The meeting was called to order at 7:00 p.m. by Laszlo Antal, Strata Manager, who welcomed the Owners and introduced the Council and representatives from Baywest Management Corporation.

GALLING THE ROLL/CERTIFICATION OF PROXIES

Prior to the start of this evening's meeting, the roll was called and all proxies certified by the Strata Manager in accordance with the requirements of the Strata Property Act. Also required by the Act is that a quorum, which consists of 113 of the Owners in good standing, be present in person or by proxy in order for the meeting to be competent to proceed. The Strata Manager reported there were a total of 72 units of which 71 were in good standing of which 36 strata lots were represented; 34 in person and 2 via proxy.

The Strata Manager advised a simple majority vote was required to pass the proposed budget, ratify the Strata Corporation's Rules, ratify the Agency Agreement and to elect a new Council. The Strata Manager also advised a3/o Vote is needed to pass the four (4) special resolutions pertaining to Deficit recovery, Bylaw amendments and lighting prolect.

ln accordance with the Strata Corporation's Bylaws, section 25 (1), the Council President was chairing the meeting and at Council's request the Strata Manager co-chaired the meeting.

PROOF OF NOTIGE OF MEETING

The Strata Property Act requires adequate proof of notice be given to all Owners by having notices delivered to their las! known address at least 14 days prior to the start of the meeting, indicating the date, time, place and items to be discussed. The Strata Manager reported notices were mailed to all Owners on March 22, 2011. Notices contained the Notice of Meeting, Agenda, lnsurance Summary, Proposed Budget, Special

-2Resolutions, Fee Schedule and a Proxy form. The Strata Manager certified the Notice was in accordance with the requirements of the Act. lt was then MOVED - 409 to approve the Notice of the CARRIED meeting as distributed. SECONDED - 405.

COUNCTL REPORT

Council President, Kyle O'Genski, provided the Owners with a report on Council activities during the first fiscal year. The highlights of Council's report included:

ANNUAL TNSURANCE REPORT

The Strata's insurance Broker is BFL Canada lnsurance Services lnc. and the Strata's appraiser company is Normac Appraisals Ltd. Each Owner was provided with a copy of the insurance for the Strata as part of the notice package, which set out the coverage and deductibles the Strata Corporation currently holds on the property. The Strata Manager highlighted features of the insurance policy which included:

Deductibles: Water/Sewer - $25,000; All Risks - $1,000

The Whitta-ker, that the amount of $i6.000 (sixteen thousand dollars) be raised in accordance with Section 105 (2) of the

After the Owner of unit 412 provided information to the Owners present the Strata Manager asked if there were any questions. One Owner recommended not to reimburse the Owner of unit 412 and no further questions were raised. The Strata Manager called for a vote and it was agreed the vote would be taken by show of hands with all voters being requested to hold up their voting cards. The votes were counted, resulting in 1 in favour, 33 opposed and 2 abstained. The motion to increase the budget by $341 .00 for the purpose of reimbursing unit 412 for damages to her car by the garage gate was DEFEATED

After a thorough discussion the Strata Manager called for a vote on the proposed budgets for both the Whittaker and the Boiler House. lt was agreed the vote would be taken by show of hands with all voters being requested to hold up their voting cards. The votes were counted resulting in 23 in favour, 9 CARRIED opposed and 4 abstained. The motion to adopt the 201 112012 Operating Budget was STRATA FEES: The new budget takes effect May 1 ,2011. Please find attached a copy of the approved budget and listing of Strata Fees for each strata lot. Owners previously making payment by way of an automatic withdrawal from their bank accounts need not take any action, as the management company will adjust their maintenance fees to the new schedule. This adjustment will be made on May 1, 2011. Owners making payment by way of post-dated cheques are encouraged to send a new series of 12 cheques (May 1 , 2011 through April 1 , 2012) to the management company. Those Owners currently not on the preauthorized chequing program, but who may wish to have their fees withdrawn automatically can contact Alwyn Li at Baywest Management. (604.595.2781, email: [email protected]) Cheques should be dated for the 1st of each month and made pavable to 8CS3735. Strata Fees are effective May 1 ,2011and all fees are due and payable on the first day of each and every month.

The Strata Manager read Resolution "C" out loud as follows: "Be it resolved by a 3/4 vote of the Owners of Strata Plan 8CS3735, The Whittaker, that Bylaw 23 (1) (a) (b), "Maximum Fine", be repealed and replaced with the following:

FEES AND ASSESSMENTS

An Owner shall:

pay strata fees on or before the 1't day of the month to which the strata fees relate; and

pay all Special Levies in accordance with the resolution approving such Special Levy in accordance with the Act;

The Strata Corporation shall cause to be prepared a budget for the coming fiscal year

accordance with the following:

a copy of the budget shall be distributed to all Owners with the notice of the annual general meeting, no less than 2 weeks in advance of the meeting, and will be accompanied by a financial statement;

(b)

if the budget is approved by a majority vote at the annual general meeting, it shall be implemented accordinglY; and

Owners will be informed, within 2 weeks following the annual or special general meeting at which a budget is passed, of any changes to their strata fees resulting from that budget.

The Common Expenses set forth in each budget shall be payable to

the

Strata

Corporation in accordance with the following:

payment shall be made in 12 equal consecutive installments, in advance, to be paid on the 1't day of each and every month;

at the request of the Strata Corporation, an Owner shall deliver a series of post dated cheques, within 30 days of the request, in payment of the installments for strata fees;

(c)

where the Strata Corporation has retained the services of a property manager or property management company, the Strata Corporation may forward payments of strata fees to such management company;

(d)

a property manager or an Owner's bank account property management company, and an option for direct debit to is availâble foi payment of strata fees, the Strata Council shall authorize the property management company to make this alternative available to the Owners.

An Owner may apply in writing to the Strata Corporation for a statement setting forth as of its due date the amount of any unpaid assessments due and owing from the Owner, and the Strata Corporation shall furnish the Owner with a statement within 10 days of receiving the written application.

Overdue strata fees shall bear interest at a rate of 10% per annum, compounded annually, not in advance, from the date when due until the date when paid; The Strata Corporation may levy a fine of $25.00 each time an Owner fails to pay strata fees in accordance with Bylaw (1) (a).

The Strata Manager called for additional nominations from the floor. As none were received after 3 successive occaJions, the above noted Owners were requested to introduce themselves to the ownership prior to an election being held. Owners were requested to put the names and/or unit number of the people they were voting for on the voting cards provided. General rules

Parking area

1.

All residents must wait for the parkade gates to close completely when exiting/entering the parkíng areas. Residents should not follow other vehicles through the parkade gate(s) (i.e. tailgating); only one vehicle should enter/exit the gate at a time for security reasons.

2.

Only vehicles with current registration and insurance in force shall be allowed in the parking areas, unless a copy of a valid "unlicensed vehicle policy" with a minimum of one hundred thousand dollars ($100,000) "basic third party legal liability" coverage is prominently displayed in the vehicle. A copy of the policy must be provided to the Property Manager.

3.

Owners/tenants or occupants are responsible for the cost of repairing damage to their assigned parking stall as a result of leakage of gas, oil or other negligent act. No cardboard allowed on garage floor to catch oil spill, it is a fire hazard.

4.

No repairs or oil changes to vehicles or other mechanical equipment are permitted anywhere on the common property.

5.

The parking area is not to be used for recreational purposes (i.e. skateboarding, rollerblading, etc.).

6.

Parking spaces are for motorized vehicles only. Storage of any other item is not permitted. Items stored are subject to removal without notice.

7.

The strata corporation may have a vehicle in violation of any of the bylaws or rules towed and impounded at the vehicle owner's risk and expense.

B. Please obey the 10 KM/H speed limit in the parking garage. 9. You must park within the lines of your assigned stall. Some stalls are tight and any violations will result in a fine.

10.

VISTTOR PARKING RULES

.

Owners/tenants are not permitted to park in the designated visitor parking stalls; these are for visitors only.

.

The visitor parking pass allows a visitor to park for 72 hours continuously or 10 calendar days in a month period without being towed. This means that if you park for longer tl-tan 72 hours or for more than 10 nights or days in a month, you will be towed.

.

Residents wíll be issued one vísitor-parking pass for short-term parking in the visitor parking area. Visitors must display this pass at all times while parked in visitor parking. If a visitor is staying for longer than 72 hours, a long-term parking pass must be obtained from the Resident Manager or member of the Strata Council. Parking passes will be replaced at a cost of $50.00.

Common areas 1.

All common area traffic ways (including, but not limited to: hallways, stairwells, equipment areas and unassigned lockers) must remain clear at all times (i.e. no mats, shoes, trash, statues, etc.). Storage of any item for more than 10 minutes is not permitted and is subject to removal without notice.

2.

Outside of door must remain same throughout building. This includes stripping on bottom of door. It is not permitted as it causes issues with our make-up air unit and pressure throughout building.

Loud noise is not permitted in any of the common areas.

Smoking, drinking or use of any drugs is not permitted in any of the common areas, including patio. Anyone found to be using drugs will be reported to the New Westminster police.

5.

There is a $200,00 move in fee, which includes the move out fee. The move in fee must be paid to the Strata Corporation by any Owner who is moving into or out of The Whittaker, subsequent to one initial move in for each unit, purchased from Developer. Both, the Resident Manager and Property Manager must receive 48 hours notice, and all moves must be arranged during the hours of 9:00 a.m. and 5:00 p.m. Current residents bringing in or having large items delivered, must also reserve the elevator with the resident manager or property manager so that the elevator can be locked off and padding installed to prevent damage to the elevator. There is no charge for this service. Anyone moving large furniture without havíng blocked off the elevator is subject to a fine.

6.

Any damage that occurs to any walls, floors or other common area must be reported to the Resident Manager or Property Manager and will be repaired at the cost of the person responsible.

7.

Anyone noticing any suspicious people inside the building(s) should notify the Resident Manager or any member of the Strata Committee or contact Police.

B.

The Strata Council must approve Signs, arrows or other real estate notíces and their placement. No other signage is allowed,

Bulletin boards in mailrooms are to be used for posting notices. Notíces are to display unit number of issuer and date of placement. All notices will be removed two weeks after placement.

Patio and Balconies 1. The only items permitted on the balconies and patios are bona fide patío furniture, plants and propane or gas barbeques (no laundry, no appliances, etc). Balconies or patios are not be used for storage. Outdoor storage units must be approved by Strata Council.

2. Charcoal barbecues and food smokers are not permitted. Propane or gas barbeques are permitted, but must be maintained in good operating condition.

3. Nothing (such as, but not limited to, plant containers) should be attached in such a way that causes damage to the building envelope.

4.

Use of drugs on patios constitutes criminal activity and will be reported to New-Westminster police. You can also be fined by Strata in accordance with Bylaw 3.

5. Nothing should ever

be thrown over or caused to drop off a

balcony (including but not limited to: spitting, cigarette butts, shaking mops, wash water etc.) - Strata to discuss patio washing procedures.

6. Satellite dishes are not permitted on balconies or anywhere

on

common property or limited common property.

7. Christmas lights are permitted from November 1't until January 31't providing that they are installed in a way that does not damage the building envelope.

B. Planters are permitted on balconies and entrances as long as there

are

proper drain trays under each pot or container and they are maintained.

Pets and other animals 1. The owner of a pet will registerthe pet with the Strata Council when the pet is first introduced into the unit.

2.

Pets are not allowed

to urinate or defecate on the common

property.

3. Only pets of the following nature may be kept on the Premises: a) a reasonable number of fish or other small aquarium animals;

b) a reasonable number of small caged mammals;

c) a reasonable number of caged birds; d) no more than 1 cat; or e) no more than 1 dog, provÍded that such dog is not a Prohibited Dog; f) "Prohibited Dog" means:

.

a dog which has previously bitten or attacked any Person or pet, whether such bite or attack occurred

.

on the Premises or not; or a dog which is anY of the following breeds 1. Pit Bull Terrier; 2. American Pit Bull Terrier; 3. Pit Bull; 4. Staffordshire Bull Terrier; 5. American Staffordshire Terrier; 6. Rottweiler; 7. Doberman Pínscher; or B. Presa Canario; 9. or is a mixed breed which includes any of the above.

No Owner shall keep or permit

to be kept on the Premises:

a) a Prohibited Dog; or b) an exotic pet, including but not limited to livestock, fowl, snakes, reptiles, spiders, or large members of the cat familY;

5. An owner/tenant or guest must clean up pet droppings immediately and properly dispose of them. An owner/tenant or occupant is also responsible for cleaning up any pet "accidents" in the interior common areas (i.e, cleaning up soiled carpet).

6.

Feeding of birds or wildlife, including pets is not permitted on the

common property or limited common property.

7. Aquariums filled with water should not exceed 50 gallons, unless the owner/resident has specific peril insurance in their homeowner policy. A copy of the policy should be provided to the Property Manager.

B" Pets should be kept on a leash at all times on the common proPertY.

General

1.

All strata lots must retain the original blinds to maintain the consistent appearance of the building exterior. Interior draperies may be added provided they have a neutral colored lining.

2.

Windows must not be covered by any material (i.e. tinfoil, flags, posters, sheets, cardboard, etc) other than recognized blinds or draperies.

3. Seasonal decorations may only be hung during a given seasonal holiday using appropriate over-the-door hangers and must not interfere with the common area hallway.

4. Any owner/tenant requesting an exemption from a rule must request an approval, in writing, from the Strata Council.

5.

No appliances, or vacuum between 11PM and 7AM. This time period will be considered "Quiet time".

6. Excessive noise during "Quiet time" is not acceptable and will result in fines to the offending party.

Storage Facilities

1.

Do not store flammables or explosives including, but not limited to, pressurized containers, propane tanks, petroleum products, oily rags and paint thinner. Food storage is also not permitted in the storage lockers.

Garbage and Recycl¡ng:

1.

Paper, cardboard, glass, tin cans and recyclable plastics should be placed IN their respective recycle bins.

2.

Garbage is to be bagged, tied and placed IN the garbage bin, no dumping allowed, garbage must be placed in the bin.

Insurance

1.

Where an act or omission by an owner/tenant or his/her guests causes an increase in the insurance costs, the owner/tenant shall pay to the Strata Corporation, in addition to any fine otherwise levied or payable pursuant to the Bylaws, the amount of the increase in the insurance costs.

If damage (the "Damage") is caused to the Insured Property by an act or omission from an owner/tenant or his/her guests (the "Responsible Owner") the Strata Corporation may:

Make a claim with its insurer for the cost to repair the damage (the "Repair Costs"); Repair the damage; and Deliver written notice to the Responsible Owner of the amount of the Repair Costs. Within 30 days of receipt of this notice, the Responsible Owner shall pay to the Strata Corporation the ded uctible.

Each owner of a strata lot is solely responsible for all form of property and líability insurance on his/her strata lot and all or any fixtures, contents, or improvements therein and thereto against perils not insured by the Strata Corporation, for amount in excess of amounts insured by the Strata Corporation, and for whatever is not covered by the insurance policies of the Strata Corporation.
