This file relates to the proposal for appointment of Shri Chetan S. Kapadia, Advocate, as a Judge of the Bombay High Court. Supreme Court Collegium while considering the proposal for appointment of Shri Chetan S. Kapadia, vide Minutes dated 3rd October, 2017 deferred the proposal of his appointment in the following terms: “The Collegium on consideration of the material on record resolves that the Chief Justice of the Bombay High Court be requested to send details of the Intervention Application in Suit No.575/15 filed by Shri Kapadia. In view of the above, the proposal is returned for being resubmitted on receipt of the above-mentioned information from the Chief Justice of the Bombay High Court.” The Chief Justice of the Bombay High Court vide letter dated 30th October, 2017 (copy placed below) has furnished the requisite information. A copy of letter dated 25th October, 2017 of Shri Chetan S. Kapadia, forwarded by the Chief Justice, explaining the position in this regard has been placed before us. With a view to ascertain suitability of Shri Chetan S. Kapadia, Advocate, for elevation to the High Court, we have consulted our colleagues conversant with the affairs of the Bombay High Court. Copies of letters of opinion of our consultee-colleagues received in this regard are placed below. In order to assess merit and suitability of Shri Chetan S. Kapadia Advocate, for elevation to the High Court, we have carefully scrutinized the material on record. Apart from this, we invited Shri Chetan S. Kapadia with a view to have an interaction with him. On

the basis of the interaction we had with him and having regard to all relevant factors, the Collegium is of the considered view that Shri Chetan S. Kapadia, Advocate is suitable for being appointed as Judge of the Bombay High Court. In view of the above, the Collegium resolves to recommend that Shri Chetan S. Kapadia, Advocate, be appointed as Judge of the Bombay High Court.
