Date: 19 December 2008 To The Hon’ble Chairman West Bengal Human Rights Commission Bhabani Bhaban, Kolkata - 27 Respected Sir, Our organisation is compelled to lodge complaint with you as follows for your urgent action and intervention. Mr. S. Mokhtar Ahmed is associated our organization Banglar Manabadhikar Suraksha Mancha (Masum) and work mainly in North 24 Parganas as District Human Rights Monitor. During his course of work, he conducted one fact finding over human rights violation on Giyasuddin Mondal who was physically tortured at Deganga Police Station. Incidentally, there was case of theft in the shop of Giyasuddin in the month of October 2008. He lodged complaint in Deganga Police Station against unknown persons. The police was investigating the matter but without success. Giyasuddin Mondal himself searched for his stolen goods and incidentally detected some of those. On 16.12.2008 Giyasuddin Mondal informed S. Mokhtar Ahmed that he repeatedly informed the said police station about the whereabouts of his stolen materials and further informed the PS about the location of those materials and the person namely, Mr Samad Mondal, son of Abban who was reportedly involved with the crime, but the Police Station had not taken any actions. It should be referred that the said person, Samad has been selling hooch just next to the shop belong to Giyasuddin and he has good connection with a section of police attached with Deganga Police Station. On the said date he again informed the matter to the PS and asked for recovery of those stolen materials, subsequently Mr. Mokhtar also requested the Officer in Charge of Deganga PS at about 9.26 a.m. from his mobile and asked for taking appropriate action. During the conversation the said OC of Deganga PS, Mr. Alok Munshi said he referred the case to the police personnel looking after the matter and asked for raid and recovery of the articles, after the call, a police party raided the alleged place but failed to recover the materials as the information was leaked to Samad as alleged by Giyasuddin and Samad removed the articles before police raid. Thereafter, Samad Mondal publicly threatened Giyasuddin for complaining the matter to the said PS and that too as alleged by Giyasuddin that police informed Samad about Giyasuddin’s complaint. Giyasuddin again contacted Mr. Mokhtar at 2.33 p.m. on the same day and narrated the whole incident of threatening by Samad, in which he said that he would ransack Giyasuddin’s residence and make his life hell and kill his family and him. Giyasuddin also informed that he was living under anxiety. Mr. Mokhtar immediately called the Officer-in-Charge of Deganga PS about the development at 2.35 p.m., the said police officer told him to inform Giyasuddin to visit the PS at evening. Samad, the person against whom there was complaint called Mr. Mokhtar on his mobile immediately after the call between him and the said O.C. at about 2.45 p.m. from a mobile numbering 9775626210. Samad criminally intimidated Mr. Mokhtar over telephone and threatened him with dire consequences if he helped Giyasuddin in any manner. He also blamed Giyasuddin for lodging complaint against him in
police station. He abused Mr. Mokhtar with the filthiest languages and made derogatory remarks about our organisation, MASUM. He also said that he has rapport with the higher echelon of police force and relation between the police and himself and it was cordial enough to inflict maximum damage to Giyasuddin. Thereafter, at about 3.19 p.m., Mr. Mokhtar called the Officer-in-Charge. of Deganga P.S. and informed the matter to him. He also supplied him the cell number of Samsad. Giyasuddin visited the PS at about 8.00 p.m. on 16.12.2008, the Officer in Charge discussed the matter with Giyasuddin and asked for a written complaint, which Giyasuddin made on 17.12.2008 at about 11.00a.m., vide Deganga PS GDE no. 1116 dated 17.12.2008. The matter did not end there. On 18.12.2008, Samad caught hold of Giyasuddin in order to teach him a good lesson. Samad beat him black and blue. Giayasuddin tried to save his life and escaping from the grab of Samad, took shelter at nearby Panchayet office. But there also he was beaten by Samad. Giyasuddin was seriously injured and he was medically treated. He informed the matter to the police station of Deganga but he was detained in the police station! After we got information we contacted the concerned police station, but there was no much help. The police on duty informed that the 2nd officer (Mejo Babu) will take decision. After the higher police officers of the district were approached, including The SDPO, Mr. J. Biswas. Giyasuddin was let off from the police station after registering one case, Deganga PS Case No. 403 under sections 448/323/325/506 of Indian Penal Code.. Samad is roaming freely in the area creating terror. The victim, Giyasuddin is helpless and living under death threat. There is strong possibility that Samad can inflict more harm to him even he is capable of committing murder him. It is worried and shocking that a section of police of Deganga P.S. are in connivance with Samad. Mr. Samad is known criminal of the locality, running illegal country liquor shop, allegedly murdered some men, a known extortionist, having close contacts with local police, political party and the people in administration. You are requested to look into the matter on threatening calls made by Samsad to Mr. Mokhtar Ahmed who belongs to our organisational fold and take necessary action for offensive acts of Samad. Mr. Mokhtar already lodged written complaint over the matter to the Superintendent of police of the District and the concerned police station. So far, the local P.S. has not taken any action for the assault perpetrated on Giyasuddin by Samad. The matter is extremely urgent and it demands your immediate intervention to the matter. The life of Giyasuddin is at stake. He must be protected at any cost. Thanking you Yours sincerely
