Constitution, Bylaws, and Regulations of Eagle Harbor Township Volunteer Fire Department Eagle Harbor, MI 49950-9722 ARTICLE 1. - ORGANIZATION Section 1. Name This organization shall forever be a non-profit voluntary association known as the EAGLE HARBOR TOWNSHIP VOLUNTEER FIRE DEPARTMENT (EHTVFD).
Section 2. Purpose The purpose of the EHTVFD is to safeguard the lives, property, and resources of the Township by providing fire fighting and fire rescue services.
Section 3. Members These Bylaws represent volunteer members of the EHTVFD. All members shall be governed by these Bylaws.
Section 4. Code of Laws The Bylaws as set forth herein shall govern this organization. In addition, the EHTVFD shall observe all applicable laws of the State of Michigan and Eagle Harbor Township.
ARTICLE 2. - OFFICERS Section 1. Fire Chief Appointment The Township Board will appoint the Fire Chief for Eagle Harbor Township. The appointed Fire Chief will serve until resignation or until relieved by a majority vote of the Township Board.
Section 2. Other Officer Appointments The Fire Chief will appoint one or more Assistant Fire Chiefs and other officers for Equipment, Training, and other responsibilities as necessary.
Section 3. Fire Chief Command 3.1 The Fire Chief shall be in command of the Department and Station subject to the laws of the State of Michigan and the laws and insurance underwriting requirements of Eagle Harbor Township. 3.2 As long as the Station is a part of the Town Hall building, the Eagle Harbor Township Board, by majority vote, reserves the right to use the Station when and as needed and furthermore assumes full responsibility for the Station and its use for the approved time duration.
Section 4. Fire Chief Responsibility The Fire Chief shall be responsible for the general condition and efficient operation of the station, the training of its members, and the performance of all other duties imposed upon him/her by statute. Revision 1.5

Section 5. Attendance The Fire Chief shall make every effort to attend all fires and drills and to direct the other officers and members in performance of their duties.
ARTICLE 3 - MEMBERSHIP Section 1. Residence The membership shall consist of residents of Eagle Harbor Township and/or any person residing in close proximity to the Township.
Section 2. Membership Membership is at the discretion of the Fire Chief and can be terminated at will.
Section 3. Active Status 3.1 Members status is at the discretion of the Fire Chief. 3.2 Members who have proper certification and members in training are considered on the active duty roster unless specifically removed by the Fire Chief. 3.3 Members not on the active duty roster are considered inactive members.
Section 4. Attendance Any member missing meetings or drills excessively without reasonable excuse to the Fire Chief can be removed from the active duty roster.
Section 5. Resignation Any member who does not wish to continue, or who is unable to continue as a member, shall present their resignation in writing to the Fire Chief.
Section 6. Auxiliary An Auxiliary may be formed from other members of fire fighter families and other local citizens to assist the Fire Department in other non-fire fighting enterprises such as fund raising, social activities, and providing food and beverage at fire scenes or practices. Other duties may be assigned at the discretion of the Fire Chief.
ARTICLE 4 - DUTIES OF MEMBERS Section 1. Chain of Command It is the duty of all members to take instructions from the Fire Chief or from any other officer or member vested with the power of authority as set forth in this Constitution and Bylaws.
Section 2. Attendance It is the duty of all members to attend all meetings and drills. In the event a member cannot attend a meeting or drill, he/she shall make every effort to notify the Fire Chief or an officer prior to the meeting or drill.
Section 3 Certification It is the duty of all members to attain appropriate and proper professional certification and maintain it while on the active duty roster. Revision 1.5

Section 4. Bylaws It is the duty of all members to read the Bylaws and be familiar with them.
ARTICLE 5 - DEPARTMENT FUNDING Section 1. Annual Budget The Fire Chief is responsible for presenting a consolidated proposed budget to the Township Clerk as directed by the Township Board.
Section 2. Resources The Fire Department provides for training, equipment, and supplies as needed under the budget and presents invoices to the Township Clerk for monthly approval and payment by the Township Board.
ARTICLE 6 - EQUIPMENT Section 1. Ownership All apparatus and equipment is the property of Eagle Harbor Township, and is operated and maintained under the jurisdiction of the Eagle Harbor Township Volunteer Fire Department.
Section 2. Equipment Use 2.1 No person shall use any fire apparatus or equipment for any private purpose unless this use will be of benefit to the Fire Department, and then only with the approval of the Fire Chief. 2.2 Non-department members are not authorized to use any fire equipment or to drive/ride in department vehicles.
Section 3. Scope of Emergency Response Fire apparatus is not to respond to fires outside of Eagle Harbor Township unless a Mutual Aid Pact or Contract has been approved by the Township Board or at the discretion of the Incident Command Officer.
ARTICLE 7 - MEETINGS AND DRILLS Section 1. Program The Fire Department will conduct at least monthly business meetings and training sessions according to a schedule determined by the Fire Chief or his/her delegate.
ARTICLE 8 - AMENDMENTS Section 1. Repeal of Prior Bylaws All Previous Bylaws and amendments thereto are hereby repealed.
Section 2. Approval This Constitution and Bylaws may be amended or changed with approval by a majority vote of the Township Board.
