SECTION – D 11. Case study. Compulsory :

Mr. Frank is a freight forwarder and customs broker with DFM International Inc. His problem is related to shipment security, for which he sees no easy solution. DFM is the forwarder of a shipment of high-value computer parts headed to South America via Miami. The cartons are contained in a half-dozen shrinkwrapped pallets, and the shipper’s instructions are explicit: Don’t break down the pallets. As a result, DFM is able to perform only a cursory inspection of the outside. The shipment reaches Miami where an agent receives it, sees nothing wrong, and sends it on. But when the shipment gets to its destination, several of the cartons deep inside the pallets are empty. Mr. Frank starts to worry. The question is one of liability. Mr. Frank may well have, signed a liability release based on the shipper’s instructions not to disturb the contents of the pallet, but that doesn’t mean the consignee won’t try to include him in a lawsuit for damages. Mr. Frank says that shippers often are ignorant of the basics of international moves, including what must be done to protect their shipments. For some, the first impulse is to blame the middleman. a) What advice do you have for Mr. Frank, a relatively small forwarder that would protect him from lawsuits while helping him to ensure the security of shipments moving under his control ? b) When inspections are possible, how can he monitor the hundreds, if not thousands, of individual cartons that are generated by his global customers on a daily basis ? c) “If we had to do this for every single shipment,” he says, “we wouldn’t move anything.” What is your solution to it ? ______________
