The Phnom Penh Municipality issues a guideline as below: I.
Objective This sub-decree aims at providing 12.44 hectares of state land to the people who are living in Boeung Kak located behind the Ministry of Information, west of Calmette Hospital, and west of French Embassy, in Village No. 6, 20, 21, 22, 23 and 24, in Srah Chak commune, Khan Daun Penh of Phnom Penh, for on-site development by occupants; it means that [the state] provides title to the households on the land where they are living and holding, the state will pay the transferring tax on their behalf. The remaining, 114.41 hectares, will be developed according to the master plan which was agreed and approved by the Phnom Penh Municipality. After receiving the land title, the households can build their own house in complying with the existing legal framework on the construction.
II.
Implementation Process For effective implementation of the sub-decree 183 dated 11 August 2011 on the adjustment of the size of the Boeung Kak Lake, the Phnom Penh Municipality has assigned as below: - Set up a committee consisting of Mr. Chhay Rithysen, Director of Phnom Penh Department of Land Management, Urban, and Construction, and necessary numbers of technical officers to register 12.44 hectares of land to be the property of the households of Boeung kak lake from now on. - The committee has to start their work from this signing date. - This committee has to take the state land title no. 12021001-0014 dated 26 September 2010 with consisted of 126.85 hectares and cut off 12.44 hectares following the cadastral procedure for the people who live at the place which is mentioned above to each family according to the size that they have, and to keep appropriate public space for roads, sewages, and other existing public spaces, and the social safe of the area following the guideline of the Phnom Penh Municipality. The long term lease No. 0082 dated 04 November 2010 must be revised by leasing only 114.41 hectare. - The people who are living in the 12.44 hectares have to:
1. Participate in implementing this sub-decree by preparing their documents such as document that certify their holding land and house, civil status documents, Khmer ID, and family record. 2. Collaborate and facilitate with the Phnom Penh technical officers to measure the land and register it according to the cadastral procedure by 30-day public display of household lists and maps which have been measured. Receiving this guideline, the relevant authorities and the people have to pay attention to implement this [sub-decree] effectively from the date of signature.
