Heard learned counsel for the parties on the question of
admission. Issue notice to the Respondents. The learned AGP waives service of notice on behalf of the Respondents. 3.
According to the Petitioners the impugned order dated
18th May, 2017 (Exhibit “H”) has been passed on the pretext that the Petitioners' club/shop is situated on the State Highway and the distance of the club/shop from the Bund Road and the State Highway is less than 500 meters. According to the Petitioners the Bund road is not a State Highway and the State Highway is not at a distance of less than 500 meters from the Petitioners' club/shop. In the circumstances, according to them, prima facie the impugned order dated 18th May, 2017 is not sustainable. 4.
In view of the aforesaid, we grant adinterim relief in
terms of prayer clause (d) and (e) of the Petition. List the matter on 22nd June, 2017.
