I.

INTRODUCTION

The Regional Development Council of Bicol, hereinafter referred to as the RDC, is the highest policy-making body in the region and serves as the counterpart of the NEDA Board at the sub-national tevel. tt is the primary institution that coordinates and sets the direction of all economic

and social development efforts in the region. lt also serves as the forum

where local efforts can be related and integrated with national development activities.

The RDC was established to provide a regional body to oversee the overall socio-economic development of the region. lts primary task is to coordinate development planning and policy making in the region.

The RDC was organized in 1974 through Letter of lmptementation (LOt) No- 22 issued on December 31, 1972 pursuant to the implementation of

the Integrated

Reorganization Plan (lRP)

and to accelerate the economic and socral development of the units in the region.'

To make the RDC more effective in carrying out its

constitutional

mandate, it was reorganized through Executive order No. 309 issued on November 5, 1987. subsequent amendments include Eo Nos. 31g (s. 1988), 347 and 366 (S. 1989), 455 (S. 1991) and 505 (S. 1992). On April 12, 1996 the RDC was again reorganized with the issuance of Eo

325 further strengthen the RDCs to make it more responsive to new developments in socio-political fields and to ensure sustainable and broad-based development process. Recognizing labor as a primary social and economic force, Eo 384 was subsequenfly issued on 07 December 1996 thereby institutionalizing the labor sector representation

in the RDCs. The regular membership of the council was further expanded in 2002 to include the commission on Higher Education (OHED) and the Technical Education and skills Development Authority (TESDA), taking cognizance of their role as major stakeholders in the generation

of high-level and technical manpower at the regional

level

(EO 143).

As provided in Eo 325, the Regional Directors of members represented in the NEDA Board shall be regular members of the RDC. per Administrative Order (AO) 148 (S. 2006), the NEDA Board was reconstituted which excluded the membership of the Department of

Agrarian Reform (DAR), Department of the Interior and Local Government (DILG) and the Department of Health (DoH). These agencies were, however, reinstated through EO 562 (S. 2006)

considering the critical roles of these agencies in the pursuit of socioeconomic development across the regions.

On June 30, 2008, Administrative Order 231 was issued reorganized the cabinet groups including the NEDA Board.

(CICT) and Presidential Management Staff (PMS). The membership of DOLE and DFA were also reinstated through EO 755 (S. 2008).

The RDC under EO 325 (s. 1996) has become more responsive to the increased autonomy of the LGUs as provided for by the 1991 Local Government Gode (Republic Act No. 7160). ln particular, EO 325 was issued to enable the RDC to respond effectively to the increased needs of the LGUs for technical assistance in the areas of planning, investment

programming and project -development in the light of the LGUs' strengthened roles and greater responsibilities. The NEDA Regional Office 5 serves as the secretariat of the RDC.

The RDC's relevance is further highlighted through the major functions it is mandated to do such as coordination of the implementation programs in the regions that involves several local government units and agencies.

The technical assistance it provides to LGUs, upon request, extends to the preparation of localdevelopment plans and programs and fulfilling

requirements of LGU projects proposed to be funded under the official Development Assistance (ODA).

The RDC 5 manual of operations was updated in 2oo7 (RDC Resolution

No. 05-02) and in 2009 (RDc Resolution No. 26) considering new presidential directives and RDc 5 resolutions, instructions and agreements.

Perform such other functions as may be assigned by the RDC Full Council.

E.

Affiliate Committees

IV.

OFFICERS

A. Council Proper

Officers. The officers of the Council include the Chairman, the CoChairman, the Vice Chairman and the Secretary. The Chairman and the Co-Chairman jointly head the Council. The NEDA Regional Director

serves as the ex-officio Vice Chairman of the RDC while the NEDA Assistant Regional Director acts as the ex-officio Secretary of the RDC.

Ombudsman, Civil Service Commission (CSC), National Bureau of lnvestigation (NBl), and/or Sandiganbayan, as may be appropriate, shall be forwarded to the NEDA Director General, who shall endorse the same to the President.

Duties

V.

PRIVATE SECTOR REPRESENTATIVES

Legal Basis. Private sector representation in the Regional Development Councils has its legal basis in Executive Order No. 308 issued by President Corazon C. Aquino on November 5, 1987. lt reorganized and

the RDCs by increasing its membership to include representatives of the private sector and non-governmental

strengthened

organizations who shall constitute one-fourth of the members of the fully constituted Council.

The implementing Rules and Regulations was prescribed by the NEDA Board Executive Order No. 384 issued by President Fidel V. Ramos on December 7, 1996. The EO amended the PSR representation by the

Definition of Terms. Private Sector Representative (PSR) refers to a qualified person selected under these guidelines

Private Sector Organization (PSO) refers to an organization created or brmed by private persons for purposes of socio-economic development rendering service

or providing assistance to the public. This includes, among

others,

non-governmental organizations, business

organizations, people's organizations, industry associations,

religious organizations, cultural associations, professional

organizations,

civic clubs and

development-oriented

coooeratives.

Qualifications of PSR Nominees. All PSR nominees must be formally nominated by a qualified PSO duty accredited by the RDC and must

meet the following qualifications:

A.

Citizenship. A PSR nominee must be a Filipino citizen of legal age and not otherwise disqualified by law.

B.

Occupation. A PSR nominee must not hold any government position, whether appointive or elective, and must not receive any compensation for services as regular employee

of the

government while serving

as

private

sector

representative to the RDC.

c. Performance.

A

PSR nominee must have proven track

record in socio-economic development in the region. D.

Commitment. A PSR nominee must be willing and able to participate in all RDC activities.

Qualifications of Nominating PSO. A PSO must have the following qualifications to be able to participate in the nomination and selection of PSRs to the RDC:

Legal Personality. The PSO must be registered with the Securities and Exchange Commission (SEC) or any

government agency which registers organizations and

associations for the purpose of bestowing legal personality'

Track Record. The PSO must have conducted socioeconomic activities for at least three years from date of registration in the region concerned and the scope of its activities must be at least province-wide or citywide.

Procedure for PSR Selection.

A.

Accreditation. The RDC Secretariat shall prepare a list of accredited PSOs in the region. lt shall pre-qualify the PSOs which shall participate in the PSR selection at least one month prior to the actual selection of PSRs.

The RDC Secretariat shall evaluate the PSO according to the qualifications. PSOs which qualify for nominating PSRs shall be accredited.

Nominee and Voter. The RDC shall request qualified PSOs

to submit their nominees and the names of their

official

voters using the prescribed form. Any individual who is qualified in accordance with the qualifications set above may be nominated by a qualified PSO provided that the qualified PSO may nominate only one nominee. Provided further that a qualified PSO and its subsidiaries and affiliates shall be counted as one PSO only except in cases where such affiliates or subsidiaries have distinct and separate legal personalities.

C.

Voting and Proclamation of Geographic PSRs. The RDC Secretariat shall prepare the list of official nominees and convene the official voters representing the qualified pSOs in designated locations in each of the six provinces of the region. Two PSRs per province shall be elected through secret voting. The RDC Secretariat shall tally the votes and proclaim the winners. Private sector nominees who are not elected in the full council shall be considered as members of sectoral committees.

D. Labor and Basic Sector Representatives. The labor sector and the basic sector representatives shall be selected as follows:

Term of Office. All cpnfirmed PSRs shall serve for a period of three years without prejudice to reappointment through the same process of nomination and confirmation provided herein. The PSRs shall serve during the same period as that of local chief executives.

Termination. PSRs considered remiss in the performance of their duties or who commit acts inimical to the RDC may be dropped as members of the RDC on motion of a member and approval of majori$ of the members present during a Full Gouncil meeting. PSR members who incur three consecutive absences in RDC Full Council meetings in a year without valid reason/s shall be recommended for termination from the RDC.

PSRs who are elected or appointed to any government position during their term shall automatically lose his/her right to represent the private sector in the RDC.

I Vacancy. In case vacancy occurs among the psRs through resignation, recall, ineligibility due to appointmenuelection to public office, incapacity, permanent disability or death, the nominee with the next highest number

of votes during the PSR election shall

automatically qualify for the position. The qualified PSR nominee must confirm in writing his intention to join the RDC. The Full council shall confirm his membership in the RDC. In case the nominee with the next highest number of votes may no longer be interested to join the RDC or is otherwise be ineligible or incapacitated for succession due to permanent disability or death, the vacancy shall be fllled-in using the usual process of psR selection.

VII.

OPERATINGPOLICIES

A. RDC Meetings Schedule. The Council Proper shall meet as often as may be necessary

but not less than once every quarter. The Executive and Advisory Committees shall meet as often as necessary while the sectoral committees shall meet prior to the RDC Full Council meetings to review matters that need action by the Full Council.

The schedule of meetings will be set by the Full Council before the start of the year.

Presiding Officer. The Chairman shall preside over meetings of the Council. In case the Chairman cannot attend the meeting, he shall designate the Co-Chairman or the Vice-Chairman to preside.

Quorum. The presence in the RDC Proper/ExCom/AdCom of a simple majority of the regular members shall constitute a quorum. In the absence of a quorum, the Council members present may discuss the items in the agenda and make recommendations thereon to the Council for its next meeting.

Ex-officio members may send representatives to attend the meetings and they shall be counted in the determination of the quorum and shall have the right to vote. The representative must be authorized in writing by the regular member to attend and vote in his behalf. Otherwise, said

representative shall be considered an observer in the meeting and shall not be counted in the determination of the quorum.

Attendance. The report of attendance in RDC meetings of regional directors and local government executives shall be submitted to their respective heads of office and to the Secretary of DILG Central Office, respectively. RDC Resolutions. The following guidelines shall be observed:

All actions of the RDC shall be in the form of resolutions' The draft resolution shall be prepared by the proponent and shall be submifted to the RDC Secretariat for technical evaluation and referral to the appropriate committee for review and endorsement.

Only resolutions endorsed by the committees concerned shall be included in the agenda of the RDC Full Council for deliberation.

Secretariat may include, but not limited to, verification of

data, consultation with relevant agencies and resource persons, and preparation of briefs/ discussion papers for the guidance of the committee concerned and the RDC.

Meetings. The minutes of the meetings of the RDC, the

ExCom and the AdCom shall be certified by the RDC Secretary and attested by the Chairman. The RDC Secretary may issue certified copies of any RDC meeting records or parts thereof to any interested party upon

written request of the interested party and written authorization of the

The agenda of the meetings of the RDC and its committees together with

the background materials therein, the approved minutes of

these

meetings and the records of implementing actions taken shall constitute the official records of the Council.

Agenda Preparation. The RDC Secretariat is tasked with the preparation of the agenda and discussion materials for all RDC, ExCom,

AdCom and Sectoral Committee meetings. The following steps shall be followed in lining up agenda items for RDC consideration:

RDC Secretariat. The NEDA Regional office shall serve as the principal technical staff and secretariat of the Full Council, the Advisory Committee, the Executive Committee and the Sectoral Committees. In addition, the RDC and the ExCom may request the regional offices of the

various agencies of the national government to provide such technical support as may be required for the effective discharge of the functions of the RDC. The following are the basic functions of the secretariat:

shall be included in the annual general appropriations bill submitted to Congress. The NEDA Regional Director shall be responsible for the

technical, administrative and financial operations of the RDC and shall be accountable for the funds and properties of the RDC.

Aside from the annual GAA, the RDC budget shall be supplemented by

the RDC member's

contributions. The annual contribution shall be

subject to the concurrence of the Council.

The proponent shall present the proposal to the Sectoral Committee. The proponent shall prepare

a presentation

about the project and shall reproduce enough copies of handouts for inclusion in the meeting's reference folder.

The proponent shall be given a copy of the evaluation report prior to the scheduled RDC sectoral committee meeting to give time for the proponent to prepare and address issues

All coordination work with the proponent shall be undertaken

by the Project Development, Investment Programming and Budgeting Division (PDD)

of NEDA. It shatt inform

proponent of the action of the Sectoral Committee and shall advise to comply with the recommendation of the Sectoral Committee.

Upon endorsement of the project to the RDC by the Sectoral

Committee, the Secretariat shall include the project in the proposed agenda of the RDC Full Council meeting.
