ORDER: The Pay Scales of the State Government employees were revised with effect from 01.07.2008 with monetary benefit from 01.02.2010. Various employees Service Associations have been representing for constitution of another Pay Revision Commission for the State Government employees. Government has considered there representations and after careful consideration, has decided to constitute the 10th Pay Revision Commission for the State Government employees. 2. Accordingly, Government hereby appoint Sri Pradeep Kumar Agarwal, IAS (Retd) as Pay Revision Commissioner in the rank equivalent to Chief Secretary. This appointment will be in addition to his responsibilities as Director General, National Academy of Construction. 3.

The terms of reference of the Commission shall be as follows: (i) To evolve the principles which may govern the structure of emoluments and the conditions of service of various categories of employees of the State Government, Local Bodies and Aided Institutions, Non-teaching staff of the Universities including AcharyaN.G. Ranga Agricultural University, Jawaharlal Nehru Technological University, Work charged employees and full-time contingent employees, which have a financial bearing taking into account the total packet of benefits available to them and suggest changes therein which may be desirable and feasible; The Commission however shall, not deal with the teaching staff in Government Colleges and Government Aided Private Colleges drawing UGC/AICTE and ICAR scales. The Commission shall also not deal with the officers of A.P. State Higher Judicial Service and 1

A.P. State JudicialService who are drawing Pay Scales as recommended by the First National Judicial Pay Commission. (ii) To examine as to what extent the existing DA may be merged in payand, to evolve consequent new set of pay scales merging DA therein and to suggest the mode of fixation of pay in the Revised Pay Scales. (iii) To study the Automatic Advancement Scheme as modified from time to time keeping in view the anomalies that have arisen during the implementation of the said scheme and also to examine whether the said scheme should continue in its present form and to make the recommendations in this regard. (iv) To examine the need for various Special Pays, Compensatory and various other Allowances and other perquisites in cash or kind now allowed and to make recommendations regarding their continuance or otherwise and if continuance is recommended what modifications, ifany are deemed, desirable with regard to their rates, terms and other conditions which should govern them in future. (v) To examine and review the existing pension structure for pensioners, and make recommendations which may be desirable and feasible. To examine the recommendations of the OMC constituted vide G.O.Ms.No.142, G.A. (Spl.A) Department, dated:07.03.2012. (vii) Review of the existing human resources of all departments in tune with the contemporary requirements including contract/ outsourcing personnel. (viii) To give its recommendations on any other matter referred to it by the State Government during the tenure of its office. (ix) In formulating its recommendations, the Commission shall take into account the overall financial position of the State. 4. The Pay Revision Commission may lay down its own procedure for receiving representations, examining witnesses and calling for information. The Departmentsof Secretariat and Heads of Departments shall furnish all necessary information as and when required by the Pay Revision Commission and extend such co-operationand assistance as may be required by him. 5. The Pay Revision Commission will ordinarily function from Hyderabad, but may tour within or outside, the State, if necessary. 6. PRESSNOTE The Government of Andhra Pradesh appointed Sri Pradeep Kumar Agarwal, IAS (Retd) as Pay Revision Commissioner in G.O.Ms.No.95, General Administration (Spl-A) Department, dt:28-02-2013 with the following terms of reference. (i) To evolve the principles which may govern the structure of emoluments and the conditions of service of various categories of employees of the State Government, Local Bodies and Aided Institutions, Non-teaching staff of the Universities including Acharya N.G. Ranga Agricultural University, Jawaharlal Nehru Technological University, Work charged employees and full-time contingent employees, which have a financial bearing taking into account the total packet of benefits available to them and suggest changes therein which may be desirable and feasible; the Commission however shall, not deal with the teaching staff in Government Colleges and Government Aided Private Colleges drawing UGC/AICTE and ICAR scales. The Commission shall also not deal with the officers of A.P. State Higher Judicial Service and A.P. (iv)To examine the need for various Special Pays, Compensatory and various other Allowances and other perquisites in cash or kind now allowed and to make recommendations regarding their continuance or otherwise and if continuance is recommended what modifications, if any are deemed, desirable with regard to their rates, terms and other conditions which should govern them in future.

(v) To examine and review the existing pension structure for pensioners, and make recommendations which may be desirable and feasible. (vi) To examine the recommendations of the OMC constituted vide G.O.Ms.No.142, G.A. (Spl.A) Department, dated:07.03.2012. (vii) Review of the existing human resources of all departments in tune with the contemporary requirements including contract/ outsourcing personnel. (viii)To give its recommendations on any other matter referred to it by the State Government during the tenure of its office. TENTH PAY REVISION COMMISSION QUESTIONNAIRE BACK GROUND The State Government have been constituting Pay Revision Commissions regularly to evolve rational pay structure for their employees. The Government recently constituted Tenth Pay Revision Commission. Its terms of reference include evolution of principles which may govern the structure of emoluments and the conditions of service taking into account the total packet of benefits available to the employees of the State Government, Local Bodies, Aided Institutions and Nonteaching staff of Universities. The Pay packets for the Government employees include Basic Pay and compensatory Allowances. The main compensatory allowances are Dearness Allowance, House Rent Allowance and City Compensatory Allowance. The Dearness Allowance compensates rise in the cost of living index which is being sanctioned based on the increase in the twelve monthly moving average of the All India Consumer Price Index for the Industrial Workers computed by the Labour Bureau, Simla. The House Rent Allowance compensates the expenditure incurred by the Government employees on Housing. The City Compensatory Allowance compensates higher cost of living index in cities. In addition there are special allowances where the employees are supposed to perform special nature of duties including those working in interior places, unhealthy localities, hill areas, tribal areas etc. The Special Pays are sanctioned where the job requires special skills or the job involves arduous nature of duties or for specific addition to work. It is pertinent to note that the quantum of these Special pays and allowances should adequately compensate the extra duties or for the arduous nature of the job, but at the same time they should not disturb the salary structure. The successive Pay Revision Commissions evolved the pay structure of the employees after thoroughly reviewing the pay scales evolved by earlier Pay Revisions. An Anomalies/Regrouping Committee followed the 1986 Pay Revision and Anomalies Committees followed the 1993, 1999, 2005 and 2010 Pay Revisions. The concept of Master Scale was first time introduced in the 1993 by the Pay Revision Commissioner. The rate of increment is the same at a given pay point in the Master Scale irrespective of the scale and it also confers relatively higher benefits on the employees with longer service. The Pay Scales are only segments of the Master scale. The Master Scale was devised with a view to providing the seniors with greater benefits. 23

The successive Pay Revision Commissions also continued the concept of the Master Scale. Among others, the last Pay Revision Commission recommended for :– 

The minimum pay Rs.6700/- and the maximum pay as Rs.55660 and thus the ratio between minimum and maximum worked out to 1:8.31



Continuance of the Master Scale progressively rising incremental increases.



Continuance of the Automatic Advancement Scheme consisting of 8, 16 and 24 years as it serves the larger interests of the Government employees. However based on the agreement reached between the Government and JAC of Employees, Teachers and Workers, the periodicity of the scheme has been revised to 6, 12, 18 and 24 years.



Continuance of Special Pays and other allowances keeping the settled and adopted criteria by the earlier Commissions in view.



Sanction of three stagnation increments.

TENTH PAY REVISION COMMISSION QUESTIONNAIRE PART I PAY, ALLOWANCES AND OTHER SERVICE CONDITIONS A. GENERAL PRINCIPLES GOVERNING PAY SCALES AND ALLOWANCES In Government of India, based on the recommendations of 5th and PRCs, whenever the D.A. crosses 50% of the basic pay, it shall be treated as Dearness Pay and the compensatory allowance including D.A. will be calculated based on the Pay Plus Dearness Pay, pending constitution of P.R.Cs as P.R.Cs are usually constituted once in 10 years. The pensionary benefits are also calculated on Pay Plus Dearness pay. The 9th P.R.C. has also recommended that whenever the D.A. reaches 50% of Basic Pay, all allowances may automatically be increased by 25%, so that necessity for a P.R.C. at short intervals is eliminated. While the position in the centre is as stated above, in the State, the PRCs are almost constituted once in 5 years. Majority of States are adopting the central pay scales to employees. In the context of the above position, the PRC would like to know your considered views on the following issues: 6th

Scale of pay: As you are aware every post carries a scale of pay with a minimum of the scale, annual increments and maximum, the State Government introduced the concept of Master Scale, it is often said that with the introduction of the Master scale, the concept of pay scale does not have much relevance particularly, to those who are in service. the pay scale continues and the demands for a higher scale of pay go on unabated. Very often the employees compare their scale with their counterparts and feel that they get a raw deal in the matter of pay scale. With this, the successive Pay Revision Commissions and the Anomalies Committees repeatedly analyzing the pay scales. (a)

The pay scale is sort of compensation or remuneration, but the employees seems to be giving much prominence to the pay scale? please indicate your view on this aspect.

It is a general phenomena that while assigning a pay scale, to a particular post, the qualifications, nature of duties, whether general or arduous nature of duties, areas of operation etc., are taken into consideration. The other argument is that the pay scale is assigned for normal duties and when the job requires special skills or arduous nature of duties or where the employee has to work in remote areas etc., there should be compensation by way of special pay or special allowance. 12.

TENTH PAY REVISION COMMISSION PART II PENSION STRUCTURE One of the terms of reference of the Pay Revision Commission (PRC) is to examine and review the existing structure for pensioners and make recommendations which may be desirable and feasible. The present rules that govern the pensionery benefits are based on the A.P. Revised Pension Rules, 1980 which came into force with effect from 29th October, 1979 as amended from time to time. Government have been sanctioning Pension on the last pay drawn, provided the employee drew pay in that post, in a regular vacancy at least for a period of two months. Otherwise the pension is based on average emoluments drawn for the last ten months. The minimum service to get pension is 10 years. Government allows a weightage of 5 years for superannuation pension and for voluntary retirement. In either case, the maximum qualifying service is 33 years for getting full pension i.e.,50% of pay drawn at the time of retirement. The Pay Revision Commission 2010 reviewed the pension structure and fixed the minimum pension as Rs.3350/- a month. The commutation of pension was recommended to be continued @ 40% and no change was recommended in the existing provision in case of restoration of commuted pension. The maximum limit of Retirement Gratuity was recommended to be enhanced from Rs.3,50,000/- to Rs.7,00,000/-. Subsequently the same was enhanced to Rs.8,00,000/-. The D.A. at the time of retirement should be added to the basic pay at gratuity be calculated. 22. (a)

Information and Communication Technology is now extensively being used in Government Departments to monitor programmes. Information is to be furnished for each category of the post. The grades, as you are aware, are already prescribed in Schedule-I of G.O.s revising the Pay Scales of the State Government employees. Similarly, the pay scales assigned by the successive Pay Revision Commissions have to be indicated. If the scales were revised subsequently, either as a result of Anomalies Committee or any subsequent order of the Government, such revised scale only has to be indicated. It also taps information regarding Special Pays/Special Allowances if any attached to the posts. If more than one special Pay or Special Allowance is attached such information has to be brought out separately, as indicated in the guidelines under proforma-I. 2(b) The second viz., Proforma-II is in regard to Service Rules governing the posts, method of recruitment, number of employees enjoying automatic advancement scales etc. 51

Subsequently, the Service Associations have requested for sanction of Interim Relief (IR) pending final action on the recommendations of PRC. 2. The Government has considered the request of Service Associations and after careful examination decided to sanction Interim Relief pending recommendations of the PRC to all Government Employees, including the employees of the Local Bodies (PR and ULBs) and the Government Institutions receiving Grants-in-Aid from the Government, and Work Charged Employees and Full-Time Contingent Employees who are currently drawing pay in the Revised Scales of Pay 2010. Accordingly, the following orders are issued: a.

Interim Relief will be paid at the rate of 27% of the basic pay and will be payable from 01.01.2014. The Interim Relief is admissible on Basic Pay as defined under FR 9(21) (a)(i).

b.

The Interim Relief sanctioned above shall be shown as a distinct element of remuneration which shall be adjusted against any benefit that may accrue to the employees on account of revision of scales of pay and other allowances as a result of Government’s decision on the Report of the Pay Revision Commissioner.

c.

The Interim Relief shall be applicable to all Government Employees, including the employees of the Local Bodies (PR and ULBs) and the Government institutions receiving Grantsin-Aid and Work Charged Employees and Full-Time Contingent Employees who are currently drawing pay in the Revised Scales of Pay 2010.

d.

The Interim Relief will not be admissible to the Officers of the Andhra Pradesh State Higher Judicial Service, the Andhra Pradesh State Judicial Service, All India Service Officers (AIS), and those drawing salaries on UGC / AICTE / ICAR / Government of India Scales, contract staff, and staff of Societies, Autonomous Institutions, Public Sector Undertakings and all those not covered under categories mentioned at ‘Para2 c’ above. The Interim Relief will also not be admissible to the Part Time Contingent Establishment.

e.

The payment on account of Interim Relief involving fractions of fifty paisa and above shall be rounded off to the next rupee and fraction of less than fifty paisa shall be ignored.

f.

The Interim Relief sanctioned above shall not count for computation of Dearness Allowance, House Rent Allowance, City Compensatory Allowance or any other Allowances, Encashment of leave, Pay Fixation, Pension or Gratuity etc., and

g.

The expenditure on sanction of Interim Relief shall be debited to the detailed Head “010.Salaries – 015. Interim Relief” under respective Major, Minor and Sub heads of Account.

Review of existing pension structure is also one of the terms of reference of the Pay Revision Commissioner. 2. Accordingly, Government hereby sanction Interim Relief at the rate of 27% of Basic Pension with effect from 01.01.2014 along with the pension payable in the month of February 2014. 5. The Interim Relief sanctioned in paragraph 4 above is subject to the following conditions:i. Interim Relief shall be shown as a separate element. No Dearness Relief on this element shall be admissible. Interim Relief involving a fraction of rupee will be rounded off to the next higher rupee. ii. The Interim Relief sanctioned shall be fully adjusted against and included in the package, which may become admissible to the pensioner/ family pensioner as a result of Government decision on the final report of the Pay Revision Commissioner. 64

The Interim Relief ordered above shall apply to: (a)(i) those who retired from service after 01.07.2008 drawing pay in the Revised Pay Scales, 2010; (ii) those who retired prior to 1.7.2008 and whose pension was consolidated in the light oforders issued in the G.O. first read above; and (b) Jagir and Estate Pensioners and (c) Service pensioners or Family pensioners in respect of the categories mentioned at para 2 (c) of the GO 3rd cited and who are governed by AP Revised Pension Rules, 1980.

7. These orders are not applicable to: (i) The pensioners who retired while drawing UGC /AICTE and ICAR Scales. (ii) Financial assistance grantees who are not getting Dearness Relief. (iii) Pensioners/ Family Pensioners of the members of the A.P. State Higher Judicial Serviceand A.P. State Judicial Service. (iv)Pensioners/Family Pensioners whose pension was consolidated in the light of the orders issued vide G.O.Ms.No.54, Higher Education (UD.II) Department, dated. 08.06.2011, G.O.(P).No.95, Finance (Pension.I) Department, dated:01.08.2010 and G.O.Ms.No.31, Higher Education (UE.II) Department, dated:24.05.2013 8. The term pension for the purpose of calculation of above InterimRelief: (i) Pension/ Family Pension in case of pre 1.7.2008 retirees and where family pension was sanctioned prior to 1.7.2008 means the consolidated pension or consolidated family pension in terms of G.O 1st read above. (ii) In the case of pensioners who retire from service on or after 1.7.2008 or where family pension is sanctioned for the first time on or after 1.7.2008. Pension/ Family Pension means the basic pension/ basic family pension as the case may be.

9. In case of pensioners in receipt of more than one pension, the Interim Relief shall be calculated on both the pensions. 10. If any pensioner is re-employed/ employed under the State or Central Government or any Public Enterprise or Autonomous Body under the control of State or Central Government, he/ she shall not be eligible to draw Interim Relief on Pension/ Family Pension during the period of such re-employment/ employment. 11. All the Treasury Officers/ Pension Payment Officers shall work out and make payments of Interim Relief on pension sanctioned in this order without waiting for further authorization/ instructions from the Accountant General (A&E), A.P., Hyderabad in terms of the orders issued in G.O.(P).No.270 Finance & Planning (FW: PSC.I) Department dated.7.10.1986. 12. The expenditure is allocable among the various States in ccordance with provisions of Rule 24 of the incidence of pension rules in Appendix – IIIB of the Andhra Pradesh Accounts Code, Volume-I 13.
