To all the Trading Members Sub : Amendments to Byelaws of the Exchange The provisions contained in the Byelaws of the Exchange are amended to the extent given hereunder:1. The existing Byelaw 17 of Chapter XI of Byelaws is substituted with the following new Byelaw 17:Quote Jurisdiction (17) The arbitration and appellate arbitration shall be conducted at the regional centre nearest to the address provided by Constituent in the KYC form or as per the change in address communicated thereafter by the Constituent to the trading member. The application under Section 34 of the Act, if any, against the decision of the Appellate Arbitral Award passed by the Appellate Arbitrator shall be filed in the competent court nearest to the address provided by Constituent in the KYC form or as per the change in address communicated thereafter by the Constituent to the trading member. Unquote 2. The existing clause (c) of Byelaw 19 of Chapter XI of Byelaws is substituted with the following clause:Quote (c) A party aggrieved by the Appellate Arbitral Award may file an application in accordance with Section 34 of the Act before the court of competent jurisdiction nearest to the address provided by Constituent in the KYC form or as per the change in address communicated thereafter by the Constituent to the trading member. Unquote The above amendments have come into force with effect from August 2, 2014, being the date of notification in the Gazette of India.
