Gurgave Industrial Consultancy (P) Ltd. is a prosperous concern in the field of electronic and communication sector. They have different outlets in different regions of the country for assembling, supply and distribution. They employed white and blue collar servants to run their business on regular and contractual basis.

The casual and

part time workers of the firm called for a strike as part of the demand to enforce the Supreme Court judgment on contract labourers. The recognized union of regular employees of the concern also called for a solidarity strike. As a result, the company remained closed for more than a week. All the functions of the units of the company came to a standstill as a result of this strike. Hence the company authorities declared a decision to terminate all Badali workers and contract labourers from the roll, as well as to sue for damages from the recognized trade unions in respect of losses incurred due to the strike. The State Labour Department intervened in the matter and directed the parties to convene a platform, under law, for mutual discussion and to resolve the issue at the earliest. Problem:II

Peter Sam is the adopted son of Anna Chandy, 96 year old widow, of Late Chandi Iype, a business icon in the sub urban area of the capital metro city. Anna Chandy is bed ridden due to continuous illness, whereas Peter Sam used to sell out properties of Anna Chandy. The few legal heirs, who questioned the acts of Peter Sam, sought the assistance of Believers Church for an amicable remedy. The claims of the legal heirs on the said property of the Late Chandy Iype and Mrs. Anna Chandy was challenged by Peter Sam and argued that he was the one and the only claimant of the assets. Believers church authorities instructed the parties to resolve the dispute through a mutually respectable and binding body or person.

Problem:III Bio-Tech Institutes and Allied Company carries out research and operational analysis in the field of Biotechnology research and studies. They have conducted scientific research in DNA transfer and other metabolism in HIV affected persons of different parts of the country. There was an MoU between Bio-Tech Institutes and Cipla International Pharma (P) Ltd., to manufacture, distribute and sell certain drugs in future. On the basis of Institute’s research analysis on DNA configuration and their changes, Cipla International Pharma (P) Ltd. evolved an appropriate medical product for HIV patients and applied for patent. But patent authorities denied to issue patent certification to the drug on the basis of pre-declarative objection filed by Bio-Tech Institutes. The subject matter has been sent for dispute determination process, as per the clause in the MoU.
