BLAINE COUNTY SCHOOL DISTRICT #61 FIELD & PARKING LOT USE TERMS AND CONDITIONS In consideration of the School District granting permission to use its school facility as requested herein, applicant hereby agrees with the School District as follows: 1. Applicant shall be solely responsible for loss or damage to property or injury or death of any person or persons arising out of or connected in any way with the use of School District facilities by the applicant. 2. Applicant accepts the facilities, including the premises and equipment, in the condition then existing, and expressly releases the School District, its directors, officers, agents, employees and representatives, from any and all claims, damage, loss, expense or causes of action or causes of suit, arising out of or resulting from the use of the facilities by the applicant. 3. Applicant hereby agrees to indemnify and hold harmless the School District, its directors, officers, agents, employees and representatives from and against any and all claims, damage, loss, expense, injury or death and from all causes of action or causes of suit, arising out of or connected directly or indirectly with the use of the facility by the applicant. 4. Applicant shall pay the usual fees and charges applicable to such use as established by the School District 5. Applicant shall reimburse the School District for all damages to the premises or property resulting from such use other than ordinary wear and depreciation. 6. Applicant agrees to conform to all rules and regulations of the School District and the acknowledgment that we have a drug, alcohol, vaping and tobacco free environment. 7. Applicant shall provide adequate supervision and shall be responsible for any improper conduct of the audience, both individually and collectively, while on School premises or utilizing the District facilities. 8. In addition to the use fees the renting party of the facility will also be responsible for the following:  A custodian is required to unlock, supervise, clean and lock the stadium field when it is being used outside of normal custodial work hours. The applicant will be billed by the School District at a rate of $35.00 per hour. This applies to all users.  Providing at their own cost the rental of additional restrooms needed for the event  Providing at their own cost additional trash containers, trash pick-up and removal  Ensure that BCSD policies concerning drug, alcohol, vaping, tobacco and firearms are adhered to by all attending the event and clean-up after pets and livestock  Obtain a letter of permission from the Community Campus Manager before operating any and all concessions on School District property or obtain a license from the City of Hailey if operating a concession on city controlled land or streets 9. Applicant agrees that the use of the facilities and this permit shall be revocable by the School District at any time at the option of the School District. 10. If your event is approved and is a non-school sponsored activity, a certificate of liability insurance for $1,000,000 with endorsement naming Blaine County School District as additional insured must be provided to the District prior to any use of facilities. The District reserves the right to waive the liability insurance. Categories for Users: Category I – BCSD events, athletics, meetings & school sponsored activities Category II – Non-Profit Groups/Organizations & Governmental Organizations Non-Profit groups will need to provide proof of 501(c)(3) status Category III – All other Individuals & Groups
