RURAL SCHOOL BOARDS--General Statements 1

In order to qualify for the position of school board member a person a must be a citizen of the United States. b must be a resident taxpayer in the district and shall have paid a statOe and county tax within one year next preceding his or her election. c shall have resided in this state for one year next preceding his or her election. d must be twenty-one years of age. Section 10420, R . S., 1939. 2 School board members must take their oath of office within four days after their election or appointment. Section 10421, R. S., 1939. . . 3 New school boards must meet in the district and orga nize within four days after the annual meeting: No member of the school board shall receive any compensation for performing the duties of a director. Section 10422. 4 If a vacancy occurs in the office of director , by death, resignation, refusal to serve, repeated neglect of -duty or removal from the district the remaining directors shall, befor~ the transaction of any official business, appoint some suitable person to fi ll the vacancy. The school board shall provide an eight months' school each year-or district may forfeit its organization. Section 10324, R. S., 1939. Free transportation of pupils may be provided by the school board when deemed advisable or when petitioned by ten taxpayers. Section 10326, R . S., 1939. The school board may be authorized to borrow money for the purpose of purchasing school house sites, erecting school houses, etc., and furnishing the same. The question of loan or issue of bonds shall be decided at the annual school meeting or special election. Section 10328, R. S., 1939. The board of directors may issue bonds: a To purchase school house sites, erect school houses, library buildipgs and furnish same, for additions and repairs. Section 10328, R. S., 1939. b To pay special taxes for sewers, sidewalks, etc. Section 10329, R. S., 1939. c To renew, payoff or exchange for outstanding bonds. Sections 10332 and 10333, R. S., 1939. Redeemed bonds shall be burned by the school officials. Section 10334, R. S., 1939. . The school board shall levy an annual tax to constitute a sinking fund for the redemption of bonds. Section 10335, R . S., 1939. The school board shall levy an annual tax to pay the i"terest on all outstanding bonds. Section 10336, R. S., 1939. The care and keeping of all property belonging to the school district is vested in the school board. Section 10337. Lunches may be provided at cost for school children at the discretion of the school board. Section 10339. The school board shall have the power to make all needful rules and regulations for the school. Section 10340. The school board has the power to require any child suffering from any contagious or infectious disease to be examined by a physician to determine whether or not said child shall be excluded from school. Section 10341. The school board may contract with and employ legally qualified teachers, not a board member or related. Both teacher and board are equally bound by the terms of the contract. Sections 10342 and 10343, R. S., 1939. It shall be the duty of the school board to visit the schools under its care. Section 10344, R. S., 1939. A t the direction of the school board the enumeration shail be taken between the thirtieth day of April and the fifteenth day of May of each yeaL This shall be forwarded to the county superintendent of schools. Section 10345,-R. S., 1939. Gratuitous education may be provided by the school board for resident persons in the district between the ages of five and six years and over twenty years of age. Section 10346, R. S., 1939. On .or before the fifteenth day of May of each year, the school board shall forward to the county superintendent of schools an estimate of the amoun t of funds necessary to maintain their schools for the ensuing school year. Section 10347, R. S., 1939. The school board may condemn land for schoolhouse sites. Section 10348, R. S., 1939. Separate free schools for colored children shall be established by the school board. Sections 10349 and 10350. The school board may provide for the instruction of defectives or may contract with other districts to provide such instruction. Sections 10351, 10352 and 10357, R. S., 1939. An election to increase the tax levy for school purposes may be held whenever the school board deems it necessary or when the board is petitioned, .in writing, by five resident taxpayers. Section 10358, R. S., 1939. The school board may provide for an election to increase the tax levy for erecting schoolhouses and similar purposes. A petition, in writing, by ten resident taxpayers, shall authorize the board to call an election for this purpose. Section 10359, R. S., 1939. The school board shall give notice of all annual or special meetings as provided by section 10418. Sections 10360 and 10361, R. S., 1939. Any school board member who shaIl wilfully neglect or refuse to perform any duty or duties pertaining to his office, shaIl be regarded as guilty of a misdemeanor * * * Section 10365, R. S., 1939. Moneys derived from taxation shaIl be paid out for the purposes only for which levied and collected. Warrants shall be in statutory form. The treasurer shall open an account for each fund and each warrant shall be paid from its appropriate fund. The treas urer shall not honor any warrant in excess of district's income for the school year, i. e., July 1st to June 30th., Partial payments shall not be paid on warrants, nor shall interest be paid. Section 10366, R S., 1939. Any school board member who encourages or endorses a teacher in unlawful conduct regarding illegal certification shall be deemed guilty of a misdemeanor and punishable by a fine. Section 10368, R. S., 1939. Wheneve,- the average daily attendance of any school is less than fifteen, the school board may provide for the payment of tuition and transportation of the children to other districts. LI939-705. The school board shall order the payment of warran ts for legal indebtedness and shall see that said warrants are paid from the proper funds. Section 10429, R. S., 1939; L1939-705. Teachers' warrants shall not be ordered paid by the school board until all required monthly and term reports are properly made and filed with the district clerk. Section 10433, R. S., 1939. Surplus school funds may be loaned by the school board upon application to the county court. Sections 10434 and 10435, R. S., 1939. School boards in districts having special charters may have said charters surrendered and may place the districts under the general laws of the state. Sections 10436, 10437, 10438, 10439, 10440, 10441, R. S., 1939. The board of directors may purchase books for indigent children from incidental fund, Sections 10652, 10653, 10654, and by majority vote of district, may furnish free books for all or any part of the pupils. Section 10661. School houses may be used free of charge, or the board of directors may charge for use of school house or grounds for free discussion of public questions, or for social, civic or educational purposes. Section 10337, R. S., 1939. The school board shall certify to the county court that free textbooks have been provided in order to use the foreign insurance money for this purpose. Section L39-705, R. S., 1939. The school board shall maintain the public school or schools at least eight months in each year. Section 10454 School Laws, R. S., 1939. A "free textbook fund" shall be kept by each school board and all foreign insurance money shaIl be placed in this fund. Free textbooks shaIl be provided by the school board when authorized by the voters in the district. Section 10462, R. S., 1939.

General Statements 1 The district clerk may be elected at any meeting of the board after its organization in April, but his duties do not begin until July 15. He mayor may not be a member of the board. The district clerk is not entitled to any salary until all reports required by law have been made. Section 10422, R. S., 1939. 2. 3

The district clerk is appointed by the board and holds his place at the option of the board. He may, therefore, be removed at any time for dereliction of duty. However, he still retains his position as a member of the board. Section 10424, R. S., 1939.

Any district clerk * * * who shall wilfully neglect or refuse to perform any duty or duties pertaining to his office may be prosecuted for neglect of duty. Section 10365, R. S., 1939.

He shall keep a record of the proceedings of all annual and special meetings of the qualified voters of the district. Copies of all election notices, contracts with teachers, certificates and all other papers relating to the business of the district must be made and securely kept. On or before the fifteenth day of July each year he shall make his annual report to the county superintendent of schools. Section 10426, R. S., 1939.

The district clerk shall record a copy of all reports made by him to the county superintendent of schools. He must enter upon the district record any change in boundary voted at annual meetings, notify the county clerk of same and record all changes in the boundary which may be made by boards of arbitration. He must keep an accurate record of the plat of his district in the minute book. Sections 10410 and 10432, R. S., 1939 .

He shall keep a record of redeemed and renewal bonds as prescribed by law. Sections 10332 and 10334, R. S., 1939.

The teacher's certificate shall be filed with the clerk during the school term. of the time he shall return it to the teacher. Section 10342, R. S., 1939.

Upon the order of the board of directors, it shall be the duty of the district clerk to draw all warrants on the county or township treasurer for legal indebtedness. These warrants shall be paid from the proper fund. Sections 10429 and L. 1939-707, R. S., 1939.

The secretary or clerk of the school board shall keep a record of all renewal or refunding bonds issued and shall also keep a full record of all transactions that may be necessary for the identification of such bonds. Section 10332, R. S., 1939.

At the opening of each school term he shall furnish the teacher with a copy of the last enumeration list of the district. Section 1059 1, R. S., 1939.

He shall procure all necessary record books for the proper transaction of the duties of his office. The district clerk shall also provide a suitable attendance register for each teacher. Section 10427, R. S., 1939.

Between June 15th and June 30th of each year he shall report to the county clerk under oath: Number of teachers employed and salary of each, total number of days attendance of all pupils, length of school term, average attendance, days taught by each teacher, so that the state money may be obtained.

He shall attend all meetings of presidents of school boards and cl~rks of school districts when said meetings are called by the county superintendent of schools. Section 10624, R. S., 1939.

SUGGESTIONS FOR RECORDING MINUTES AND FOR ORDER OF PROCEDURE IN SCHOOL BOARD MEETINGS

According to law, no official business can be transacted by a board of education except in an authorized meeting with a majority of the members present. The minute book, as the original and legal record of the official actions of the board at its meetings, is the most important record of a school system. Hence, the minutes should be promptly and accurately recorded and safely and permanently retained. To expedite the work of the clerk or seuetary of the board, as the official caretaker of the minutes, detailed suggestions follo~: a.

At each meeting the clerk should fill in all preliminary information, called for by the headings given at the top of the minute-record form.

Number all meetings consecutively throughout the school fiscal year; state whether the meeting is a regular, special, or adjourned meeting; and indicate the place where the meeting is being held. If the meeting is a sp ecial meeting, indicate the purpose of the meeting and include a copy of the notice of the special meeting in the minutes.

Record in full the date and the time of day when the meeting is held.

Record the call to order arid the roll call; list the names of (I) presiding officer, (2) members present, and (3) absent members. Record in the minutes if a member arrives or leaves during the meeting and before adjournment.

Read prepared minutes of previous meeting unless copies are sent to members for correction prior to the meeting. Record action of board (correction-if necessary-and approval). Immediately upon approval, the president and clerk should sign in the minute book below record of the last meeting for the previous minutes.

During the meeting, as it is brought up for board a:ction, note briefly the presentation and disposal of each item of business, whether communication, discussion, or resolution. This notation should be made, preferably, on stenographic or note paper, as a preliminary to leisurely recopying into the permanent minute book as soon as convenient after the meeting IS over.

Immediately after it is made, record the exact wording of each motion or resolution, together with the names of the persons making and seconding the motion. Indicate final action of board on each resolution and list names of those members voting aye, those voting nay, . and those not voting. Similarly record all amendments to motions.

Important written communications or evidence, such as audits, budget estimates, notice of bond elections, and official reports, should be copied into or firmly attached to the minuterecord form in the appropriate place as an integral part of the permanent record.

When claims or bills are approved for payment, list in the minute book the number of each voucher (or warrant if vouchers are not used) , offered for payment, the name of the payee, and the amount of the approved claim.

Indicate by a concise marginal note or index, placed in the left-hand margin opposite the head of the paragraph, the main topic or purpose of each item of business, such as adoption of budget estimate, approval of bills, purchase of bus, etc. Number each individual item consecutively and place the number in the left-hand margin, immediately below the marginal or topical notation.

The district record should show the facts concerni ng the election of teachers, name of teachers, number of months to be taught and wages per month to be paid. Court Construction, Section 10342, R. S., 1939. 1 No teacher shall be employed to teach who does not possess a legal certificate which must be in force for the full time for which the contract is made. A teacher shall not serve as clerk of the district. Section 10342, R. S., 1939. 2 The teacher cannot bind the district for the services of a janitor. All contracts made with the directors when not assembled as a board are void. Court Construction, Section 10337, R. S., 1939. 3 The school board shall provide the teacher with a copy of the rules and regulations for the organization, grading and government of its school. Section 10340, R. S., 1939. 4 Both the school board members and the teacher are equally bound by the terms of the contract when it is duly made and signed by the contracting parties. If a teacher's certificate is revoked the contract is thereby annulled. The rules and regulations of the school board when tendered in writing constitute a part of the contract and due compliance therewith must be given. Section 10343, R. S., 1939. 5 A teacher's certificate may expire before the close of the term for which he is hired. It is mandatory that he have a certificate in full force at the opening of the term for which he is employed. Section 10367, R. S., 1939. 6 Any teacher who shall enter a public school to teach school and who has not complied with the provisions of Sections 10342 and 10367, shall be deemed guilty of a misdemeanor and punishable by a fine. Section 10368, R. S., 1939. 7 The teacher must make all monthly reports an d file them with the district clerk at the close of each month before the monthly salary shall be paid. In ad dition a term report shall be filed at the close of the year. Section 10433, R. S., 1939. 8 No teacher shall receive the last month's salary until he or she presents a receipt for the term report signed by the county superintendent. Section 10615, R. S., 1939. 9 No person shall be granted a license to teach who is not of good moral character. Section 10627, R. S.: 1939. 10 A teache;'s certificate may be revoked by the county superinttrdent upon satisfactory proof of incompetency, lmmorahty, neglect of duty or the annulling of written contracts with the board of directors without the consent of the majority of the members of the board which is a party to such contract.
