Railway Board's attentionis invited to Federation'sletterNo. IV/RSAC/Conf./PartVIII dated I ll09l20l7 wherein Federationhad suggesteda Road Map for arrestingSPAD to enable the Boardto considerthosesuggestions. The Railway Board vide letter dated 28thNovember, 2017 has since asked the Zonal Railwaysto convey views on the following terms of referenceof the Committeeof four EDs constituted in the caseof SPAD:"To review the norms of punishmentsawarded to Loco Pilots/AssistantLoco Pilots in the caseof Signalpassingat danger(SPAD)and submitclear recommendations"" ln this connection, Federation placesbelowcertainvital pointsfor appreciation:r

The Railway SafetyReview Committee(RSRC) in the year 1998 chairedby Hon'ble Justice HR Khanna had recommendedthat 'extreme'punishmentof removal from serviceor compulsoryretirementshould not be imposedupon the Loco Pilots who passedthe Signalat dangerandnot causedany accident'.

The High PowerCommittee(R&S) in its reportgiven to Board in August,2013had oareviewof recommended the existinginstructions of minimumpunishmentto stafffor SPAD casesto ensure that the decision takes into account the gravity of offence (repercussions of the SPAD) and the Loco Pilotspastrecordalso'. (Page88/89of the Report).

o The Task ForceCommitteeon Safety,2016 in Para24.6,1of its reportrecommended that "SPAD shouldbe classifiedaccordingto the distanceof overshooting. Casesof SPAD should be dealt differentlyupon whether LP, after committing SpAD,'has stoppedwithin the signaloverlapor crossedthe overlap.This shouldalso decidethe penaltyimposedon the erring crew". 2. SPAD is uniquein the mannerthat it is both mentalandphysicalat the sametime and defies.alllogic. It is an unusualeventso closeto an usualevent. 3. Crew passesmillions of signalsand also stopsat millions of 'Red Signals' Safety every day and day after day and year after year rather very routinely, uneventfully unnoticed. In the above context, NFIR gives following suggestionsfor considerationat Board's level: l.

Punishmentnormsto be revisedso that the Capitalpunishmentof Removalfrom servicemust not be administrateduponthe Loco Crew.

SPAD within the adequatedistance(Block Overlap/SignalOverlap),the distance providedto ensuresafety,shouldbe treatedas over-shootingof Signaland not as SPAD.

3.

SPAD must be classifiedaccordingto the distanceovershootand the gravity (consequence)and the penalty may commensuratewith the consequence, ofcourseafterholding impartialenquiry.

4.

For SPADs without consequences,counseling and retraining may be the correctivestepand harshpenaltiesmay not be desirableaction.

5.

SPAD enquiries must be conducted in a holistic manner and the present syndromeof "who went wrong "requiresa radicalchangeto "what went wrong" to find systemfailure alsofor correctiveactions.

6.

In the case of SPAD with contributoryfactors like brake failure, system deficiencyetc.,due weightageto be given to suchfactorsand otherextenuating circumstances in enquiries.

7.

Past record and performance of the Running Staff should be taken into consideration by the DisciplinaryAuthorityinsteadproceeding mechanically.

NFIR requeststhe Railway Boardto considerthe situationsexplainedand alsothe given by the Federation,for makingcoursecorrectionwhich hopefullywould suggestions go a long way in boostingthe morale and confidenceof Running Staff to improve the efficiencylevelsand help runningthe Railwayssafely. \
