GENERAL RELEASE OF LIABILITY, HOLD HARMLESS, WAIVER AND INDEMNITY AGREEMENT In consideration of being allowed to enter upon the Land located off Highway 105 in Splendora, TX a/k/a Pagan Sandpit, Roger Pagan, Danny Pagan, Pagan Construction, their successors and or assigns as their interest may appear in regards to land ownership, (the “Property”) of and for the use of the facilities and equipment of the “PARTIES RELEASED” herein1, whether for personal, recreational or business use and while participating in, observing or engaging in any way in any recreational and/or business related activities including but not limited to, clay/skeet shoot event, and/or other related activities on the Property or adjacent to the Property or while in the process of coming to or leaving the Property, I do by these present for myself, my heirs, executors, administrators, and assigns, do hereby RELEASE, HOLD HARMLESS, WAIVE AND PROMISE NOT TO FILE A LAWSUIT OR MAKE A CLAIM OF ANY KIND, WHETHER FOR PERSONAL INJURIES OR DAMAGE TO PROPERTY AGAINST THE “PARTIES RELEASED” their officers, agents, servants, employees, successors and assigns from any and all actions, causes of actions, claims, demands, lawsuits, costs or damages of any kind arising out of, relating to or resulting from property damage, personal injuries or death sustained by me or my property while participating in observing or engaging in any way any recreational and/or business related activities including but not limited to clay/skeet shooting event, and/or other related activities. I further agree that for myself, my heirs, executors, administrators, and assigns, that I will HOLD HARMLESS, DEFEND AND INDEMNIFY THE PARTIES RELEASED, their officers, agents, servants, employees, successors and assigns, from any and all injuries, liabilities, lawsuits, damage, award or judgment of any nature incurred or suffered by me, my heirs, executors, administrators, and assigns or by the PARTIES RELEASED or any other persons, individuals or business entities of any kind or description claiming by through or under me or the PARTIES RELEASED as a result of any act, omission or failure including but not limited to the SOLE, JOINT OR CONCURRENT ACT OR ACTS OF NEGLIGENCE OR GROSS NEGLIGENCE OF THE PARTIES RELEASED, their officers, agents, servants, employees, successors and assigns, that occur on the Property, adjacent to the Property or while in the process of coming to or leaving the Property, whether caused by me or the PARTIES RELEASED, and which occur while participating in, observing or engaging in any way in any recreational and/or business related activities including but team roping event, and/or other related activities. I agree that I have not relied on any representation, promise or warranty of any kind made by the PARTIES RELEASED as to the safety of any conditions, equipment, premises or activities which I may encounter or which could occur while participating in, observing or engaging in any way in any recreational and/or business related activities including clay/skeet shoot event, and/or other related activities. BY SIGNING BELOW, I HAVE READ THIS AGREEMENT.

Clay/Skeet Shoot Event and related activities and recreational related activities and equipment includes but is not limited to the interaction with natural occurring or man made features or conditions on the property; the interaction with weather conditions; the interaction with wildlife, livestock, snakes or varmints as well as the use of lodging, storage, preparation or cooking facilities or equipment; the ingestion of alcohol, beverages or food; any and all types or kinds of firearms whether air, gas or pump operated; all types of archery equipment including crossbows; clay/skeet or trap targets or throws; ammunition of any kind; knives, machetes, chainsaws, implements of brush clearing equipment, jeeps, motor vehicles, motorcycles, golf carts, mini bikes, scooters, boats, jet skis, wave runners, trailers, three, four and six wheeled vehicles, all terrain vehicles, four wheel drive vehicles, specialty hunting vehicles, horses, dogs, blinds, stands, tri pods, towers, feeders, fences, calls, trans, cages.
