EMPLOYMENT AND WORKPLACE LAW CERTIFICATE PROGRAM FALL 2016 – SPRING 2017

A complex and ever-changing set of federal and state laws govern the American workplace. Union representatives, labor relations professionals, and attorneys must understand the ways in which these laws interact with collective bargaining agreements. The Employment and Workplace Law Certificate Program will address the following issues: •When is unequal treatment actually illegal discrimination and harassment? •What rights to accommodation at work do disabled union members have? •Under what conditions is a member entitled to family and medical leave? •What rights do union members have when they are injured on the job? •How do First Amendment rights apply in employment? •What rights does one have for privacy at work? •How is social media impacting the workplace?

Fall 2016 Semester Workplace Discrimination and Harassment I Thursday, September 15th, 9 a.m. to 4 p.m. Instructor: Lisa Schur This course will cover the federal and New Jersey state laws prohibiting disability, gender, and race discrimination and harassment. Topics will include legal definitions of disability, legal requirements of reasonable accommodation, what constitutes disparate treatments on the basis of gender and race, and other issues of special concern to union representatives.

Public / Private Sector Arbitration Thursday, November 10th, 9 a.m. to 4 p.m. Instructor: Steven Weissman This course is designed to increase the practitioner’s skills in preparing for and presenting public and private sector grievance arbitration cases. Major subjects discussed include preparing for arbitration, the hearing, presenting a case, standard for just cause, evidence, criteria for contract interpretation, remedies, the arbitration decision, and different arbitration systems.

Social Media and Workplace Law Friday, October 14th, 9 a.m. to 4 p.m. Instructor: Carla Katz Social media has transformed the ways in which we communicate at home and work. This workshop will examine how social media has impacted the workplace and employment relations generally. We will discuss the burgeoning case law resulting from the NLRB social media cases and review examples of leading U.S. Supreme Court cases that outline the scope of protections afforded to employees under the First Amendment.

Workplace Discrimination and Harassment II Thursday, December 8th, 9 a.m. to 4 p.m. Instructor: Ursula Leo This course will examine laws that prohibit workplace discrimination on the basis of national origin, citizenship, and religion. The course will also cover the issue of workplace bullying – latest legislative development, how to negotiate collective bargaining agreements that protect employees against it, and the technological impact of harassment claims. .

Spring 2017 Semester Immigration Law and Issues Friday, January 20th, 9 a.m. to 4 p.m. Instructor: James Cooney This course will cover basic immigration law topics, including U.S. Citizenship, Lawful Permanent Residency, Non-Immigrant Status, Removal/Deportation, Employment Verification, rights of and remedies available to immigrant workers, and issues commonly confronted by representatives of immigrant workers. Rights to Privacy and Employment Testing Thursday, February 23rd, 9 a.m. to 4 p.m. Instructors: Rosemarie Cipparulo This workshop will examine the issue of rights to privacy in the workplace and employment testing. The topics include drug tests, background and credit checks, use of computer and communication devices, GPS monitoring, biometrics, medical records, and more. The workshop will equip participants with knowledge and skills that enable them to represent their members effectively in discipline and discharge grievances related to privacy issues and how to negotiate collective bargaining agreements that protect members’ privacy. Workplace Retaliation and Whistleblowing Friday, March 10th, 9 a.m. to 4 p.m. Instructor: James Cooney This course will cover worker protections from retaliation under the Constitution and various labor and employment laws, including “whistle blower” statutes. Topics will include discussion of legallyprotected activities, procedures for filing claims, and a survey of relevant court decisions.

Workplace Investigations and Interviews Friday, March 24th, 9 a.m. to 4 p.m. Instructor: Carla Katz This course will cover the most common types of workplace investigations and investigatory interviews and review the rights of employees, employers, and union shop stewards during those investigations. Topics discussed will include Weingarten rights and the rights of the representative in those meetings, Loudermill due process rights prior to termination, and public employee Garrity rights against self-incrimination. The course will also review the union Duty of Fair Representation and management’s due process obligations. Other topics discussed will include discrimination investigations, workplace violence, privacy issues in investigations, drug testing, searches at work, false imprisonment, and personnel files. Workers’ Compensation Thursday, April 13th, 9 a.m. to 4 p.m. Instructor: John Burton This course will examine the New Jersey workers’ compensation law, which provides cash and medical benefits to workers who are disabled by work-related injuries and diseases. Topics include employee coverage, compensable injuries and diseases, procedure to ensure payment, and workers’ abilities to sue employers for damages.

Program Faculty Employment and Workplace Law Certificate Program classes are taught by full-time and adjunct faculty of the Rutgers School of Management and Labor Relations and experienced legal experts. Each instructor brings an extensive background in consulting and training for labor and management relations, in both the public and private sectors. John F. Burton, Jr., Ph.D. Professor Burton received his Ph.D. degree in Economics from the University of Michigan. He is a former Dean of the Rutgers University School of Management and Labor Relations, and Professor Emeritus at Rutgers and Cornell University. He co-authored A Workers’ Guide to The New Jersey Workers’ Compensation Law, which will be used in his Workers’ Compensation Law course. Rosemarie Cipparulo, Esq., J.D. Professor Cipparulo received her J.D. degree from the Rutgers University School of Law in Newark. She is a faculty member in Labor Studies and employment relations in the school of Management and Labor Relations at Rutgers University. She is an attorney at Weissman and Mints and has a wealth of experience in representing labor unions in collective bargaining and alternative dispute resolutions. She was a member and leader of the International Union of Painters and Allied Trades. James M. Cooney, Esq., J.D. Professor Cooney received his J.D. degree from University of Miami School of Law. He is a faculty member in Labor Studies and Employment Relations in the School of Management and Labor Relations at Rutgers University. Professor Cooney also is an experienced arbitrator and mediator. He specializes in employment, labor, and immigration law, and he previously represented labor organizations throughout New Jersey.

Carla Katz, Esq., J.D. Professor Katz received her J.D. degree from Seton Hall University School of Law. She is a faculty member of the Department of Labor Studies and Employment Relations in the School of Management and Labor Relations at Rutgers University. She is also Of Counsel with Cohen Placitella & Roth. She specializes in labor, employment, and public sector law. Professor Katz is also a former elected President of a local union of the Communications Workers of America (CWA), and a former Commissioner of the NJ Public Employment Relations Commission. Ursula Henrich Leo, Esq., J.D. Ms. Leo received her undergraduate degree from University of New Mexico, and her law degree from Syracuse University College of Law, cum laude. Ms. Leo focuses her practice on Land Use, Municipal, and Labor and Employment matters. Ms. Leo is an attorney at Laddy, Clark and Ryan, LLP. Lisa A. Schur, Esq., J.D., Ph.D. Professor Schur received her J.D. degree from Northeastern University and Ph.D. degree in Political Science from University of California at Berkeley. Dr. Schur is an Associate Professor in Labor Studies and Employment Relations in the School of Management and Labor Relations. She also is an attorney and a leading scholar in disability and employment law. Steven Weissman, Esq., J.D. Rutgers School of Law, Newark Mr. Weissman, of Weissman & Mintz, LLC, specializes in employment related matters. A published author, he has been a bencher for the Reitman Inn of Court and is an Executive Committee member of the New Jersey State Bar Association’s Labor and Employment Law Section. He also serves on the State Advisory Council to the Rutgers University, School of Management and Labor Relations.

All Employment and Workplace Law Certificate Program classes take place at the Rutgers University Labor Education Center, 50 Labor Center Way, New Brunswick. Certification Requirements Participants must complete six courses to receive the Employment and Workplace Law Certificate Program Certificate. While the program begins in September, learners may enroll in individual courses at any time.
