Voting Systems: OVSTA Monthly Update – June 2015

Each month, the Office of Voting Systems Technology Assessment (OVSTA) provides an update on Election Assistance Commission (EAC) and Secretary of State (SOS) activities related to voting systems. Each update provides information on: • • • • • • •

Voting system related events that may be of interest. Administrative approvals and denials since the prior month’s update. Administrative approval requests since the prior month’s update. Voting system testing and approval at the SOS office. Voting system testing and certification at the EAC. Defect, failure and fault reports issued since the prior month’s update. Ballot printing certification requests since the prior month’s update.

Recent and Upcoming Events In the May issue of the National Conference of State Legislatures (NCSL) monthly newspaper, “The Canvass”, focuses on “Elections Technology: Nine Things Legislators May Want to Know.” Additionally, for those jurisdictions that are looking at acquiring a new voting system, there is a section entitled “Ten Things to Know About Selecting a Voting System.” At the April 29, 2015, Standards Board Meeting, in Williamsburg, Virginia, the Election Assistance Commission (EAC) Transition Report was presented to the new Commissioners on where the EAC should place its emphasis as it continues to move forward after being reconstituted. The full report can be obtained on the EAC website. On May 19-20, 2015, OVSTA attended and presented at the State Certification Testing of Voting Systems National Conference in Seattle, Washington. This conference is a coalition of states to discuss their certification testing for all election technology. The

On May 27, 2015, the Secretary of State and multiple California jurisdictions testified at the Senate Elections and Constitutional Amendments and Assembly Elections and Redistricting joint hearing on the Colorado model of elections based upon their observations of the May 5 Denver municipal election. The hearing can be viewed on the Senate Oversight Hearings webpage. On June 2, 2015, the Voting Modernization Board (VMB) held a public meeting in Los Angeles. At the public meeting the VMB authorized funding to Los Angeles County in the amount of $11,085,765 for the research and development of its voting system. The next VMB meeting is scheduled for July 23, 2015, in Sacramento. The Voting Opportunities Committee (VOC) of the CACEO held two meetings, plus additional sub-committee meetings, in the month of May. The VOC is working to explore voting options including the vote center model. Testing and Approval by the State of California •



On February 10, 2015, the Secretary of State received an application and technical data package for the testing and approval of the Elections Systems and Software, Inc. (ES&S) Unity 3.4.1.0 voting system. ES&S has provided all of the documentation and software necessary to deem the application complete. OVSTA gave comments to ES&S on the documentation and has requested that an updated set of Use Procedures be provided. On April 21, 2015, the Secretary of State received an application from Clear Ballot Group for its Clear Count Central Count Scanner. Clear Ballot Group submitted only the application form. It did not submit any of the associated configuration documentation (software, hardware, etc.) to deem the application complete. Further, in discussion with Clear Ballot, it was still unsure of the configuration in which the system was going to be submitted to California. Therefore, on May 11, 2015, the Secretary of State denied the application.

Administrative Approval Requests California Elections Code section 19213 precludes a voting system or part of a voting system that has been approved by the Secretary of State from being changed or modified until the Secretary of State has determined the change “does not impair its accuracy and efficiency. . . .” Information on submitting an administrative approval request is in “Requesting Administrative Approval of a Change or Modification to an Approved Voting System.” •

Dominion submitted an application for the modification to its conditionally approved Democracy Suite 4.14-A.1 voting system. The application only includes a modification to central count optical scan (CCOS) hardware component and leaves the remainder of the recently certified Democracy Suite

CCROV #15055 June 4, 2015 Page 3 4.14.A.1 unchanged. Dominion is requesting the addition of the Canon DRG1130 commercial off the shelf scanner as a secondary CCOS to work in conjunction with its currently approved ImageCast Central software version 4.14.4. •

Sonoma County has submitted an application for the modification to its approved Mark-A-Vote voting system and BCWin ballot counting system. The application includes a request to upgrade to a new central processing unit (CPU) and upgrade its operating system to Windows 7. Additionally, it will need to modify the associated controllers and drivers required to operate the system.

Testing and Certification at the EAC The EAC provides a weekly update of voting system testing. Although an update has not been provided since May 5, 2015, OVSTA was able to obtain the following information for systems relevant to California: Dominion Democracy Suite 4.14-E. EAC received a draft Test Report on May 27, 2015. Related documents can be found on the EAC website. ES&S EVS 5.4.0.0. EAC approved the application for the ES&S EVS 5.4.0.0 test campaign on February 23, 2015. NTS is working on the Test Plan. Related documents can be found on the EAC website. Everyone Counts eLect Voting Solution 4.0. The EAC is waiting for additional information related to the system. Related documents can be found on the EAC website. Hart InterCivic Verity 1.0. The EAC issued a Certificate of Conformance and Final Decision Granting Certification on May 12, 2015. Related documents can be found on the EAC website. The EAC’s "Voting Systems Under Test" and "Certified Voting Systems" pages provide more specifics on each voting system. Defects, Failures and Faults Defects, failures and faults (problem reports) of (1) voting system hardware and software and (2) ballot printing manufacturing and finishing are reported to the Secretary of State. •

The Secretary of State did not receive any defect reports in the month of May.

Ballot Printing Certification Requests Ballot Manufacturer and Finisher Applications Under Review: •

K&H Printers has requested approval to use the Canon/Océ Color Stream 3900 inkjet printer to print Sequoia Optech ballots at its Everett, Washington facility.
