Under the Authority of the Declaration of Covenants, Conditions & Restrictions of Island West HOA, the Board of Directors approves and adopts the following Architectural Guidelines and establishes the Architectural Review Committee (ARC) to review and recommend action to promote and administer same.

The Architectural Guidelines are effective April 21, 2014.

GENERAL POLICIES Contains general provisions and guidelines applicable to all Units (as defined in IW Covenants) as well as specific provisions which vary among the Units according to location, use, or other factors. No exterior construction, alteration, addition, or erection of any nature, whatsoever, shall be commenced without prior approval. OWNERS, BUILDERS, CONTRACTORS, SUBCONTRACTORS, AND LAND-SCAPE PROFESSIONALS ARE TO OBSERVE THE COVENANTS AND ARC POLICIES, PROCEDURES AND GUIDELINES STATED IN IW DECLARATION OF CC&RS AND ENSURE ADHERENCE BY ALL SUB-SUBCONTRACTORS TO SAME. 1. The property owner is the ultimate responsible party. 2. Any owner may remodel, paint, or redecorate the interior of his or her Unit without approval. However, modifications to the interior of a Unit visible from outside the structure shall be subject to approval by the ARC. 3. Adherence to plans, as they are submitted and approved, is required. Revised plans clearly showing changes must be submitted and approved prior to site changes being made. NO EXCEPTIONS! 4. Renovation/addition plan approvals are dated and are effective up to twelve (12) months from the date of approval. Construction is to begin upon receipt of Notice to Proceed and is to be completed within 120 days following issuance of ARC Notice To Proceed. 5. Work at the site may not begin until Notice to Proceed and all applicable permits have been posted. 6. Work may be performed Monday through Saturday between 7:00AM and 7:00 PM. Noise or noxious behavior complaints from property owners will require the ARC or Security to shut down the job and a penalty will be imposed. Work is not authorized on Sundays and National holidays. 7. The project site is to be kept in a reasonably clean and uncluttered condition at all times. The entire area is to be free of debris at the end of each day. Daily penalties may be imposed and/or job may be shut down. No burning or dumping is permitted in Island West. 8. Materials must be stored on the building lot not the adjacent property. Access to building site by means of adjacent property is not permitted. If it is not possible to perform construction work without using common property for access, the applicant may request permission to do so from the ARC. Permission to use privately owned property must be obtained in writing from the owner and a copy provided to the ARC. Any damage must be repaired to its original condition. 9. Noxious or loud music or behavior will not be allowed on the construction site. No fishing or hunting by construction workers is permitted. No pets of construction workers or any persons not associated with the job shall be allowed. 10. Street pavement must be kept clean during construction. Costs of repairs and maintenance to offsite areas damaged in the construction process are the responsibility of the owner.

SCOPE OF ARC DECISIONS The Island West Covenants grant the ARC authority to approve or disapprove plans based on subjective or aesthetic judgments as well as on objective, quantitative grounds. This authority is limited only by the requirements that the architectural review process not be conducted in an arbitrary or capricious manner. It would be arbitrary or capricious, for example, for the ARC to apply substantially different standards to similar cases reviewed during the same period of time. ARC decisions are based on reasonable grounds consistent with the objectives of the covenants, including, but not limited to the following:        

Size (square footage, height, mass and scale); Siting of structures, including setback requirements; Aesthetic considerations of harmony and suitability of overall design including color and construction materials; Landscaping and preservation of significant trees or unique vegetation; Exterior lighting and drainage; Auxiliary amenities such as pools, decks, and sheds; Effect on neighboring properties; Appearance of the property from roads, golf courses, or walkways.

It is understood that any approval of a plan which, when built, is not considered desirable for future construction, it shall not be considered a precedent requiring the ARC to approve similar plans on subsequent submissions.

SUBMISSION PROCEDURES General 1. All applications, requests and forms are to be completed in their entirety and signed by ALL applicable parties. Administrative fees are due with initial submission of the documents. 2. All applications, plans and related documents must be submitted to the Island West management service by the 15th of the month, to ensure consideration in that month. 3. All plans and documents submitted to the ARC pursuant to these requirements and procedures become the property of the ARC. 4. All surveys shall have the seal of a South Carolina licensed land surveyor – no exceptions. Owners are required to submit plans professionally prepared by an architect or residential designer. For minor changes, clear, legible drawings prepared by the owner or contractor may be sufficient. The ARC or Board members shall determine if drawings are sufficiently clear and detailed. 5. The applicant or their representative may make a presentation at an ARC meeting. A written decision will be provided subsequent to the meeting. Verbal determinations shall not be rendered. 6. All documents specified on the application form must be submitted to the management service. Approval does not constitute permission to commence any work at the site until proper permits and the Notice to Proceed is posted. Revised April 21, 2014

……………………………………………………………………………………… Complete Submissions 1. Any submission that does not include all documents and signatures as cited on the relevant application form will not be considered. 2. Following approval of the project, the management office must receive: Copies of the applicable Beaufort County building permit, fully executed; and applicable Compliance Deposit fees before a Notice to Proceed will be posted. Construction Completion Date Construction is to begin following issuance of written Notice to Proceed, and completed within 120 days following issuance of the Notice to Proceed. Requests for any extension of a completion date must be received in writing by the Island West management service prior to such completion date. Extensions may be granted at the sole discretion of the ARC. Change Requests Change requests forms must be submitted for any change to approved plans: Revised plans clearly showing changes must be submitted and approved prior to site changes being made. NO EXCEPTIONS.

FEES REQUIRED Administrative Fee The IW Board has removed the requirement for an application fee. However, a fine in the amount of $250.00 will be assessed if no application is received and approved. Compliance Deposit 1. Two compliance deposits, (one from the homeowner; one from contractor) may be due after approval of the plans and prior to the issuance of any Notice to Proceed. Compliance deposits are determined by the ARC. Checks are to be made payable to Island West Homeowners' Association. 2. Compliance funds shall be retained by the Homeowners' Association pending satisfactory completion of a project in accordance with plans approved and in accordance with the covenants. 3. The compliance deposit is refundable except for any penalties assessed against it or as otherwise provided herein. 4. If a written request for the refund of the compliance deposit has not been received within 90 days after the date of the completion of the project, then such deposit shall become nonrefundable and retained by the Homeowners' Association.

PERMIT PROCEDURES AND REQUIREMENTS Beaufort County Building Permits; A copy of the applicable building permit is to be provided to the Island West Management Company. ARC Notice to Proceed Revised April 21, 2014

……………………………………………………………………………………… Once copies of the applicable building permit, applicable fees and deposits have been received by the Island West Management Company, a Notice to Proceed will be issued. No construction can commence until the Notice to Proceed is posted at the site. A penalty will be imposed if work is begun before the applicable permits and Notice to Proceed are posted at the site. Site Requirements 1. Roadways in Island West may not be obstructed by construction traffic. Orange cones should be used to alert passing cars of construction vehicles parked on the road. 2. Portable toilet facilities at work sites must be placed with the door facing away from the street and adjoining houses. Minimum setback from the street is 15 ft. Toilets should be kept clean and odor free and removed promptly at completion of construction. 3. Trash receptacles at work sites must have a minimum setback from street of 15 ft. Empty when full. Remove promptly at completion of construction. Full containers over a weekend or holiday are not permitted. NOTE: The Homeowners' Association has the right to contract for cleanup, at owner expense, should the contractor fail to maintain a neat and orderly work site. 4. The ARC reserves the right to require installation of a silt fence to guard against soil erosion or water runoff onto neighboring properties. 5. Place a builder's/architect's sign on the property, maximum size 4ft. by 4ft.; single faced only with sign face parallel to street; setback 10 ft. from street. 6. Post the applicable building permit and Notice to Proceed on area provided on or next to builder's sign. Height Restriction … 35 feet 1. Island West has a 35 ft. mean height restriction above finished grade within five (5) feet of house. Caution should be exercised to insure that the finished roof does not exceed this. The ARC may request, at their discretion, a height certified survey. 2. Maximum roof height allowed is 35 feet AMSL. Chimney height is left to the discretion of ARC. Exposed metal flues are not permitted. Prefabricated chimney flue caps shall be screened with a metal or other non-combustible material shroud. Inspections Interim: a) Throughout the construction period the site will be inspected by ARC members. Final: b) A final inspection will be conducted when the Island West Management Company has received from the owner/contractor a request for a final inspection. c) If plans do not match construction and subsequent inspections are necessary, subsequent inspections will be assessed at the discretion of the IW Board. Site Preparation and Maintenance 1. All underground utility locations are to be flagged prior to any clearing, grading or digging. The Underground Utility Damage Prevention Act of July 18, 1978 provides for a penalty of

at least $1,000 to the person doing the excavating if the utility involved has not been contacted. No trees of any kind above six (6) inches in diameter at a point four (4) feet above ground level may be removed without approval of the ARC and a posting of an ARC permit. Trees to be removed outside the building envelope must be designated on the site plan with the reason for the removal (e.g., dead, diseased, top missing.) All trees on the construction site must be protected against damage by orange mesh attached to 2 x 4 frame barricades, as close as possible to the tree's drip line, or a minimum of 5 ft. Mulch should be placed within the perimeter of the barricades. Under no circumstance should building materials, equipment or vehicular traffic or parked vehicles come into contact with trees on the site. Designate an area well away from trees for storage of building materials. Root compaction is to be avoided within the drip line of trees. Caution should be exercised when making grade changes around trees. Tree wells are encouraged. When clearing around trees, avoid use of heavy root raking equipment which may damage or destroy root systems, resulting in tree failure.

DESIGN REGULATIONS Rules & Regulations 1. Only one single-family residential unit, not to exceed three (3) habitable stories is allowed on each site. The finished first floor elevation must meet FEMA requirements. Refer to Island West Declaration of Covenants, Conditions and Restrictions, Exhibit C. 2. Exterior walls are to be of stucco, hardiplank, brick, or other approved material. Vinyl or aluminum siding is not acceptable. Window Treatments The exterior surfaces of all exterior window treatments, including hurricane protection devices, are to be compatible with and complement the exterior of the residence. Foundation The enclosure of a raised foundation must receive the same careful attention to detail and finishes as the main portion of the house. Foundation walls are to be stucco or similar material. Exposed wooden/round pilings are not acceptable. The raised foundation must be fully enclosed with a foundation wall or a combination of foundation wall, louvers, or the like. Lattice is not acceptable. Foundation wall openings (on all elevations) are to be of the same design and material treatment, including attached porches, stairs, decks, etc. The exterior wall of the raised foundation is to be of the same color as the remainder of the house or match other house trim. Grading and Drainage Grading and drainage shall be designed to ensure no storm water or roof water runoff is directed toward adjacent home sites or directly into marsh areas. Runoff should be directed into swales. The areas of the lot that may be filled are limited to the area immediately under and around the house and adjacent driveway area. This area should transition down to existing grade as soon as possible once beyond the budding line. It should be anticipated that natural law lying areas will Revised April 21, 2014

……………………………………………………………………………………… be preserved and that these low areas might retain water for several days following heavy rainfall. Cuts and fills should be designed to complement the natural topography. Grading should produce graceful contours, not sharp angles. Provide smooth transitions at the head and toe of the slope. The ARC reserves the right to require a certified drainage plan for any project. Easements Improvements by a property owner within an easement are subject to disruption by the owner of the easement and need not be replaced. Interior Remodel An ARC permit is required when placing a trash receptacle upon the property. Setbacks 1. Setbacks are measured from nearest vertical construction. 2. For minimum setbacks from respective property lines, check with the ARC. Garages / Carports 1. Carports are not permitted 2. A maximum of 3-car garage is allowed or 2-car garage with golf cart garage as part of same garage unit. 3. Boats, trailers, recreational vehicles, commercial and similar vehicles if stored in an enclosed garage cannot be exposed to view.

LANDSCAPE CHANGES One of the primary responsibilities of the ARC is to ensure the community is attractive and harmonious with the surrounding environment. Toward this end, the degree of attention and sensitivity shown in the landscape treatment of each individual lot becomes very significant. The ARC encourages a more maintained appearance with areas of lawns and shrubs. A condition of approval from the ARC to proceed with construction is the owner's agreement to implement the landscape plan submitted with the architectural drawings for the house. The intent of the landscape requirements is to enhance the building. Plans for any landscaping, grading, excavation or filling of lots must be approved by the ARC and conform to the following guidelines: 1. Landscaping plan will be drawn on a copy of previously approved site plan, will show existing plants and trees, and will indicate trees to be removed. Common name, size and mature size will identify new plants and trees. Building area shall not exceed 30% of the lot and a minimum of 60% of the lot shall be landscaped or in its natural state. The calculations of exact percentages are the responsibility of the landscape architect and will be clearly shown on the landscape plan. 2. All construction, including landscaping in street right-of-ways must be approved by the ARC. It is the responsibility of the homeowner to ensure lot landscaping includes street rightof-way to edge of pavement and to all property lines. Revised April 21, 2014

……………………………………………………………………………………… 3. In general, proposed plant material should be easily available, salt tolerant, unappetizing to deer, drought resistant and cold hardy. 4. A landscaping plan that uses rock or crushed rock as a predominant element will not be accepted by the ARC. 5. Any exterior changes in ground cover from biodegradable material to non-biodegradable hardscape for landscape beds must be submitted to the ARC for review. 6. Planting design: Lawn areas are encouraged in open areas around homes where sunlight is available for a good portion of the day. Otherwise, wooded areas should be preserved and enhanced by the selective introduction of ground cover and edge plantings. Plant material, berms, fences and walls should also be incorporated into the design of outdoor spaces for functional use such as to provide screening and privacy. At driveway entrances, for reasons of safety, no plantings which obstruct sight lines at driveway entrances (between 2' and 6' above streets and roadways) shall be permitted. 7. Tree protection: No tree with a trunk diameter measuring 6" or more at a distance of 4' above ground level (DBH) shall be removed or effectively removed through damage, without written approval by the ARC. The ARC may designate specific trees which must be protected through the clearing and construction phases with barriers erected at least 6' from the trunk of trees. 8. Walks, retaining walls or other hardscape improvements must be identified by material and dimensions including height above finished grade. 9. Exposed foundation walls on street-facing façade will be planted with a minimum of 5-gallon plants spaced to cover exposed wall in a maximum of 2 years. 10. All landscape improvements and sodded areas will be covered by an irrigation system. 11. Silt fences elsewhere required by these guidelines will remain in place and be properly maintained until the landscape inspection has been successfully completed. 12. Landscaping of lots adjacent to the golf course will be additionally required to landscape the areas of said lot adjacent to the golf course. If the plan calls for grass, the acceptable grasses are Fescue, Zoysa, Centipede or St. Augustine. However, St. Augustine and Centipede grass will not be permitted if contiguous to golf course turf. 13. The landscape plan is to be submitted with the application. 14. At final inspection, the ARC, in its sole judgment, will determine whether the landscape design intent has been met.

HOUSE COLOR SELECTION 1. When making improvements to an existing external structure, written approval of color selection is required prior to installation. Painting or staining may not take place until the Notice to Proceed permit has been posted. This includes repainting or re-staining a house the same color. a. If the owner is repainting and using the original color only notification is required. b. When choosing a new exterior paint color, please review the original approved color charts in Appendix A and B. The ARC will approve based on the color being in harmony with the original muted color scheme. The listed color charts are for Sherwin Williams paints but similar colors from other suppliers are acceptable. c. For exterior trim all homes have the Sherwin Williams SW 2123 White or comparable. d. Only Flat or Satin finish is acceptable. Revised April 21, 2014

……………………………………………………………………………………… 2. "Chips" of all new color selections, including picture of and selection for front entry door, need to be labeled and submitted for approval. All stucco color selections are to be submitted on stucco. A "chip" is not acceptable.

MAILBOXES AND HOUSE NUMBERS All mailboxes and mailbox posts shall be the style, material and color originally provided. House numbers will be part of the approved mailbox assembly. House numbers are required on the structure of the house and must be readable from the street. House numbers may not be painted on the curb.

TREE REMOVAL 1. An ARC Permit is required for the removal of trees above six (6) inches in diameter at a point four (4) feet above ground level. The property owner and tree surgeon must sign the application. When the trees have been marked and the application document and fee received by the management office, an inspector will visit the site and the removal request considered. If approved, a permit will be posted. If the removal is not approved, the property owner will be notified. Work may not commence until a Notice to Proceed is posted at the site. 2. The ARC may require replacement of any tree approved for removal. Type and size of replacement will be at ARC discretion. The desire of the Association is to have the number of trees in Island West remain relatively constant over time to retain the current pleasant atmosphere.

FENCES, SERVICE YARDS AND WALLS Fences & Walls 1. Fence plan will be drawn on a previously approved site plan. 2. Plan will show elevation of one section of fence. 3. Maximum fence height is 6' above grade. Wooden fences are not allowed. a. Black aluminum may be approved by the ARC on any lot, and is the only fence permitted on golf course lots at a height not to exceed 4'. b. 6' high privacy fences that consist of a 5' solid panel section and a 1' lattice accent may be permitted by the ARC on lots with wooded views. c. Any lot that is exposed to multiple views from other homes may submit their request for ARC review and consideration. 4. Walls and fences may be approved provided they are attached to or within 4' of the house as an architectural extension. Deer fences are not acceptable. It is desired that each owner consider that deer live on the property when planting their landscaping and use plants which will be less attractive to deer. Service Yard 1. Service yards should be designed to complement the house. Lattice or similar see-through material is not acceptable. Overlapping siding, stucco or louvers are acceptable. 2. Landscaping around the perimeter of the service yard is required. Revised April 21, 2014

POOL AND SURROUNDING DECK 1. Pool/surround deck setback must be within property setback lines, unless approved by Beaufort County 2. Pool equipment, including heaters, tools and chemicals are to be located in an enclosed service yard. Underground propane tanks must be located outside the service yard, but must be a minimum of 10' from the property line. Pool backwash/ drain hose is to be located in such a manner as to assure that water remains on owner's property. Flexible/collapsible surface hoses are not acceptable. Pump motor location is to provide minimal noise disturbance to adjoining properties. Propane tanks must meet the requirements of the NFPA Document 58, administered by the office of the South Carolina Fire Marshall. 3. The ARC reserves the right to require complete landscape upgrade if the property does not meet current guidelines. Landscaping for pool additions should complement or enhance the existing property and should provide for landscape planting beds between the house/raised decks and pool deck to allow adequate foundation plantings to screen and soften the mass of the house. 4. Outside Pools must be fenced and the fence must be a minimum of 4' height. Gates and doors must be self-closing and latching. Enclosed pools with a screened lanai are acceptable. 5. A site plan showing exact location and complete construction details including waterfalls, raised spas, construction materials along with a landscape plan are required. 6. Siting of pools will be reviewed on a case-by-case basis. 7. Top of pool construction may not be over two (2) feet above existing grade unless integrated into terraced construction with ARC approval.

HOT TUBS AND SPAS Hot tubs and spas must meet setback requirements and be adequately landscaped. An applicable permit is required. Work may not begin until Notice to Proceed is posted.

DECKS, PATIOS AND TERRACES 1. The design of decks, patios and terraces must be coordinated with the design of the residence. These spaces add a great deal to the outdoor "livability" to a home and can provide a high degree of privacy when bordered by dense natural vegetation and/or appropriate landscaping. 2. Grade-level patios and decks are subject to the same setback requirements as swimming pool decks.

ROOF REPAIR AND REPLACEMENT When replacing the roof on an existing residence, ARC approval is required prior to installation. This applies even if the roofing color and material are not to be changed. It is the desire of the ARC to adhere to the original roofing shingle color and style installed. An application for reroofing must be completed, appropriate fees paid, and a Notice to Proceed posted before reroofing can begin. Revised April 21, 2014

……………………………………………………………………………………… Repairing a roof on an emergency basis only requires notification of the IW Management Company.

AWNINGS 1. Awnings may only be installed on the rear of residences, with ARC approval. 2. Only fade-resistant, solid color fabric awnings may be installed. Awning color should be compatible with the exterior colors of the house.

FLAGPOLES Flagpoles are permitted but not within 20' of the curb line, with a maximum height of 20' above natural grade.

EXTERIOR LIGHTING (FIXED) 1. All exterior lighting must be approved by the ARC prior to installation. 2. Location of all exterior lighting and type of fixtures shall be shown on the site plan and elevations. Cut sheets should be furnished coded to their location on the plan. 3. All exterior lighting shall be installed so as not to disturb neighbors or street traffic. 4. Exterior lighting may be provided to illuminate driveways, walkways and entryways, or to highlight landscape features. Such lighting shall be of low intensity.

YARD PLAY EQUIPMENT Basketball Backboards 1. A single, portable, backboard may be installed at a residential home site with ARC approval. 2. The continued general clean and neat appearance, maintenance and upkeep of the basketball backboard and surrounding area are the responsibility of the respective homeowner. Play Structures 1. The placement and use of play facilities on a residential home site must be approved in advance by the ARC. 2. An aesthetically pleasing playhouse may be placed in the rear yard of a residence provided it is not visible (or is landscape screened) from streets, neighboring houses, and where applicable, adjoining golf course fairways and lagoons. Minimum setbacks from the rear and side property are 20'. Color of playhouse is to be neutral earth town/color and is to blend with its surroundings. 3. A gym set (with swings, slide, etc.) may be placed in the rear yard provided it is a stained/varnished wooden structure to blend with surroundings and is not visible (or is landscape screened) from streets, adjacent homes and golf course/lagoons. Minimum setbacks from the rear and side property lines are 20'. Gym sets that are not wooden structures must be specifically approved by the ARC.

……………………………………………………………………………………… Trampolines 1. Placement of a trampoline requires ARC approval. 2. The trampoline must be maintained in good repair, i.e., no rusted frames; no torn netting. Tree houses Tree houses, tree stairs or platforms or any other structure in or on a tree are not permitted.

PENALTIES The ARC has the right to impose penalties for failure to comply with its policies and decisions. The amounts of such penalties are established and modified by the IW Board at its sole discretion. Penalties may be deducted from the compliance deposit upon notice to the owner. Retention of the total compliance deposit shall in no way relieve the owner of further liability. Penalties will be imposed for, but not limited to, the following: 1. Failure to submit an application will be subject to a fine of $250.00. 2. Failure to construct the project in accordance with approved plans. 3. Failure to complete construction by the completion date. 4. Tree removal without a posted ARC Notice to Proceed. 5. Painting/staining exterior without a posted ARC Notice to Proceed. 6. Use of exterior materials/colors not approved by the ARC. 7. Failure to submit an as-built survey, where applicable. 8. Failure to submit height survey, where applicable. 9. *No trash receptacle on site 10. *Failure to deposit trash in receptacle. 11. *Overflowing trash receptacle. 12. No portable toilet on site, where applicable. 13. Failure to barricade trees as required or inadequate barricades. 14. Use of privately owned property (adjacent home sites or lots) without providing the ARC with prior written permission from the owner 15. Use of water/electricity from neighboring properties. 16. Failure to install approved landscape/drainage plan. 17. Legal or other expenses incurred. Fines: The IW Board may levy fines for violations of the Rules of Island West, and its decision shall be final. A violation will be considered a separate offense for each day the violation is permitted to remain uncorrected. Fines will be deducted from the refundable deposits. *The IW Board has the right to contract for cleanup should the contractor fail to maintain a neat and orderly work site. Cost of such cleanup will be deducted from the contractor's compliance deposit.

……………………………………………………………………………………… REPEAT OFFENDERS OF THE ABOVE RULES AND GUIDELINES WILL INCUR HIGHER PENALTIES FOR THESE OFFENCES. ANY HIGHER PENALTIES WILL BE DETERMINED BY THE ARC.

APPEAL PROCESS An applicant may appeal an ARC decision by submitting a written request to the Island West management service. Such request for appeal must be received within 30 days following written notification of the ARC's decision. The request will be forwarded to the Island West Homeowners' Association Board of Directors to hear the appeal and render a decision. The decision of a majority of this body will be final and binding on the ARC, the owner and all other parties.

REVISIONS These policies, procedures and guidelines are subject to periodic revision and modification. THE ARC RESERVES THE RIGHT TO REQUIRE ADHERENCE TO THE ABOVE GUIDELINES THAT, IN ITS SOLE JUDGMENT, HAVE NOT BEEN FOLLOWED.
