ქალბატონო ნინო, თქვენი მიმდინარე წლის 29 ივნისის განცხადებასთან დაკავშირებით გაცნობებთ, რომ საქართველოს საგადასახადო კანონმდებლობა კრიპტოვალუტის მომპოვებელ პირთა მიმართ დაბეგვრის რაიმე განსხვავებულ წესებს არ ითვალისწინებს. ამასთან, საქართველოს საგადასახადო კოდექსის მე-80 და 97-ე მუხლების დებულებების გათვალისწინებით, რეზიდენტი ფიზიკური პირის/რეზიდენტი საწარმოს საშემოსავლო/მოგების გადასახადით დაბეგვრის ობიექტია დასაბეგრი შემოსავალი/მოგება, რომელიც განისაზღვრება, როგორც სხვაობა გადასახადის გადამხდელის ერთობლივ შემოსავალსა და ამ კოდექსით გათვალისწინებული გამოქვითვების თანხებს შორის. ამავე კოდექსის 168-ე მუხლის მე-2 ნაწილის ,,ა“ ქვეპუნქტის მიხედვით, ჩათვლის უფლების გარეშე დღგ-ისგან გათავისუფლებულია ფინანსური ოპერაციების განხორციელება ან/და ფინანსური მომსახურების გაწევა. რაც შეეხება სხვა საგადასახადო ვალდებულებების განსაზღვრას, აღნიშნული დამოკიდებულია პირის სამართლებრივ ფორმასა და მის მიერ განხორციელებული ოპერაციის შინაარსზე. პატივისცემით, ეკატერინე ყაველაშვილი
