2015 CELLA Student Agreement The following is an agreement between Cebu English Language Learning Academy (‘CELLA’) and students. Please make sure that you understand and agree to be bound by the terms and conditions as stated in this agreement. 1.
REFUND & CANCELLATION POLICY 1.1 Requests for refunds must be made in writing to the Director of CELLA or representatives. 1.2 The enrolment fee, material fee, airport transfer service fee, SSP, I-CARD and visa fees are non-refundable. 1.3 All refunds will be paid to the person who has entered into the contract with CELLA, unless the person gives a written direction to pay the refund to someone else. Refunds will be processed and paid within four (4) weeks of the receipt of the written notification. Bank charges are deducted from refunds made by overseas electronic transfer or bank draft. 1.4 If student enrolls for 4 weeks or less, no refunds will be given. 1.5 If student enrolls for 5 weeks or more, 50% of the remaining course fee will be refunded except dormitory fee. Reduce of schedules is considered the same as cancellation. 1.6 For cancellation made after 50% of the course completed, no refunds will be given. 1.7 Any course or dormitory changes, 50% of the difference fee (course or dormitory) will be refunded. In addition, TESOL to another course change, 80% of the difference will be refunded. 1.8 Tuition fees (Course and Dormitory fee) are not transferable to other institutions or other students. 1.9 No refund will be given to students who are expelled for breaching the CELLA’s policies and rules.

ACADEMY AND DORMITORY RULES 2.1 CELLA has rules that must not be violated. These rules may apply to academy as well as life in dormitory. 2.2 For the details, refer to the notice board at Academy and Dormitory. It is your responsibility and mandatory to be aware of the contents of the notice board and check regularly for updates. 2.3 If a student’s behavior is deemed inappropriate by the academy’s standards, students will receive warning. If inappropriate behavior continues, students will be expelled. Depending on the severity of the situation, students may be expelled immediately without warning! In such cases no refund will be given. 2.4 A security deposit is required and normally this deposit is returnable at the end of the study period but some or all of the deposit may be withheld to compensate for damage or loss of inventory. The Director of CELLA or his/her nominees have the right of access to dormitory at all reasonable times to checks for loss or damage etc.

DISMISSAL POLICY Any of the following may cause immediate dismissal or progressive discipline:
3.1 Excessive absenteeism (below 50% attendance) 3.2 Any illegal activities including stealing, gambling, drug abuse/misuse, defamation, protest, etc. 3.3 Any act that may endanger others (i.e. intoxication, harassment, threatening behavior, etc.) 3.4 Any act that may nuisance to others (i.e. damage to the property, making noise, bringing pets, etc.) 3.5 Failure to follow safety policies and procedures (i.e. other sex room access, curfew time, bringing and/or drinking alcohol and smoking in dormitory, using burner and others that concern with fire, etc.)
3.6 Students must pay all fees in accordance with official price. If anyone who did not pay official price or those students disclosing information about discount from the agency, the student will be expelled by CELLA.

DISCLAIMER 4.1 CELLA has the right to alter its fees and conditions, cancel or defer its courses and alter class timetables and contact hours at any time without notice. 4.2 CELLA reserves the right to expel a student who does not adhere to the discipline code of the school. In such cases no refund will be given. 4.3 CELLA will not be held liable for any loss, damages, death, illness or injuries to people or property which occur whilst students are on any activity or excursion organised by themselves or CELLA. It is students’ sole responsibility to take out comprehensive travel, accident and medical insurance against such risks. 4.4 In the unlikely event (inevitable accident, natural disasters, war, business conflict and anything the Academy can’t deal with), CELLA will not be held liable for failure to deliver the courses and service. 4.5 CELLA has the right to replace the class teacher (The native speakers also can be replaced by Filipino teacher) without compensate and notice due to the resignation, absences, vacation leave, tardiness, and labor dispute.
I have read the Refund & Cancellation Policy and agree to abide by these terms, also I understand that I could be expelled under the Dismissal Policy.
