You are invited to bid on a Music Specialties Contract for the NEW Warren County Middle School, for the Warren County School Board, 210 North Commerce Avenue Front Royal, VA. All prices must include freight. Products are to be delivered to the appropriate location via free freight and off truck placement in the building as designated by Mrs. Amy Gubler, principal. Mrs. Gubler’s contact phone number is 540-5222206.

Bids shall be received until 2:00 pm local prevailing time on April 25, 2017, in the Board Room of the Warren County Public School Administration Building, 210 N. Commerce Ave., Front Royal, VA 22630, at which time they will be opened publicly and read aloud. Bids received after this time will not be accepted. All interested parties are invited to attend. Bid documents and specification may be examined at the offices of Warren County Public Schools.

4. Copies of documents may be obtained in person at the offices of Warren County Public Schools or on the website at www.wcps.k12.va.us. No deposit required. 5. The Owner reserves the right to waive irregularities and to reject any or all bids.

6. Bids shall be binding for a period of sixty (60) days from the date on which bids are opened.

SUMMARY OF THE WORK WORK UNDER THIS CONTRACT: The work to be done hereunder includes the furnishing of all labor and new materials and performing all work for Music Specialties at Warren County Middle School (240 Luray Ave., Front Royal, VA) for the Warren County School Board as specified herein.

CONSTRUCTION SCHEDULE: Time is of the essence and the Owner requires the project to be totally complete by August 25, 2010.

DELIVERY, SETUP AND INSTALLATION: Delivery cannot be prior to August 9, 2010 or after August 20, 2010. All equipment and furniture herein specified shall be delivered inside, set up and installed in each designated area to all locations specified. Equipment and furniture requiring assembling shall be assembled as soon after delivery as possible. The successful bidder shall be responsible for protecting the buildings surfaces. All packaging from equipment and furniture shall be removed from the building and placed in the Owner’s dumpster on a daily basis.

Commerce Ave. Front Royal, VA 22630 (540)635-2171 To be considered, bids must be made in accordance with these instructions to Bidders: A. Documents 1. All bidders may obtain bid documents and specifications from the offices of Warren County Public Schools or from the Warren County Public Schools’ website at www.wcps.k12.va.us. B. Obligation of Bidder 1. By submitting a bid, the bidder covenants and agrees that they are satisfied from their own investigation of the conditions to be met, that they fully understand their obligation and that they will not make any claim for, or have right to cancellation or relief from the contract because of any misunderstanding or lack of information. C. Questions 1. Submit all questions and comments in writing to Mrs. Amy Gubler, principal, Warren County School Board, 210 N. Commerce Ave., Front Royal, VA 22630 by April 25, 2017. Replies will be issued as addenda to the bid documents and specifications and will become part of the contract. The owner will not be responsible for oral clarification. The Owner will email addenda to all parties, but will not be held responsible for addenda not received. D. Substitutions 1. Approvals and/or Submittals Prior to Bidding: The Bid Documents will not require samples, shop drawings, or similar materials to be submitted for approval prior to receipt of bids. Bids shall be based upon the materials and equipment as indicated in the Contract Documents. No substitutions will be approved prior to bidding. 2. Approvals of Submittals: The specifications contain sufficient information to describe to the Contractor and bidders the performance and quality standards that will be used to evaluate the submittals.

3. Equal Materials or Equipment: Unless otherwise stated in the specifications, other brand, make or manufacturer of a product, assembly or equipment which in the opinion of the Owner is the equal of that specified, considering quality, capabilities, workmanship, configuration, economy of operation, useful life, compatibility with design of the work, and suitability for the intended purpose, may be accepted. The Bidder must submit to the Owner a request for substitution within seven (7) days after bid date. All such requests shall be submitted in writing and shall be accompanied by a Substitute Request Cover Sheet (as attached at the end of this section), enumerating any and all deviations from specified product, complete manufacturer’s literature, specifications, and cut sheets covering the proposed substitute materials and the manufacturer’s recommendations for installation. It shall be understood that the burden of proof for a substitute or an “or equal” material shall be on the Bidder. The Owner shall be the sole determination as to the acceptance of substitutes. E.

Basis of Bid 1. The bidder must include the base bid and all unit prices, and all other items shown on the bid forms; failure to comply may be cause for rejection.

F. Preparation of Bids 1. Bids shall be made on unaltered bid forms as furnished in FORM OF PROPOSAL. Fill in all blank spaces. Bids shall be signed with name typed below signature. Where bidder is a corporation, bids must be signed with the legal name of the corporation, and the legal signature of an officer authorized to bind the corporation to a contract. 2. No bids shall be withdrawn for a period of sixty (60) days after the scheduled bid opening time. G. Submittal 1. Submit bid in a sealed opaque envelope. Identify the envelope with: A) Music Specialties Bid #2017-004 B) Name of Bidder; C) Bid Date. If bids are forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed as specified in the Form of Proposal with the notation “BID ENCLOSED” on the face thereof. H. Modification and Withdrawals 1. Modification of bids already submitted will be considered if delivered prior to the time fixed for opening of bids. Written modifications may be delivered by mail or by the bidder personally or his properly identified representative or messenger. Telephonic and FAX modifications will not be considered. Modifications shall not reveal the original or revised bid. Delivery of modifications shall be the responsibility of the bidder. I.

Negotiation with Lowest Responsible Bidder 1. The Public Body may negotiate with the apparent low bidder in accordance with Title 2.2, Chapter 43, Part 18 of the Virginia Public Procurement Act.

Withdrawal of Bid Due to Error 1. A bidder may withdraw his bid from consideration in accordance with Virginia Code Title 2.2, Chapter 43, Part 30 of the Virginia Public Procurement Act.

K.

Opening 1. Bids will be opened as called for in the Invitation to Bid. No consideration of bid award will be made at the bid opening. The bid evaluation and award will be made at a later date.

Award 1. The contract will be awarded to the lowest responsible bidder complying with the conditions of the Form of Proposal. The lowest bid refers to the lowest base bid.

M. Execution of Contract 1. The Owner reserves the right to accept any bid and to reject any and all bids, and to waive any irregularities or informality in bids received whenever such waiver or rejection is in his own best interest. N. State of Virginia Requirements The Code of Virginia, Title 2.2, Chapter 43, Part 11 requires each contract for more than $10,000 to include provisions 1 and 2 below: 1.

During the performance of this contract, the Contractor agrees as follows: A. The Contractor will not discriminate against any employee or applicant for employment because of race, religion, color, sex, national origin, age, disability, or any other basis prohibited by state law relating to discrimination in employment. The Contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of the nondiscrimination clauses. B. The Contractor, in all solicitations or advertisements for employees placed by or on behalf of the Contractor, will state that such Contractor is an equal opportunity employer. C. Notices, advertisements and solicitations placed in accordance with federal law, rule or regulation shall be deemed sufficient for the purpose of meeting the requirements of this section.

The contractor will include the provisions of the foregoing paragraphs a, b and c in every subcontract or purchase order of over $10,000 so that the provisions will be binding upon each subcontractor or vendor.
