INTERNATIONAL LAW PROBLEM The Socialist Republic of Taiku was established in 1959 and joined the UN the same year. It maintains diplomatic relations with well over 100 other States, including Australia. Around 90 per cent of the SRT’s population are members of the Taiku ethnic group. The remaining 10 per cent (about 300,00 people) are members of the Lorku ethnic group with a language, religion, history, and cultural tradition which distinguish them from the majority. When the SRT was established, it created the Lorku Autonomous Region (LAR) located in the far South of the SRT, The LAR enjoyed a large measure of internal self-government through its own Regional Assembly, and the SRT’s socialist economic policies did not apply in the LAR. Almost all the Lorku people lived in the LAR, where they comprised about 95 per cent of the population. In October 1999, during the 40th anniversary celebrations of the foundation of the SRT, the Chairman of the ruling Taiku People’s Party announced the government’s plan to abolish the LAR and ‘finally unify the socialist motherland’. Within days the Regional Assembly of the LAR met and, by a majority, declared the region’s independence as a new State to be known as Lorkunia. This declaration of independence expressly invoked ‘the Lorku people’s inherent right of self-determination’. The Regional Assembly also declared that the borders of Lorkunia were to be the same as the borders of the old LAR, and elected an interim President and cabinet. A pro-SRT faction walked out of the Regional Assembly and called upon SRT troops to ‘safeguard national unity’. Widespread fighting erupted in the LAR between pro-independence militias and pro-SRT militias supported by SRT troops. The Regional Assembly dispersed for the safety of its members, The LAR police force and civil service were divided in their support for the two factions. For almost three years bitter fighting raged across the LAR. During this time neither the SRT nor the pro-independence forces were able to assert effective control over most of the LAR’s territory. Nevertheless, the pro-independence forces never controlled less than about one-third of the LAR. It was not until August 2002 that, growing weary of the struggle, the SRT withdrew all its forces from the LAR thereby permitting the establishment of control over the LAR’s entire territory by the Regional Assembly and the pro-independence militias. By September 2002, over 20 States had recognised Lorkunia’s statehood. The Australian Froeign Minister, however, announced that Australia was still considering whether to recognise Lorkunia. At the same time, a building partly owned by the Australian government and partly owned by the UN was burned down by an angy group of pro-independence militias. The Lorkunian Foreign Minister publicly apologised for the incident, accepted liability on behalf of Lorkunia, and said that Lorkunia would pay full compensation to any State or organisation entitled to it provided they recognised Lorkunia’s statehood. In October 2002, the UN received an application for membership from Lorkunia. The Lorkunian Foreign Minister wrote to the Australian Foreign Minister asking that Australia recognise Lorkunia’s statehood and Lorkunia’s government. He also requested that Australia acknowledge that the Lorku people were legally entitled to their self-determination, and that Lorkunia was a State since the formal declaration of independence in October 1999. The SRT ambassador at the UN is opposing Lorkunia’s bid for UN membership on the basis that no such State exists and that the LAR is part of the SRT’s sovereign territory. Similarly, the SRT ambassador in Canbearra is insisting that any Australian recognition of Lorkunia’s statehood or government would constitute an unlawful interference in the SRT’s internal affairs.
