FACILITIES CONSTRUCTION Background Facility construction may be required if the number and type of facilities owned by the district are determined by the district to be insufficient to meet educational and/or recreational goals set for the community. This procedure is applicable when the district assumes responsibility for construction of facilities. Procedures 1. Construction Costs, Estimates and Determinations 1.1
Before commencement of construction of facilities, the district shall endeavour to compile complete estimates of costs relating to the project. The district shall determine these costs by any manner deemed acceptable to the district in view of the project under consideration.
2. Appointment of Prime Consultant for Building Services 2.1 2.2
The chief superintendent, will approve the commission of a prime consultant for building services for each approved construction project. The standard form of agreement between the Board and prime consultant will include the following conditions: 2.2.1

Notwithstanding anything herein to the contrary contained, the prime consultant hereby represents and warrants to the Board that by competent, economical design of structure and building services including a careful selection of all equipment and materials, the prime consultant shall endeavour to contain the total cost of construction or the project (inclusive of the fee paid the prime consultant hereunder) to an amount which will be contributed towards such cost by the Government of the Province of Alberta in accordance with the applicable regulations established pursuant to the provisions of the School Buildings Act (or any similar legislation hereinafter enacted in lieu thereof.)
In the event it shall appear from the final cost estimate prepared by the prime consultant and submitted to the Board at least two weeks prior to calling of tenders that such total cost of construction will be exceeded, and following assurances to the satisfaction of the Board that the design was in accordance with clause 2.2.1 above, the prime consultant upon acceptance of the prime consultant’s final cost estimate by the Board shall proceed with the calling of tenders on behalf of the Board.
3. Construction Contracts

The Board will advertise publicly for tenders for school building construction. Tenders submitted for construction of school buildings will be opened by a representative of the district administration in the presence of contractors, and recommendation will subsequently be approved by the chief superintendent. Construction contracts entered into in accordance with the School Act provisions will set out the following requirements: 3.2.1 3.2.2 3.2.3

A performance bond for 50 percent of the contract price.
A labour and materials payment bond for 50 percent of the contract price at the district's discretion. Evidence of compliance with the requirements of the provincial Workers Compensation Act and Proof or Certificate of Recognition with Provincial Safety Program.
Evidence (certified copy) of maintenance by the contractor of comprehensive liability, elevators (if applicable), contractor's contingency liability, and automobile liability insurance (owned and unowned or hired units); such insurance to be maintained until final completion of the work, including making good of faulty work or materials, coverage of completed operations liability, which will be maintained for a 12-month period following the date of substantial completion as certified by the prime consultant. A certified true copy of fire insurance with standard extended coverage endorsement in the joint names of the owner and contractor to a total of the total value of work done and materials delivered to the site, payable to the district and the contractor as their respective interests may appear. 3.2.5.1
In the event of occupancy of the building prior to completion, any increase in insurance cost will be at the owner’s expense. All such insurance will be maintained until a date 10 days after issue by the prime consultant of a certificate of completion.
4. Supervision of Construction 4.1 4.2
The district may assign employees or contract professional services to supervise the construction of any district-owned facilities. Buildings undergoing major changes where contractors are on the job will have no changes made in the plans or any additions made to old rooms except on the approval of the Director, Facilities.
5. Inspection and Acceptance of New Facilities 5.1 5.2
The district shall provide for an inspection, by competent employees or contracted professional staff, of any new facility prior to acceptance of the facility. Acceptance by the district will be conditional on a written inspection report being developed for the facility.
6. Public Dedication of New Facilities

6.1
The district recognizes and encourages the interest of the public in district facility development. The district, therefore, encourages public dedication of new facilities to inform and acquaint the public with district activities and facilities.
7. Memorials 7.1
No individual or group of individuals shall be permitted to erect any memorial or other structure of any kind in a school building or upon school grounds except by special permission of the Board.
