Seit 1966 die ersten Containerschiffe die Transatlantikroute befuhren und die Dauer eines Warentransports USA - Europa um vier Wochen verkürzten, hat sich eine Entwicklung vollzogen, die den multimodalen Transport von einer wirtschaftlichen und rechtlichen Randerscheinung zu einem Zweig der Verkehrswirtschaft von überragender und ständig zunehmender Bedeutung gemacht hat. Während operative Faktoren kausal für die Herausbildung von Transportketten mit mehreren Transportmitteln waren, führte der starke Wettbewerb in der Transportwirtschaft zu einer Änderung der vertraglichen Beziehungen. Früher wurden meist über Vermittlung eines Spediteurs separate Frachtverträge im sog segmentierten Verkehr abgeschlossen. Nunmehr ist - entsprechend dem Interesse der verladenden Wirtschaft - der Transportunternehmer seinem Kunden gegenüber für die Organisation und Abwicklung der gesamten Beförderung verantwortlich. Die haftungsrechtliche Problematik multimodaler Transportverträge hat mE zwei Ursachen: 1. Der multimodale Transport ist weder durch ein internationales Übereinkommen noch durch Normen der österreichischen Rechtsordnung geregelt. Die getrennte Entwicklung der Regelungen für die einzelnen Transportmittel führte zu einer großen Zersplitterung des Transportrechts.
