SCHOOL-BASED POLICY OF FIORELLO H. LAGUARDIA P.S. 205 FOR USE OF CELL PHONES, COMPUTING DEVICES, AND PORTABLE MUSIC AND ENTERTAINMENT SYSTEMS ON SCHOOL PROPERTY Students are permitted to bring the following electronic items to school: 1) cell phones; 2) laptops, tablets, iPads and other similar computing devices (“computing devices”); and 3) portable music and entertainment systems, such as iPods, MP3 players, PSP, and Nintendo DS. A.

The use of cell phones, computing devices and portable music and entertainment systems at school is subject to the conditions below. 1. Cell phones, computing devices, portable music and entertainment systems must be stored out of sight. 2. Students shall be personally and solely responsible for the security of electronic devices brought to school. The school shall not assume responsibility for theft, loss, damage, or unauthorized calls made with an electronic device. If devices are loaned to or borrowed and misused by non-owners, device owners are jointly responsible for the misuse of policy violation(s). 3. Cell phones, portable music and entertainment systems may not be turned on or used during the administration of any school quiz, test or examination. 4. Computing devices may not be turned on or used during the administration of any school quiz, test or examination, except where such use has been explicitly authorized by the school or is contained in an Individualized Education Program or Section 504 Accommodation Plan. 5. Cell phones, computing devices, and portable music and entertainment systems may not be turned on or used during school fire drills or other emergency preparedness exercises. 6. Cell phones, computing devices, and portable music and entertainment systems may not be used throughout the school building (classrooms, bathrooms, hallways, stairwells, lunchroom, community room, library, main office, nurses office) without consent of a teacher or administrator. 7. Students who use cell phones, computing devices, and/or portable music and entertainment systems in violation of any provision of the DOE’s Discipline Code, the school’s policy, Chancellor’s regulation A-413, and/or the DOE’s Internet Acceptable Use and Safety Policy (“IAUSP”) will be subject to discipline in accordance with the guidance interventions and disciplinary responses set forth in the Discipline Code.

B.

Cell phones, computing devices, portable music and entertainment systems, may be used as set forth below (select from bullets below or select other options consistent with Regulation A413). During the school day:

Cell phones, computing devices, portable music, and entertainment systems may not be turned on or used while on school property. Cell phones may be used to notify parents or guardians upon student arrival and departure. Cell phones, computing devices, portable music, and entertainment systems may not be turned on or used during instructional time, except for instructional and educational purposes with the explicit approval of the teacher. Camera or audio recording functions of electronic devices is strictly prohibited on school premises at all times.

During after-school, school-sponsored programs or activities: 

Cell phones, computing devices, portable music, and entertainment systems may be turned on or used during after-school, school-sponsored programs, or activities with the explicit approval of the teacher.

Confiscation and return of electronic items If students are seen using an electronic device, the following measures will be instituted in a progressive fashion. 1. The First Violation: Verbal warning to student to be noted by teacher and initialed by student. 2. The Second Violation: Verbal warning to student and parent notification of policy violation. 3. The Third Violation: Confiscation of item, parent notification and return of electronic at end of school day to student. Teachers will send confiscated electronic devices to an administrator. 4. The Fourth Violation: Confiscation of item, parent meeting and return of electronic at the end of the school day to student. Teachers will send confiscated electronic devices to an administrator. 5. The Fifth Violation: Revocation of privilege to bring item to school for the remainder of the school year.
