The Complainant submits this complaint to the Court and states that there is probable cause to believe Defendant committed the following offense(s): COUNT I Charge: Solicit Child or Believe to be a Child Through Electronic Communication to Engage in Sexual Conduct Minnesota Statute: 609.352.2a(1) Maximum Sentence: 3 years and $5,000 Offense Level: Felony Offense Date (on or about): 09/23/2016 Control #(ICR#): 16037288 Charge Description: and with the intent to arouse the sexual desire of any person, use the Internet, a computer, computer program, computer network, computer system, an electronic communications system, or a telecommunications, wire, or radio communications system, or other electronic device capable of electronic data storage or transmission to solicit a child 15 years of age or younger or someone the defendant reasonably believed was a child 15 years of age or younger, namely "child 1", DOB "14 years old" to engage in sexual conduct, and the defendant was 18 years of age or older

STATEMENT OF PROBABLE CAUSE   The Complainant states that the following facts establish probable cause:  

Your complainant is a licensed peace officer in the State of Minnesota, and is employed by the Washington County Sheriff's Office. In that capacity and upon review of the reports and attachments, your complainant states the following to establish probable cause:  On 9-23-2016, Detectives with the Washington County Sheriff's Office participated in a detail in order to combat the issue of adult males soliciting minors to engage in sexual contact. On September 23, 2016, Det. Folendorff placed and add on the "Whisper' application (an application that allows anonymous advertisements to be placed and is often a source for adults seeking sexual contact from minors.). The ad stated "Not into school today wanna play instead?"  An anonymous person using the name "Pallyi_Awesome" responded. The individuals profile indicated he was a 30-35 year old male located 38 miles from Stillwater. Pallyi_Awesome initiated a conversation via the "whisper" application by asking, "How are you looking to play?" and if the undercover officer "child 1" would be "up for a random hookup?" "Child 1" stated that she was 14 years old. The response was, "that's not too young. In my opinion, age is just a number and pussy is just pussy." Pallyi_Awesome described himself as a 34 year old who wants to "get laid by a younger girl." He inquired as to where they could meet and "where we would fuck." The conversation between "child 1" and Pallyi_Awesome continued for three weeks. The discussion continued to be sexual in nature and Pallyi_Awsome repeatedly stated he knew she was 14 years old and wanted to have sex with her any way. He commented on how he could get in to a lot of trouble for having sex with a 14 year old since he was 34. He also at one time suggested she bring her 12 year old cousin along. The discussion eventually turned to communication via text as Pallyi_Awesome provided his cell phone number 651-...-2065. Throughout the three weeks of communication Pallyi_Awesome stated that he "had sex or done sexual things with quite a few underage pussies." He told "child 1" that he wanted to "touch her and her underage pussy and underage titties."  On October 27, 2016 Pallyi_Awesome and "child 1" made arrangements to meet at Lake Elmo Park Reserve in Washington County in order to have sex in his truck. Pallyi_Awesome told "child 1" that his real name is Joseph and he offered to pay her to take pictures and engage in sexual contact with her. He stated, "How about I give you $250 total and I do whatever I want and take whatever pictures I want?" "Child 1" asked what he meant and he responded, "Like I can lick wherever I want touch where ever I want and take pictures of whatever I want and fuck you."  "Child 1" and the suspect then made arrangements to meet at 8:00 am the following day at Lake Elmo Park. On October 28th, 2016, Officers set up surveillance in the park while "child 1" continued communicating with the suspect. The officers observed a male enter the park driving a black pick up truck. "Child 1" directed the suspect to drive to the boat launch and the driver of the black truck did just that. The truck then parked at the boat launch. Officers then approach the driver and identified him as JOSEPH THOR PERKINS, DOB: 9-25-1981, herein defendant. The defendant was found in possession of a cell phone, Adam and Eve lubricant, and a prostate massager similar to the massager he described in previous conversations with "child 1."

FINDING OF PROBABLE CAUSE From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody, pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
