birth certificate: • immunization record according to state guidelines: and • completed registration card. The registration card is part of the child’s permanent record. Any time there is any change of address, telephone numbers, doctor, or emergency contact, the school office should be notified. Families who reside in the Minot Public School District may request attendance in a school other than the one in the attendance area in which they reside. They may complete a form in the office of their home school. Approval may be subject to a number of factors including class sizes. Proof of identity and residence are required for enrollment in our schools (see page 16 of this handbook).

Animals Minot Public Schools has a specific policy regarding animals in the classroom. The only animals allowed in a classroom must be for a specific and appropriate educational purpose and shall be allowed for the amount of time necessary to achieve the educational goal. The principal shall approve any animals to be housed in the classroom.

Arrival and Dismissal Students are expected to arrive no earlier than five minutes before school starts unless they are participating in the before school or breakfast program. Students arriving too early or staying after school is dismissed often encounter a variety of problems. The schedule is: 1. Students enter building under normal weather conditions five minutes before school starts. 2. Inclement weather will determine admittance to the building at other times. 3. Students are expected to leave the school grounds immediately following dismissal from school or any after school program. 4. Supervision is not provided before or after school unless the student is enrolled in special activities. Attendance and Tardies Please call the school as soon as possible when you know your child will be absent. If the school doesn’t hear from you in the morning, a phone call will be made to ensure that your child is safe. Your call will save time and help protect your child. Children who are ill should not be sent to school. Regular attendance and being on time are two habits that help your child be successful in school. Absences and tardiness are upsetting for children, and disrupt their schedules. Regular school attendance is essential for success in school. Families are asked to avoid taking vacations that will cause students to be absent from school. North Dakota Century Code Chapter 15.1-20-01, “Compulsory attendance” directs, that the caregiver(s) for a child “between the ages of seven and sixteen years shall ensure that the child is in attendance at a public school for the duration of each school year”. This law also says that if a person enrolls a child of age six in a public school, the caregiver shall ensure that the child attends the public school for the duration of the school year. The Stay in School Project is a collaborative effort of community agencies, who have come together in recognition of the value of regular school attendance. The Stay in School Project will provide families with support, information, and intervention to reduce excessive school absences/tardies. The school tracks each student’s daily attendance. After excessive tardies or seven (7) missed days of school (not including medically excused or school related absences), a student will become part of the Stay in School Project.

Band and Orchestra Instrumental music is offered for students in grades four (string instruments only), five and six. Small group lessons are given during the school day. Group rehearsals are scheduled outside of school hours.

! Instruments and necessary lesson materials are provided by the parents with staff assistance if desired. Parent cooperation in encouraging and monitoring home practice is essential.

Bicycles

Bicycle owners are expected to use designated parking areas on the school grounds. Bikes are to remain parked from arrival until dismissal. Bike locks and helmets are recommended. Children are not allowed to use skateboards or roller blades on school grounds.

Character Counts!

The Minot Public Schools is a member of the city-wide Character Counts! Coalition. The program provides instruction and activities to promote six pillars of character development: Respect, Fairness, Citizenship, Caring, Trustworthiness, and Responsibility.

Child Custody In most cases when parents are divorced, both parents continue to have equal rights where their children are concerned. If you have a court order that limits the rights of one parent in matters such as custody or visitation, a copy must be on file in the school office. Unless your court order is on file with the school, we must provide equal rights to both parents.

Children Home Alone Ward County Social Services provides the following general guidelines for home supervision of students: • At age 9, children may be left home alone for short periods of time. They may not supervise other children. • At age 12, children may supervise other children.

Closing of School (Emergencies) School cancellations due to bad weather or other emergencies will be announced on local radio and television stations. Families will also receive a call from the

automated phone service - AlertNow. This system sends a voice message informing parents of any closure or time changes. If by chance you miss the message, you can refer to the web site at: www.minot.k12.nd.us or http://www.alertnowmessage.com If serious storm conditions develop during the day when children are already in school, the principals will follow the general policy of not allowing students to leave the building unless called for by an adult. Elementary schools will not normally dismiss school early because many parents are not at home and are not expecting their children until the regular dismissal time. Parents may elect to keep their children home if they determine the weather is too severe to send their child to school. Children will be counted absent if school is in session.

Counseling and Guidance The purpose of a school counseling program is to assist all students in understanding themselves and adapting to their ever-changing world. In order to serve all students, the program emphasis is development and prevention rather than remedial and crisis oriented. Elementary counselors provide classroom presentations and individual or small group counseling.

Curriculum Modifications To assist students with learning needs the assigned curriculum may be modified. For regular education students, modifications in curriculum will be made by the teacher who is teaching the course. Curriculum modifications for students with disabilities are identified in the IEP or 504 plan as developed by the current team(s) involved in each individual case. An asterisk (*) is used on the report card and transcript to indicate that a modified curriculum has been used.

Discipline/Responsible Behavior The Minot Public School staff believes all students have the ability to learn and grow in a safe and secure environment. All staff, students and parents will treat each other with respect, and staff will refuse to tolerate bullying in any form. Students are expected to be responsible for their work and respectful to teachers and others in authority. Staff is expected to hold all pupils accountable for their conduct at school and on the playgrounds during recess. The goal for all students, parents and staff is to have respect for self, others, and property. All staff members have disciplinary authority when students are on the school premises. In order to support this environment, Minot Public Schools encourage students to follow the Character Counts pillars: Respect, Responsibility, Trustworthiness , Citizenship, Caring, Fairness.

Dress Students are expected to maintain an appearance that does not detract from the educational program. Student dress should be modest, age-appropriate, and appropriate for the weather. Clothing that displays offensive or questionable graphics or lettering or that illustrates illegal drugs, alcohol, or tobacco products has proven to be disruptive to the school environment and is not acceptable. Students are not allowed to wear head attire inside the school building. Hats and other head attire are to be stored during the school day. The principal may make an exception to these guidelines for medical or religious situations or for school spirit or curriculum activities. When there is a question about the appropriateness of a student’s dress and appearance, parents may be contacted. The principal will make the final decision regarding dress code issues.

Drug Free Workplace Act of 1988 All school district workplaces must be totally free of the illegal use of drugs. Smoking and the use of tobacco products is prohibited on school district property. This includes all school district buildings, grounds, and vehicles. The unlawful manufacture,

! distribution, dispensing, possession or use of a controlled substance is prohibited in the Minot Public School District.

Drug Free Zone School sites and the area within 1,000 feet of the school are designated as drug-free zones through federal legislation. This specifies more severe legal consequences for drug-related legal infractions within the area.

Electronic Device Use

Students may bring electronic devices to school. These devices may not be activated or used during the school day, or CLC, except in case of an emergency or with permission from the teacher. Any abuse of this policy may result in the confiscation of the device. Any device found active during any class assessment activity may be treated as cheating and will be dealt with as such by the teacher. Please note that if the student finds it necessary to bring these devices to the building, they should not be carried in their possession during the day. It is the student’s responsibility to find a secure location to store them during the day. Students should understand that they bring an electronic device to school at their own risk. Minot Public Schools assumes no liability for the loss, theft, or damage of any personally owned electronic device at school. In addition, devices that allow for the recording or transmission of images or audio may not be used for any inappropriate use at any time. These instances may be referred to local law enforcement for possible legal action.

Field Trips Field trips are planned to provide additional educational experiences for children. Generally speaking, field trips are an extension of a classroom experience and have educational value relevant to topics being studied in class. Written permission is necessary for your child to go on a field trip and, if it is not received, your child will remain at school. You will receive advance notice of upcoming field trips and teachers may ask parents to assist in supervision.

Grading

Report cards are prepared for every child each nine weeks. Parent-teacher conferences are scheduled twice during the school year.

Head Lice Any child found to have nits or head lice will be sent home from school for proper treatment. After the treatment, if found to be nit-free, the child may return to school. If nits are found, the child will not be readmitted to class until they are nit free.

Homework Homework is studying for tests, reading practice or practice on skills. Homework is not completion of classroom assignments, graded to impact the report card or a skill the student has not mastered.

Parents can help by: • providing a suitable place for study; • establishing a regular time to study; • giving encouragement and showing interest • assisting when asked; and by • understanding the teacher’s and school’s goals and objectives. Homework should take approximately: Grades k-3 .........................20 minutes per day Grades 4-5 .........................30 minutes per day Grade 6 ............................. 45 minutes per day Students who have make-up work due to absence should be given two days for each day of absence to complete the incomplete assignments.

Library The Minot Public Schools have libraries accessible to all students. Each classroom has a regularly scheduled weekly library class. Time permitting, teachers may also schedule special library classes for individual or small group work. Children are encouraged to check out books. Parents are responsible to pay for books not returned or damaged.

Lunch/Breakfast Program Students are encouraged to eat meals provided by the lunch program at school. For students who bring lunch from home, milk is available for a nominal cost. Menus are sent home monthly. Parents must inform the school if the child is going to leave the school campus for lunch. Free and reduced price meal applications are available in the school office. Forms are sent home with all students on the first day of school. If income status changes during the year, families are asked to reapply. Students who were approved the previous year remain approved for the first month of school while applications are being processed. Parents may access lunch account information at Nutrikids. www.mynutrikids.com NutriKids allows parents to make online prepayments, monitor account balances, and track student purchases in the cafeterias.

Medication Medication, including non-prescription drugs such as pain relievers, shall be administered through the office with written permission by parent or guardian. Medical consent forms are available through the school office. The school will dispense only medication provided by the parent or guardian. Medications must be in their original container. Children using asthma medication may carry inhalers with written permission from a medical doctor.

Parental Involvement When parents are involved in the education process, children do better in school. Parents and school personnel are effective partners when:

! • parents meet their basic obligations (ensuring children’s health and safety, feeding and clothing them, providing supervision and guidance, ensuring regular school attendance); • parents participate in activities and events at school (attend school events and volunteer time at the school); • and when parents engage in learning activities at home with their children.

Parent-Teacher Association The PTA is an organization for parents, teachers, and other community members. All parents are encouraged to join this organization each year.

Parties Three occasions for room parties are Halloween or Fall Festival, Christmas, and Valentines Day. Invitations to private parties may not be distributed during school hours.

Personal Belongings Students names should be on their personal belongings so found items may be identified. The school does not accept responsibility for lost or damaged personal items. Found items will be placed in a designated area of the building. Articles not claimed will be donated to local charities.

Recess All children have recess as a part of their lunch break and may get other recesses. Children should bring adequate clothes for weather conditions. Children will not go outside for recess when the temperature is -5º F or colder or the wind chill is -15º F or colder. It is school policy that if children are well enough to attend school, they will go out for recess unless a written excuse is provided by a doctor.

Retention No student shall be retained in a grade without consultation between parents and school staff. The school administrator has final authority in this matter.

Significant Disease Policy/Communicable Disease Regulations Teachers must report suspected cases; whenever any principal and/or teacher in any private, parochial or public school has reason to suspect any pupil is suffering from a contagious or infectious disease, he/she will exclude the child and report the occurrence to the First District Health Unit.

Sports and Extracurricular Activities Our community is proud of its excellent reputation for academics and athletics, and we encourage families to support our local athletes and scholars. To show your support and help our kids follow the expectations of being safe, respectful, and responsible, please keep your child seated with you at all times while attending sporting or other extracurricular events at all school-sponsored activities. Please accompany your child if he or she needs to use the restroom or visit the concession stand. Your cooperation in following these expectations keeps all children safe and allows fans of all ages to cheer on our teams in a positive, respectful environment.

Summer School Minot Public Schools offers a variety of programs for students during the summer. The registration for the programs usually takes place in late April through mid-May. Students who attend programs for remedial reading and math, or kindergarten skills improvement, must meet specific criteria to qualify for these programs. For detailed information, please check the summer school registration guide when it becomes available.

Telephone Calls Parents are expected to make prior arrangements about what children should do after school. Unless it is an emergency, children and teachers will not be called out of class for telephone calls. Messages will be taken in the office.

Textbooks Children may take textbooks home for completing unfinished daily work. Parents are responsible for the replacement costs of lost or damaged textbooks, workbooks, and library books.

Visitors All visitors entering the building are to check in at the office and receive a visitor pass. Children visiting from other school districts will not be allowed to attend school in

! Minot Public School classrooms. Having parents visit the classroom is an important part of the elementary school experience. The MPS staff values the concept of parents as partners in education, and understands that the student’s education extends beyond the school. Parents will have the option of signing up to assist as a room parent for special projects and parties, joining PTA and performing special school activities, helping with science fairs, and volunteering time to assist on field trips. It is up to the individual teacher to determine his/her classroom needs and to make any necessary arrangements for parent volunteer assistance. Parents wishing to visit the classroom to observe specific academic instruction need to visit with the building principal for approval. Parents must provide 24-hour notice and state the purpose of the visit (identify what you wish to accomplish by the visit). The decision is entirely up to the building principal based on the purpose of the request. This rule is for the protection of all students and the instructional program. Many children in the classroom setting receive special services (ELL, Special Education, Title, Speech, etc.) during the school day due to their individual academic needs, and this information is extremely confidential. Due to FERPA (Federal Law), request will be closely scrutinized to ensure the safety and confidentiality of our student population, along with their individual programming needs. This type of request is different than volunteering time to help with a classroom project, party or field trip. If you are granted permission to visit a classroom to watch specific academic instruction, you must follow these rules: • Sign in at the office to receive a visitor’s badge and be directed to the classroom. • Refrain from engaging the attention of teachers or students through conversation or other means. • Not record data that is considered confidential about how other children are learning or the services they are receiving based on IEP and other criteria. • Remain inconspicuous and non-disruptive to the instructional process. • Parent visitations are limited to only one class period during the school day.

Wednesday Night Activities Wednesday night is designated as church night. No clubs, dramatic groups, music groups, sports practice or events will be scheduled after 6:00 pm on Wednesday. This policy does not include homework or tests assigned by the classroom teacher.

The Family Educational Rights and Privacy Act The Family Educational Rights and Privacy Act (FERPA) affords parents and students over 18 years of age (eligible students) certain rights with respect to the student’s educational records. They are: The right to inspect and review the student’s education records within 45 days of the day the district receives a request for access. The right to request the amendment of the student’s education records that the parent or eligible student believes are inaccurate or misleading. The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent. The right to file a complaint with the U.S. Department of Education concerning alleged failures by the district to comply with the requirements of FERPA. The name and address of the office that administers FERPA is: Family Policy Compliance Office U.S. Department of Education 400 Maryland Avenue SW Washington, DC 20202-4605 This district discloses directory information from student records. Directory information may include the following: name; address; phone number; date of birth; place of birth; participation in officially recognized school activities; weight, height, past statistics, and year in school of members of athletic teams; dates of attendance; awards received; previous schools attended; and names of parents or guardians. The district may also publish an honor roll. Parent or legal guardians of a student or eligible students have the right to refuse to permit the designation of any or all of the above categories as directory information with respect to the student. This refusal should be in writing and be communicated to the school principal by September 15 of each year. A complete text of the FERPA regulations is available at each school site as well as at the district administration building.

! Grievance Procedure This procedure may be utilized for issues involving Section 504/ADA, Title VI, and Title IX. Any employee, student, or patron of the School District shall have the right to appeal the application of policies and/or administrative decisions affecting him/her. The individual shall be assured freedom from restraint, interference, coercion, discrimination or reprisal in presenting an appeal with respect to a personal grievance. A grievance under this policy is defined as a complaint lodged by a student or employee alleging violation of state and federal law prohibiting discrimination (includes race, color, creed, age, religion, national origin, sex, marital status, status with regard to public assistance, and/or disability). If a person has a grievance, he/she should present it in writing within a period of 90 days to: Level 1: The immediate supervisor, who should schedule an informal meeting for the purpose of discussing the alleged grievance. (In the case of a student, this would be the teacher, coach, or director responsible for the program or activity involved.) Since this is an informal step in the process, the grievant may choose to begin the grievance at level two. Level 2: If the grievant is not satisfied with the resolution made at Level 1, he/she may appeal in writing to the Building Principal. The appeal should be made within 5 working days of the Level 1 informal meeting. If the alleged grievance is properly appealed, the Building Principal shall set a time to meet within 10 working days after receipt of the appeal. Within 10 working days after the meeting, the Building Principal shall issue a decision in writing. Level 3: If the grievant is not satisfied with the resolution made at Level 2, he/she may appeal in writing to the Superintendent or his/her designee. The appeal should be made within 5 working days of receipt of the Level 2 written decision. If the alleged grievance is properly appealed, the Superintendent shall set a time to meet within 10 working days after receipt of the appeal. Within 10 working days after the meeting, the Superintendent shall issue a decision in writing. Level 4: If the grievant is not satisfied with the resolution at Level 3, he/she may appeal in writing to the Board of Education. The appeal should be made within 5 working days of receipt of Level 3 written decision. If the alleged grievance is properly appealed to the Board of Education, the Board of Education shall set a time to hear the grievance and render its decision in writing within 20 working days of the hearing date. At the option of the Board of Education, a committee or a hearing officer may be designated to hear the appeal and render a decision thereon. Failure to appeal a grievance from one step to another within the time periods provided shall be deemed a waiver of the grievance. Individuals shall have the right to present their own grievance or may designate a representative to appear with them at any level of the above procedure. Costs incurred for representation shall be the responsibility of the individual grievant. Other Stipulations: 1. The Title IX Coordinator will serve as the alternate for any district staff member where that staff member is the respondent in the discrimination proceeding. 2. This procedure assures confidentiality will be protected consistent with the district’s obligation to conduct an investigation. 3. This procedure provides the grievant with access to school records relevant to the subject of the grievance. 4. This procedure allows for the recording of any hearing at the request of either person and/or the taking of minutes of any hearing, interview, witness statement, or other information provided regarding the grievance. 5.
