Most Urgent To, Sri Bijay Kumar, IAS Executive Director (Vig) Food Corporation of India Head Quarter, 16-20 Barakhamba Lane, New Delhi-110001 Sub: The approval of Experience Criteria for the post of AGM (QC) by BOD, FCI-Reg Sir, I have made several representations for justice owing to injustice made to me by the FCI selection board for the post of AGM (QC) advertised in the month of January 2011. Apart from my representations, I have also requested for various information under RTI Act 2005. Few of them have been replied but most of them are still awaited despite making appeal to the appellate authorities. Also few of them which have been replied are either incomplete or vague and not satisfactory. Further, it is bring in your kind attention that in one of the RTI reply, FCI Hqrs, New Delhi had communicated [refer FCI HQrs letter no. EP. 49(1)/2012 dated 16.07.2012] that “The experience as JRF/SRF during higher studies will be reckoned as required experience” has been reckoned with the approval of the board of directors and not by amending the FCI (Staff) Regulations, 1971. The reference of Agenda item No. 96/2007[309th Urgent (Adj.)BD] was cited in the reply. This act in itself needs to be examined that whether there is any such provision to incorporate such thing without amendment through notification in FCI (Staff) Regulations, 1971. However, no authentic document was provided in support of this claim in RTI reply. However a copy of minutes of the 309th (Urgent)-Adj. meeting held on 28.12.2007 in respect of item no. 96/2007 was provided wherein no evidence of approval was there. In the reference, it was cited that while the Board agreed in general with the proposal as revised by committee, following observations were made:(i) (ii) (iii) For the post of AGM (QC), the experience acquired as junior/senior fellows while pursuing higher studies should be reckoned as the requisite experience. So definitely it was not the approval by BOD from any corner. More over in the reference no Junior/Senior Research Fellow term was used.
Hence to clarify the things, the detailed agenda notes placed before BOD in its 309th urgent (Adj.) meeting held on 28.12.2007 was sought. The copy of the same has been provided by FCI, Hqrs vide letter no. EP.49(1)/2012 dated 18.09.2012-
The approval of item No. 96 /(309th –BD)/Urgent dated 28.12.2007 was as follows-
From the above approval, it is clear that the recommendations of committee as contained in para 4 of agenda note was approved. Now examining the detailed agenda with recommendations of committee as under-
Here the committee has clearly written that the experience acquired as junior/senior research fellow while pursuing higher studies, as proposed, should not be reckoned for the post of AGM (QC). The BOD had approved should not be reckoned?

So, BOD: 96 /(309th –BD)/Urgent dated 28.12.2007 had probably had not approved the experience as JRF/SRF as requisite for the post of AGM (QC) as per documents provided by FCI Hqrs in response of RTI applications.
Was there any other BOD meeting where it was approved? The RTI reply says that it was 309th meeting but in above meeting it was not only “not approved” but it was “rejected”.
I was also an applicant in the exam for the post of AGM (QC) in 2008 also. If the above observations are true than I was also a sufferer in 2008 exam too as I am sure that I must be in merit as per written test but I was not called for interview for reasons not known to me. I was at par in experience criteria with my colleagues who were appointed and having equal experience in food grain preservation.
So I kindly request you to examine the same as the document provided by FCI Hqrs does not support the RTI reply.
