Moriches, Center Moriches, East Moriches and Eastport
In 1995 with the cooperation of the Town of Brookhaven, the greater Moriches communities undertook a planning exercise and formulated a Hamlet Plan. The Moriches Four-Hamlet Comprehensive Plan was summarized in the Town of Brookhaven’s 1996 Comprehensive Land Use Plan and was included as an addendum. Although that was almost twenty years ago, many of the recommendations contained in the hamlet plan continue to be relevant today. Several recommendations have been implemented and some have not. This includes the recommendations relative to zoning and land use which have not been implemented. This study intends to use some of the recommendations contained in the hamlet plan
along with other older plans and some more recent studies in order to formulate the basis for this comprehensive zoning re-evaluation. The older recommendations will be examined, updated and the new proposals analyzed. This study covers approximately seven miles of Montauk Highway, from the Forge River to the Southampton Town line, along with Frowein Road and the coastal areas of the Moriches communities. The study area includes the historic districts of Moriches, Center Moriches, East Moriches and Eastport. The goals and objectives of this study hope to achieve an appropriate level of future commercial and industrial development within the study area.

Introduction The comprehensive zoning reevaluation of the Montauk Highway corridor for Moriches, Center Moriches, East Moriches and Eastport has been developed after extensive research of past proposed rezoning efforts, review of existing land uses along the corridor and the addition of other spot zoned and split zoned lands. The study area also includes proposed upzoning of publicly owned lands as well as sensitive lands along stream corridors and waterways. Various land use plans and studies for this greater Moriches area have been drafted and adopted by the Town in the past. As a result of those studies and plans, numerous recommendations for rezoning of
this corridor have been proposed. However, those proposals were not enacted and many of those recommendations remain relevant today. The Town working with the local community developed the selection of parcels based on the review of the previous plans and studies. The primary focus of this study is to identify and rezone vacant, split zoned, non-conforming and excess commercial zoning. Excess commercial zoning has lead to commercial sprawl in other areas of the Town of Brookhaven. The commercial sprawl effect also leads to consequences including increased traffic and other significant environmental impacts.

Past Plans In 1937 the Town adopted zoning regulations and commercially rezoned or strip zoned hundreds of miles of Town roads throughout the Town of Brookhaven. Zoning maps from 1937 indicate the commercialization of the main corridors of the town. From 1937 to 1954 there were only three zoning districts representing residential, commercial and industrial uses. After 1954, planned land use changed and multiple zoning districts for residential, commercial and industrial districts were formed with associated bulk requirements and specific permitted land uses. The 1975 Brookhaven Master Plan can be summarized in terms of corridors, clusters, centers and conservation: “These four basic concepts are intimately interrelated since, short of outright acquisition of vacant land, corridors, clusters and centers are the best available tools for implementing conservation.” The 1975 plan proposed four residential densities (rural, low, medium and multi), three categories of commercial zoning, and maintained the agriculture designation. In addition, several new concepts were introduced. Specific areas were designated for new commercial centers, multi-use planned unit developments, and open space residential development. Emerging strip commercial development was recognized, thereby expanding commercial land use designations. With the exception of changes in the vicinity of Brookhaven Airport and additional lands in Manorville, fewer lands were designated as agricultural. The plan substantially expanded proposed open space, particularly green belts. The Town of Brookhaven 1987 Land Use Plan recommended significant rezonings. The residential component of the plan called for a net reduction in overall residential density throughout the town. Former planned use areas were shown more definitely as multi-family and/or commercial uses. Medium to high residential densities were added in Manorville (replacing the center designations) and Eastport. Proposed industrial development was expanded in Yaphank, and the proposals around the airport were changed to medium density

Past Plans (cont.) residential and open space. In general, open space proposals were expanded and the plan map included smaller institutional holdings. The 1987 plan reinforced the goals and objectives of the 1975 plan, with more emphasis placed on groundwater protection. The goal of the 1987 plan was to respect and preserve Brookhaven’s special environmental features and ensure that the town’s growth was attractive, livable and healthy. In 1995 the Moriches Four-Hamlet Community Hamlet Plan was completed. The recommendations of the Hamlet Plan were incorporated into the 1996 Town Land Use Plan but were not implemented in the Moriches areas. The 1996 Comprehensive Land Use Plan was the town’s first comprehensive plan based on community planning initiatives; unprecedented community outreach efforts were made in the months leading up to the preparation of the plan. Eight individual community-based hamlet plans were developed and integrated into the overall plan: Based on the recommendations of the 1996 plan, in 1997 the Town Board, on its own motion, rezoned over 100 acres of commercial property town wide to a more restrictive zoning category that did not permit retail sales. In 2002, the Town Board again rezoned on its own motion over 900 acres of land town wide. A review of change of zone application logs since 1996 reveals there have been considerable private rezoning efforts as well. Although strip commercial property was represented on the 1996 land use map along every major transportation corridor, a concerted effort by the town to achieve and retain rural character was undertaken. In 2003, code amendments were enacted to rezone all J-3 (Commercial Center) lands to J-2 Business, and the L-3 Industrial category (Office Park) was eliminated. These amendments also promulgated new regulations regarding the interpretation of district boundaries, commonly known as the split-zone rule, that specified properties regulated by two or more zoning districts would conform to the standards of the more restrictive zoning district. Prior to 2003, the town’s zoning ordinance did not permit the type of pre-World War II downtown development realized in Port Jefferson and Bellport Villages. With the 2003 code amendments, the Town Board adopted development standards that prioritized the pedestrian experience and encouraged live/work developments in historic downtowns. Subsequent rezonings in conformance with adopted land use plans set the groundwork for this renaissance of main street development standards.

Past Plans (cont.) In 2007 the Town adopted the County Road 51 Corridor Based Land Use Study. Suffolk County Road 51, also known as East Moriches-Riverhead Road, is a major north-south thoroughfare between East Moriches and Riverhead. The focus of this study and land use plan is the southern five miles of CR 51 from Montauk Highway to the Southampton town line. This area is one of the last remaining active agricultural areas in the Town of Brookhaven. A significant increase in applications for residential development generated the need for this study. The study will help the Town effectively manage and direct future land uses, thereby promoting future development and land uses that are consistent with the community’s needs and reducing the likelihood of undesirable changes in suburban sprawl. In 2012 The Town undertook the Forget River Watershed Management Plan. The Plan was accepted by the Town of Brookhaven Town Board in March 2012. The Management Plan focused on the overall health and welfare of the waterway. The plan provided very broad and general land recommendations in order to provide for reduced nitrogen loading into the waterway. The plan recommends redevelopment and environmental restoration of the Jurgielewicz duck farm, acquire lands for open space, impose clearing restrictions and reduce nitrogen with alternative sanitary treatment systems and facilities.

Past Plans Analysis Over the course of all the study and examination of this Moriches area many proposed rezoning efforts were undertaken. Most notably in 1988 and 1989, multiple changes of zone proposals were offered for these areas. However, the vast majority of the proposals for these Moriches areas were withdrawn from consideration. As a result, the zoning pattern in the greater Moriches areas has remained the same as it had been for many years. The Town of Brookhaven 1987 Land Use Plan proposed to rezone approximately 75 parcels of land zoned J-2 Business, L-1 Industrial and K Business to a residential zoning category making up approximately 150 acres of land. The majority of these rezoning recommendations were withdrawn. In November of 2000, the Town Board adopted the Historic District designations for Moriches, Center Moriches, East Moriches and Eastport. The enactment of these historic districts along the Montauk Highway corridor appears to have controlled the appearance of the commercialization of the corridor by requiring strict architectural standards and review of all proposed development projects through the Historic District Advisory Committee (HDAC). The 2007 County Road 51 Corridor Based Land Use Study provided a recommendation to rezone property to more suitable classifications or promote the establishment of appropriate land uses on certain sites. However, with the exception of the Spadaro Airport site, detailed site specific rezoning recommendations were not provided. The 2012 Forge River Watershed Management Plan did not include any specific recommendations for rezoning. However, this plan does recommend reduced nitrogen loading to the waterway. Typically, the Town has used this type of analysis to upzone areas along stream corridors to a lower density residential zoning category. The vast majority of these plans and studies all point to very similar conclusions; reduce the amount of commercial development along the corridor and rezone in accordance with existing land use. Based on the overwhelming study and analysis of the Moriches, Center Moriches, East Moriches and Eastport areas the recommendations provided herein are reasonable and warranted and consistent with the previously adopted Town Plans.

Proposed Rezoning Analysis Working with the community to implement the hamlet plan recommendations, the Town developed a broad catalog of potential parcels of land that should be considered for rezoning. The catalog of parcels includes vacant and improved lands zoned J-2 Business or split-zoned J-2 Business and residential zoning category. Other lands include open space parcels and other sensitive lands along wetlands and waterways. The following analysis will help the Town of Brookhaven in its decision making by providing the specifics and rational for the proposed comprehensive zoning re-evaluation of the Montauk Highway corridor. Within the Moriches/Mastic area the lands identified for proposed rezoning include open space and single family residential areas along both sides of the Forge River and East Mill Pond along with the contributing areas north of the Sunrise Highway. The vacant and residentially developed J-2 Business zoned lands along Montauk Highway will also be considered for rezoning. Transitional areas will be established by using the J Business zoning district at key locations. Within the Center Moriches area, transitional areas become vitally important. Center Moriches enjoys a main street district and those areas are proposed for the J-6 Main Street Business District zoning. The areas along the eastern and western boundaries of the main street district will be considered for a J Business Zoning District. Other potential rezoning parcels include lands identified as developed with a single family residence. These lands will be considered for a residential zoning district. Sensitive lands along waterways and open space lands will be considered for low density residential zoning districts.

Proposed Rezoning Analysis (cont.) Within the East Moriches area transitional areas also become vitally important. East Moriches enjoys a very small and quaint main street district and those areas are proposed for the J-6 Main Street Business District zoning. The areas along the eastern and western boundaries of the main street district will be considered for a J Business Zoning District. Other potential rezoning parcels include lands identified as developed with a single family residence. These lands will be considered for residential zoning district. Sensitive lands along waterways and open space will be considered for low density residential zoning districts Within the Eastport area, open space lands will be considered for a low density residential zoning district. Commercial lands along wetlands and waterways will be considered for a residential zoning district. The following will provide a detailed analysis of the potential full build out of all of the commercial parcels along the Montauk Highway corridor for each of the four communities. Also included is an analysis of the potential full build out of the proposed main street business district areas in Center Moriches and East Moriches.

Proposed J6 Business Rezoning Analysis Center Moriches The existing main street area of Center Moriches runs along Montauk Highway from Canal Street to Railroad Avenue. The main street consists of 23 parcels of land zoned J-2 Business, equaling 6.69 acres of land. An additional 19 parcels of land are split zoned J-2 Business and A-1 Residence, equaling 4.30 acres of land. The Center Moriches main street area currently enjoys approximately 142, 000 square feet of commercial retail building area. The proposed J-6 Business Main Street Business District zoning includes 45 parcels of land equaling 13.89 acres of land. This area can support approximately 181,000 square feet of retail commercial building area. This estimated building area could be achieved with redevelopment or parcels and in-fill development of the existing main street area. Additional building area could also be realized with the addition of a sewer district for the area.
East Moriches The existing main street area of East Moriches runs along Montauk Highway at its intersection with Atlantic Avenue/Pine Street. The main street consists of 3 parcels of land zoned J-2 Business, equaling 0.43 acres of land. An additional 10 parcels of land are split zoned J-2 Business and A-1 Residence, equaling 1.60 acres of land. The East Moriches main street area currently enjoys approximately 41,200 square feet of commercial retail building area. The proposed J-6 Business Main Street Business District zoning includes 15 parcels of land equaling 4.02 acres of land. This area can support approximately 52,000 square feet of retail commercial building area. This estimated building area could be achieved with redevelopment or parcels and in-fill development of the existing main street area. Additional building area could also be realized with the addition of a sewer district for the area.

Rezoning Summary The proposed comprehensive zoning re-evaluation of the Montauk Highway Corridor for Moriches, Center Moriches, East Moriches and Eastport will greatly reduce the amount of future retail commercial development in these historic communities. The proposed rezonings also support and strengthen the existing commercial enterprises by focusing future development and redevelopment projects into the downtown/main street areas. Rezoning of these areas will help eliminate spot zones and split zones within the corridor. Rezoning of the sensitive lands along stream corridors and waterways will help protect the environment by reducing the overall residential density and thereby the amount of nitrogen-loading into the nearby waterways through new septic system development. The analysis revealed that the majority of the lands proposed for rezoning are either vacant or used for land uses other than retail commercial, not consistent with the existing J-2 Business Zoning District pattern found throughout the corridor. The analysis shows that the majority of the existing land uses found along the corridor could be sustained under a residential zoning district or a J Business Transitional zoning district. The analysis also shows that the parcels of land selected are proposed to be rezoned in accordance with their existing land uses. Further review of the analysis find that the potential build out of all of the J-2 Business zoned parcels would result in excessive retail commercial development that the areas cannot sustain and would result in retail commercial sprawl. This also would result in other irreversible impacts including significantly increased traffic generation, loss of natural vegetation and increased nitrogen loading to the nearby waterways. Residential upzoning along wetlands and waterways will reduce the number of new septic systems and should have a positive effect on the waterways and the environment.
